Extraordinary Council Meeting Thursday 18 September 2014
held at Murwillumbah Cultural and Civic Centre commencing at 5.00pm
COUNCIL'S CHARTER
Tweed Shire Council's charter comprises a set of principles that are to guide Council in the carrying out of its functions, in accordance with Section 8 of the
Local Government Act, 1993.
Tweed Shire Council has the following charter:
• to provide directly or on behalf of other levels of government, after due
consultation, adequate, equitable and appropriate services and facilities for the community and to ensure that those services and facilities are managed efficiently and effectively;
• to exercise community leadership;
• to exercise its functions in a manner that is consistent with and actively promotes the principles of multiculturalism;
• to promote and to provide and plan for the needs of children;
• to properly manage, develop, protect, restore, enhance and conserve the
environment of the area for which it is responsible, in a manner that is consistent with and promotes the principles of ecologically sustainable development;
• to have regard to the long term and cumulative effects of its decisions;
• to bear in mind that it is the custodian and trustee of public assets and to effectively account for and manage the assets for which it is responsible;
• to facilitate the involvement of councillors, members of the public, users of facilities and services and council staff in the development, improvement and co-ordination of local government;
• to raise funds for local purposes by the fair imposition of rates, charges and fees, by income earned from investments and, when appropriate, by borrowings and grants;
• to keep the local community and the State government (and through it, the wider community) informed about its activities;
• to ensure that, in the exercise of its regulatory functions, it acts consistently and without bias, particularly where an activity of the council is affected;
• to be a responsible employer.
The Meeting commenced at 5.00pm.
IN ATTENDANCE
Cr B Longland (Mayor), Cr M Armstrong (Deputy Mayor), Cr G Bagnall, Cr C Byrne, Cr K Milne, Cr W Polglase and Cr P Youngblutt.
Also present were Mr Troy Green (General Manager), Mr Neil Baldwin (Acting Director Corporate Services), Mr David Oxenham (Director Engineering), Mr Vince Connell (Director Planning and Regulation), Ms Jane Lofthouse (Acting Director Community and Natural Resources), Mr Peter Brack (Corporate Compliance Officer) and Mrs Maree Morgan (Minutes Secretary).
ABORIGINAL STATEMENT
The General Manager acknowledged the Bundjalung Aboriginal Nation with the following statement:
"We wish to recognise the generations of the local Aboriginal people of the Bundjalung Nation who have lived in and derived their physical and spiritual needs from the forests, rivers, lakes and streams of this beautiful valley over many thousands of years as the traditional owners and custodians of these lands."
PRAYER
The meeting opened with a Prayer by Council's Chaplain, Pastor Peter Howard of Murwillumbah Seventh Day Adventist Church.
"Dear Father
On this day 18th September 2014 and in particular for this occasion the meeting of the Tweed Shire Council we humbly come into your presence. As the creator and Sustainer of all things, animate and inanimate we are more thankful today that you are graciously proactive with the wellbeing of all life. I thank you also that you are the Author and Finisher of our faith that continues to provide direction to our lives, moment by moment and day by day. To You the Great "I AM" of all time, past, present and future I invite you to incline your ears and your heart to all those here today. May it be as you look down upon us today you have an amazing sense of pride as you bear witness of the goings on here today in this Council Chamber?
It is an awesome privilege to lead those attending this meeting today to your throne of Grace, Mercy and Justice. Please abundantly bless our Mayor and Councillors of the Tweed Shire District Council as well as the Administrative support team and the members of the public who have come together to attend the needs to the community
bitumen be of priority? May it not be the structures created for the community that motivated expenditure of the public purse but may it be those who benefit from the blessings of such structure become the real focus of the Council's attention.
Thank you now Father for the awe inspiring part of Your creation in which we have the pleasure to reside and serve you. Your gifting of such a beautiful environment to us is beyond comprehension, we stand amazed at the beauty that daily surrounds us, which is never constant but always changing. Not only is this the perfect environment in which to work but also to relax. What a delightful place to share with family, friends, visitors and work colleagues. Bless us now dear Father as we all seek to harmoniously work together for the enrichment of the people and the place we can so wonderfully for now call home. May you grace and peace be working through us all as we endeavour to glorify your name in the beautiful place the Tweed Valley.

1 [GM-EXT] Method of Election of Mayor and Deputy Mayor for Period Ending September 2015
The General Manager advised the methods available to Council for the Election of the Mayor and Deputy Mayor for the period ending September 2015.

RESOLVED that Council determines the procedure for electing the Mayor/Deputy Mayor to be Ordinary Ballot by way of open voting which is in accordance with Schedule 7 of the Local Government (General) Regulation 2005.
The Motion was Carried FOR VOTE - Unanimous
2 [GM-EXT] Election of Mayor and Deputy Mayor for Period Ending September 2015
The General Manager/Returning Officer advised that two nominations had been received for Mayor:
• Cr W Polglase nominated by Councillors Polglase and Cr Youngblutt;
• Cr G Bagnall nominated by Councillors Armstrong and K Milne;
The result of the ballot by way of Ordinary Ballot by way of open voting (show of hands) for Mayor was as follows:
Voting for Cr W Polglase for Mayor:
FOR VOTE - Cr P Youngblutt, Cr W Polglase, Cr C Byrne Voting for Cr G Bagnall for Mayor:
FOR VOTE - Cr M Armstrong, Cr K Milne, Cr G Bagnall, Cr B Longland
The General Manager/Returning Officer advised that two nominations had been received for Deputy Mayor:
• Cr P Youngblutt nominated by Councillors C Byrne and P Youngblutt;
• Cr M Armstrong nominated by Councillors K Milne and G Bagnall;
The result of the ballot by way of Ordinary Ballot by way of open voting (show of hands) for Deputy Mayor was as follows:
Voting for Cr P Youngblutt for Deputy Mayor:
FOR VOTE - Cr P Youngblutt, Cr W Polglase, Cr C Byrne, Cr B Longland
Voting for Cr M Armstrong for Deputy Mayor was not required as there was a clear majority for Cr P Youngblutt.
Based on the above voting, the General Manager/Returning Officer declared the following:
1. Mayor for the period ending September 2015 - Cr G Bagnall.
2. Deputy Mayor for the period ending September 2015 - Cr P Youngblutt.
There being no further business the Meeting terminated at 5.09pm
