PERSETUJUAN ANTARA PEMERINTAH REPUBLIK INDONESIA DAN PEMERINTAH REPUBLIK ISLAM AFGHANISTAN MENGENAI

PEMERINTAH REPUBLIK ISLAM AFGHANISTAN MENGENAI

PEMBEBASAN VISA BAGI PEMEGANG PASPOR DIPLOMATIK DAN PASPOR

DINAS

Pemerintah Republik Indonesia dan Pemerintah Republik Islam Afghanistan, selanjutnya disebut sebagai "Para Pihak";

MENIMBANG hubungan persahabatan antara kedua negara;

BERHASRAT untuk lebih memperkuat hubungan tersebut, secara timbal balik, dengan memfasilitasi izin masuk warga negara Republik Indonesia dan warga negara Republik Islam Afghanistan ke wilayah negara masing-masing;

SESUAI dengan hukum dan peraturan perundang-undangan yang berlaku di masing-masing negara;

TELAH MENYETUJUI hal-hal sebagai berikut:

PASAL 1 PEMBEBASAN VISA

Warga Negara Republik Indonesia atau Warga Negara Republik Islam Afghanistan, pemegang paspor diplomatik atau paspor dinas yang sah, wajib

tidak dipersyaratkan untuk memperoleh visa untuk masuk, singgah, dan tinggal di wilayah negara Pihak lainnya untuk suatu jangka waktu yang tidak melebihi tiga puluh (30) hari terhitung sejak setiap tanggal masuk.

PASAL 2

MASA BERLAKU PASPOR YANG SAH

Masa berlaku paspor dari warga negara salah satu Pihak wajib sekurang-kurangnya enam (6) bulan sebelum memasuki wilayah Pihak lainnya.

PASAL 3 PEMBATASAN VISA

Pemegang paspor yang sah dari salah satu Pihak sebagaimana dirujuk dalam Persetujuan ini dapat masuk dan keluar dari wilayah negara Pihak lainnya di setiap titik yang diizinkan untuk maksud tersebut oleh pihak imigrasi yang berwenang, tanpa pembatasan apapun kecuali di tempat-tempat yang ditentukan bagi syarat-syarat keamanan, migrasi, bea cukai dan persyaratan kesehatan serta persyaratan lainnya yang secara hukum diterapkan kepada pemegang paspor diplomatik dan paspor dinas.

PASAL4

VISA BAGI ANGGOTA MISI DIPLOMATIK DAN KONSULER

1. Warga Negara Republik Indonesia pemegang paspor diplomatik atau paspor dinas Indonesia yang sah dan ditugaskan sebagai anggota misi diplomatik atau konsuler Republik Indonesia di dalam wilayah Republik Islam Afghanistan, termasuk anggota keluarga mereka, wajib mendapatkan visa masuk yang sesuai dari Kedutaan Besar Republik Islam Afghanistan di Jakarta.

2. Warga Negara Republik Islam Afghanistan pemegang paspor diplomatik atau paspor dinas Afghanistan yang sah dan ditugaskan sebagai anggota misi diplomatik atau konsuler Republik Islam Afghanistan di dalam wilayah Republik Indonesia, termasuk anggota keluarga mereka, wajib mendapatkan visa masuk yang sesuai dari Kedutaan Besar Republik Indonesia di Kabul.

PASAL 5

HAK PIHAK YANG BERWENANG

1. Persetujuan ini tidak membebaskan warga negara salah satu Pihak dari kewajiban untuk menghormati hukum dan peraturan perundang-undangan negara Pihak lainnya saat memasuki wilayah negara Pihak tersebut, termasuk

namun tidak terbatas pada hukum dan perundang-undangan mengenai masuk, tinggal dan keluarnya orang asing.

2. Persetujuan ini tidak akan mempengaruhi hukum dan/atau perundang-undangan yang berlaku di kedua negara berkaitan dengan keamanan internal dan masuk1 tinggal atau pergerakan orang asing.

3. Para Pihak berhak untuk menolak memberikan 1zin masuk atau memperpendek masa tinggal setiap orang yang berhak atas pembebasan visa dan fasilitas-fasilitas berdasarkan Persetujuan ini apabila orang tersebut dianggap tidak diinginkan.

PASAL 6 PENANGGUHAN

1. Salah satu Pihak dapat menunda sementara waktu Persetujuan ini baik seluruhnya maupun sebagian, dengan alasan keamanan nasional, ketertiban umum atau kesehatan masyarakat.

2. Pemberlakuan dan pengakhiran dari Penangguhan Persetujuan ini sebagaimana dimaksud pada ayat 1 Pasal ini harus segera diberitahukan kepada Pihak lainnya secara tertulis melalui saluran diplomatik.

PASAL 7

CONTOH DAN PENERBITAN PASPOR ATAU DOKUMEN PERJALANAN 1. Pejabat yang berwenang dari Para Pihak wajib saling bertukar, melalui

saluran diplomatik, contoh-contoh paspor diplomatik dan dinas yang sah mereka dalam jangka waktu tiga puluh (30) hari setelah penandatanganan Persetujuan ini.

2. Dalam hal pengenalan paspor diplomatik dan dinas baru, serta modifikasi terhadap yang telah ada, pejabat yang berwenang Para Pihak wajib saling memberitahukan secara tertulis, melalui saluran diplomatik, mengenai setiap perubahan tidak lebih dari tiga puluh (30) hari sebelum pengenalan resminya. 3. Dalam hal warga negara dari salah satu Pihak kehilangan atau rusak paspor

diplomatik atau paspor dinasnya di wilayah Pihak lainnya, ia wajib memberitahukan kepada pejabat berwenang di negara Pihak yang menerima untuk tindakan selanjutnya. Misi diplomatik atau kantor konsuler yang bersangkutan wajib menerbitkan paspor atau dokumen perjalanan baru kepada orang yang dimaksud dan memberitahukan pejabat yang berwenang dari negara penerima.

PASAL 8

PENYELESAIAN SENGKETA

Setiap sengketa antara Para Pihak mengenai penafsiran atau penerapan dari Persetujuan ini wajib diselesaikan secara damai melalui konsultasi atau perundingan.

PASAL 9 PERUBAHAN

Persetujuan ini dapat diubah atau direvisi setiap waktu melalui kesepakatan bersama secara tertulis oleh para pihak. Perubahan atau revisi tersebut wajib mulai berlaku pada tanggal yang ditentukan oleh Para Pihak dan merupakan suatu kesatuan dari Persetujuan ini.

PASAL10

MULAI BERLAKU, JANGKA WAKTU DAN PENGAKHIRAN

1. Persetujuan ini mulai berlaku tiga puluh (30) hari sejak tanggal penerimaan

pemberitahuan terakhir secara tertulis dimana Para Pihak saling

memberitahukan, melalui saluran diplomatik, bahwa semua persyaratan untuk mulai berlakunya Persetujuan ini, sebagaimana tercantum dalam masing-masing perundang-undangan nasionalnya telah dipenuhi.

2. Persetujuan ini tetap berlaku untuk jangka waktu 5 (lima) tahun dan dapat diperpanjang untuk jangka waktu 5 (lima) tahun berikutnya dengan kesepakatan bersama secara tertulis, kecuali salah satu Pihak memutuskan untuk mengakhiri Persetujuan ini dengan pemberitahuan secara tertulis kepada Pihak lainnya, melalui saluran diplomatik, setidak-tidaknya 6 (enam) bulan sebelum tanggal pengakhiran yang diinginkan.

SEBAGAI BUKTI yang bertanda tangan di bawah ini, telah menandatangani

DIBUAT di Bali, Indonesia pada tanggal 9 bulan November tahun 2012 atau

sama dengan tanggal 19/8/1391, rangkap dua, masing-masing dalam Bahasa

Indonesia, Pashto, Dari, dan Bahasa lnggris, semua naskah memiliki kekuatan

hukum yang sama. Dalam hal terjadi perbedaan penafsiran, naskah Bahasa

lnggris wajib berlaku.

REPUBLIK INDONESIA

AGREEMENT BETWEEN

THE GOVERNMENT OF THE REPUBLIC OF INDONESIA AND

THE GOVERNMENT OF THE ISLAMIC REPUBLIC OF AFGHANISTAN ON

VISA EXEMPTION FOR HOLDERS OF DIPLOMATIC AND SERVICE PASSPORTS

The Government of the Republic of Indonesia and the Government of the Islamic Republic of Afghanistan (hereinafter referred to as the "Parties");

CONSIDERING the existing friendly relations between the two countries;

DESIRING to further strengthen such relations, on a reciprocal basis, by facilitating the entry of nationals of the Republic of Indonesia and the Islamic Republic of Afghanistan into their respective countries;

PURSUANT to the prevailing laws and regulations of the respective countries; HAVE AGREED as follows:

ARTICLE 1 VISA EXEMPTION

Nationals of the Republic of Indonesia or nationals of the Islamic Republic of Afghanistan, holding valid diplomatic or service passport, shall not be required to obtain a visa to enter, transit, and stay in the territory of other Party for a period which does not exceed thirty (30) days from the date of entry.

ARTICLE 2

DURATION OF PASSPORT VALIDITY

The duration of passport validity of nationals of either Party shall be at least six (6) months before entering the territory of the other Party.

ARTICLE 3 VISA RESTRICTION

The holders of the valid passport of either Party referred to this Agreement may enter into and depart from the territory of other Party by any point authorized for that purpose by the competent immigration authorities, without any restriction except for those stipulated in the security, migratory, custom and sanitary provisions and others which may be legally applicable to holders of diplomatic and service passports.

ARTICLE 4

VISA FOR MEMBERS OF DIPLOMATIC OR CONSULAR OFFICES

1. Nationals of the Republic of Indonesia who are holders of valid Indonesian diplomatic or service passport who are assigned as members of the diplomatic or consular mission of the Republic of Indonesia in the Islamic Republic of Afghanistan, including their family members, shall be required to obtain appropriate entry visa from the Embassy of the Islamic Republic of Afghanistan in Jakarta.

2. Nationals of the Islamic Republic of Afghanistan who are holders of valid Afghan diplomatic or service passport who are assigned as members of the diplomatic or consular mission of the Islamic Republic of Afghanistan in the Republic of Indonesia, including their family members, shall be required to obtain appropriate entry visa from the Embassy of the Republic of Indonesia in Kabul.

ARTICLE 5

THE RIGHTS OF AUTHORITIES

1. This Agreement shall not exempt nationals of either Party from the obligation to respect the laws and regulations of the other Party when entering into its territory, including but not limited to the laws and regulations concerning the entry, stay and exit of foreigners.

2. This Agreement does not affect the applicable laws and/or regulations of the two countries relating to internal security and the entry, stay or movement of foreigners.

3. Either Party reserves the right to refuse admission of entry or shorten the duration of stay of any person entitled to visa exemption and facilities under this Agreement if it considers that person undesirable.

ARTICLE 6 SUSPENSION

1. Each Party may temporarily suspend this Agreement either in whole or in part, with the reasons of national security, public order or public health.

2. The introduction as well as termination of the measures stated in paragraph 1 of this Article shall be duly informed to other Party through diplomatic channels.

ARTICLE 7

SPECIMEN AND ISSUANCE OF PASSPORTS OR TRAVEL DOCUMENTS 1. The competent authorities of the Parties shall exchange, through diplomatic

channels, specimens of their respective passports within thirty (30) days after signing this Agreement.

2. In case of introduction of a new diplomatic or service passport, as well as modifications of the existing ones, the competent authorities of the Parties shall inform each other in writing, through diplomatic channels, about any changes and send the new specimens not later than thirty (30) days prior to their official introduction.

3. If a national of either Party losses his/her valid diplomatic or service passport, in the territory of the other Party, he/she shall inform the concerned authorities of the receiving Party for appropriate action. The concerned diplomatic mission or consulate shall issue a new passport or travel document to the aforementioned national and inform the competent authorities of the receiving Party.

ARTICLE 8

SETTLEMENT OF DISPUTES

Any disputes between the Parties on the interpretation or implementation of this Agreement shall be settled amicably through consultations or negotiations.

ARTICLE 9

AMENDMENT

This Agreement may be amended or revised at any time by mutual consent in writing by the two Parties. Such amendment or revision shall enter into force on

such a date as may be determined by the Parties and form as integral part of this

Agreement.

ARTICLE 10

ENTRY INTO FORCE, DURATION AND TERMINATION

1. This Agreement shall enter into force thirty (30) days from the date of the

receipt of the last written notification in which the Parties inform each other,

through diplomatic channels, that all requirements for the entry into force of

this Agreement, as stipulated by their respective national legislation have been fulfilled.

2. This Agreement shall remain in force for a period of 5 (five) years and may be renewed for further period of 5 (five) years by mutual consent of the Parties in

writing, unless either Party decides to terminate this Agreement by giving written notice to the other Party, through diplomatic channels, at least 6 (six)

months prior to the expected termination date.

IN WITNESS WHEREOF, the undersigned, have signed the present Agreement.

DONE at Bali, Indonesia on the November 91h, 2012 equal to 19/8/1391 in two

originals, each in Indonesian, Pashto, Dari, and English languages, all texts

being equally authentic. In case of any divergence in their interpretation, the

English text shall prevail.
