TENT ANG
PEMBENTUKAN KOMISI BERSAMA UNTUK KERJA SAMA BILATERAL
Kementerian Luar Negeri Republik Indonesia dan Kementerian Luar Negeri dan Warga Guinea di Luar Negeri Republik Guinea (selanjutnya disebut secara terpisah sebagai "Pihak" dan secara bersama sebagai "Para Pihak");
MENGINGINKAN untuk mengembangkan dan meningkatkan hubungan dan kerja sama bilateral yang dapat bertahan dalam jangka waktu yang lama;
MEYAKINI perlunya kerja sama efektif dan berkesinambungan yang menjadi kepentingan dari Para Pihak;
MENEGASKAN kepentingannya untuk memperkuat kerja sama bilateral di antara kedua negara berdasarkan prinsip-prinsip persamaan, saling menguntungkan dan penghormatan penuh terhadap kedaulatan; dan
MEMERHATIKAN perjanjian yang telah ada antara kedua negara di berbagai bidang;
SESUAI dengan hukum dan peraturan perundang-undangan yang berlaku di masing-masing Pihak;
PASAL1
Pembentukan Komisi Bersama
Para Pihak akan membentuk sebuah Komisi Bersama (selanjutnya disebut sebagai "Komisi") untuk memfasilitasi konsultasi dan kerja sama antara kedua negara di berbagai bidang bilateral, regional, dan global, termasuk bidang politik, ekonomi, perdagangan, budaya, dan teknis, maupun bidang lainnya sesuai kepentingan bersama.
PASAL2 Tujuan
Komisi akan mempertimbangkan cara dan upaya untuk memajukan konsultasi dan kerja sama sebagaimana tertuang pada Pasal 1 serta memastikan adanya koordinasi dan pelaksanaan yang tepat atas Memorandum Saling Pengertian (MSP) ini.
PASAL 3 Prosedur Ketentuan
Komisi akan menentukan aturan-aturan dan prosedur, dan, apabila diperlukan, dapat membentuk Komite, Sub-Komite dan/atau Kelompok Kerja untuk membahas isu-isu spesifik yang telah ditentukan sebelumnya.
PASAL4 Lingkup Kerja Sama
Lingkup kerja sama dari Komisi mencakup:
1. Memajukan hubungan bilateral dan kerja sama melalui promosi dan pelaksanaan proyek-proyek bilateral dan hal-hal saling menguntungkan lainnya;
2. Mengoordinasikan kegiatan kerja sama yang telah ada antara Kementerian dan badan kedua negara yang merupakan focal point untuk implementasi perjanjian bilateral dengan maksud untuk mencapai tujuan utama pada Ayat (1 );
3. Mengoordinasikan tugas berbagai Komite, Sub-Komite, dan Kelompok Kerja dan memberikan rekomendasi untuk berbagai badan yang ada dan dianggap
perlu sehingga memudahkan tugas Komite. Sub-Komite. dan Kelompok Kerja tersebut;
4. Mendapatkan informasi secara teratur dari hasil pertemuan berbagai Komite, Sub-Komite, dan Kelompok Kerja.
PASAL 5 Komposisi
1. Komisi Bersama akan berada pada tingkat menteri dan/atau perwakilannya yang merupakan Pejabat Senior;
2. Pertemuan Komisi Bersama akan diketuai oleh Menteri Luar Negeri atau Pejabat Senior yang mewakili Kementerian Luar Negeri dari Para Pihak, dan akan terdiri dari Pejabat Senior yang relevan yang mewakili
Kementerian/lnstitusi pemerintah terkait maupun sektor swasta terkait;
3. Setiap Pihak akan menentukan besar dan komposisi delegasinya untuk pertemuan Komisi;
4. Keketuaan Pertemuan Komisi Bersama akan secara bersama-sama dipimpin oleh Ketua delegasi masing-masing pada pertemuan Komisi dimaksud.
PASAL 6
Pertemuan Pejabat Senior
1. Persiapan untuk Pertemuan Komisi Bersama akan dilaksanakan oleh Pejabat Senior dari masing-masing Kementerian Luar Negeri kedua Pihak;
2. Pejabat yang disebutkan dalam Pasal 6 Ayat (1) di atas akan menjadi ketua bersama pertemuan sebelum pelaksanaan Pertemuan Komisi Bersama; 3. Pejabat Senior memastikan pelaksanaan seluruh keputusan dan rekomendasi
Komisi Bersama.
PASAL 7
Frekuensi Pertemuan
Komisi akan bertemu setiap dua tahun atau pada waktu yang disepakati oleh Para Pihak, secara bergantian di Indonesia dan Guinea.
PASAL
8
Agenda1. Tanggal, tempat, agenda dan hal-hal lainnya akan disepakati oleh para Pihak;
2. Agenda sementara untuk Pertemuan Komisi Bersama akan diajukan oleh Tuan Rumah sekurang-kurangnya dua bulan sebelum tanggal pertemuan yang dijadwalkan.
PASAL 9
Catatan1. Hasil pertemuan Komisi yang disepakati oleh kedua Pihak akan dituangkan dalam bentuk Agreed Minutes;
2. Pihak Tuan Rumah bertanggung jawab atas persiapan Agreed Minutes
tersebut;
3. Seluruh hasil Pertemuan Komisi Bersama dijaga kerahasiaannya. Namun demikian, Komisi dapat mengeluarkan pernyataan kepada Pers apabila dipandang perlu.
PASAL10
Jalur KomunikasiSeluruh komunikasi dilakukan melalui saluran diplomatik antara kedua negara.
PASAL11
Kewajiban Finansial1. Pihak tuan rumah menyediakan tempat, kesekretariatan, dan transportasi lokal untuk pertemuan atas biaya sendiri;
2. Setiap Pihak menanggung biaya masing-masing untuk menghadiri pertemuan.
PASAL12
Penyelesaian Perselisihan
Setiap perbedaan atau perselisihan antara Para Pihak yang timbul dari penafsiran dan/atau pelaksanaan MSP ini diselesaikan secara damai melalui konsultasi dan/atau negosiasi antara Para Pihak.
PASAL13
Revisi dan Perubahan
Salah satu Pihak dapat meminta secara tertulis, setiap revisi atau perubahan dari keseluruhan atau sebagian MSP ini. Setiap revisi atau perubahan disetujui oleh Para Pihak akan mulai pada tanggal yang disepakati oleh Para Pihak dan menjadi bagian yang tidak terpisahkan dari MSP ini.
PASAL14
Ketentuan Penutup1. MSP ini mulai berlaku sejak tanggal penandatanganannya;
2. MSP ini akan berlaku untuk jangka waktu 5 (lima) tahun dan akan secara otomatis diperpanjang untuk jangka waktu 5 (lima) tahun berikutnya, kecuali salah satu Pihak berkeinginan untuk mengakhiri MSP ini, dengan membuat pemberitahuan secara tertulis 6 (enam) bulan sebelumnya, melalui saluran diplomatik;
3. Dalam hal terjadi pengakhiran, ketentuan-ketentuan dalam MSP ini tetap
berlaku bagi program-program yang masih berjalan hingga selesainya
program tersebut, kecuali disepakati lain oleh Para Pihak. Pengakhiran juga
tidak akan memengaruhi keabsahan kesepakatan teknis antara Pihak
termasuk yang telah ditandatangani sesuai dengan ketentuan MSP ini, kecuali
SEBAGAI BUKTI, yang bertanda tangan di bawah ini telah menandatangani MSP ini.
DIBUAT di Jakarta pada tanggal Tiga bulan Agustus tahun Dua ribu enam belas
dalam rangkap dua, masing-masing dalam bahasa Indonesia, bahasa Perancis,
dan bahasa lnggris, semua naskah memiliki keabsahan yang sama. Dalam hal
terjadi perbedaan penafsiran, maka naskah dalam bahasa lnggris yang berlaku.

DE LA REPUBLIQUE DE GUINEE SUR
LA CREATION D'UNE COMMISSION MIXTE DE COOPERATION BILATERALE
La Republique d'lndonesie et la Republique de Guinee (ci-apres singulierement appelee la «Partie» et collectivement les «Parties»);
DESIREUSES d'elargir et de renforcer les relations bilaterales et la cooperation sur une base
a
long terme et durablea
long;CONVAINCUS de la necessite de la cooperation durable et efficace dans l'inten§t des parties;
CONFIRMANT leur inten§t pour le renforcement de la cooperation bilaterale entre les deux pays, sur la base des principes d'egalite, d'interet mutuel, et le plein respect de la souverainete;
TENANT COMPTE des accords existants entre les deux pays dans divers domaines;
CONFORMEMENT aux lois et reglements des pays respectifs en vigueur; CONVENU comme suit:
ARTICLE 1
Mise en place de la Commission mixte
Les Parties creent une Commission mixte ci-apres denommee la «Commission», pour faciliter la consultation et la cooperation entre les deux pays dans divers domaines de questions bilaterales, regionales et mondiales, qui peuvent inclure politique, economique, commercial, culture!, et les domaines techniques, ainsi que d'autres domaines d'interet commun.
ARTICLE 2 Objectif
La Commission examinera les moyens de promouvoir la consultation susmentionnee et de la cooperation visee

la bonne coordination et la mise en ceuvre du present protocole d'accord (MoU).ARTICLE 3 Regles de procedure
La Commission determinera ses regles et procedures, et, comme ii le juge necessaire, peut creer des comites, sous-comites et I ou groupes de travail pour traiter des sujets communs specifiques dont elle est saisie.
ARTICLE 4
Portee de la cooperation
La portee de la cooperation de la Commission comprendra:
1. Promouvoir les relations bilaterales et la cooperation
a
travers la mise en ceuvre des projets bilateraux et les mesures mutuellement benefiques; 2. Coordonner les activites des forums existants entre les ministeres et lesagences des deux pays qui sont des points focaux pour la mise en ceuvre de ces accords bilateraux en vue d'atteindre l'objectif general au point (1 ); 3. Coordonner les travaux des divers comites existants, sous-comites et
groupes de travail et de faire des recommandations
a
ces differentes instances existantes jugees necessaires afin de faciliter le travail de ces comites, sous-comites et groupes de travail;4. Pour etre regulierement tenus informes du resultat des reunions des differents comites, sous-comites et groupes de travail.
ARTICLE 5 Composition
1. La Commission mixte sera au niveau des ministres et I ou de leurs
representants qui seront hauts fonctionnaires;
2. La reunion de la Commission mixte sera presidee par les Ministres des
affaires etrangeres OU par les hauts fonctionnaires representant les
Ministres des affaires etrangeres des Parties, et comprendra des hauts
fonctionnaires competents representant les ministeres concernes et les organismes gouvernementaux, ainsi que les secteurs prive pertinents ;
3. Chaque Partie determinera la taille et la composition de sa delegation
a
la reunion de la Commission;4. Le President de la reunion de la Commission mixte sera assume conjointement par le chef des delegations respectives
a
la reunion de la Commission.ARTICLE 6
Reunion des hauts fonctionnaires
1. La preparation de la reunion de la Commission mixte sera assuree par les hauts fonctionnaires des Ministeres des Affaires etrangeres des deux
Parties;
2. Les hauts fonctionnaires vises
a
!'article (6) (1) ci-dessus co-presidera lareunion de poursuivre la reunion de la Commission mixte;
3. Les hauts fonctionnaires assureront la mise en ceuvre de toutes les
decisions et recommandations de la Commission mixte. ARTICLE 7
Frequence des reunions
La Commission se reunira taus les deux ans ou
a
tout moment convenu par lesParties, alternativement en lndonesie et en Guinee.
ARTICLE 8
Ordre du jour
1. La date, le lieu, l'ordre du jour et d'autres questions seront convenues par
les Parties;
2. L'ordre du jour provisoire de la reunion de la Commission mixte sera propose par le pays hote au moins deux mois avant la date prevue de la reunion.
ARTICLE 9 Enregistrements
1. Les resultats de la reunion de la Commission qui sont acceptes par les deux parties seront sous forme de proces-verbal agree ;
2. La Partie hate sera responsable de la preparation du proces-verbal agree ; 3. Tous les enregistrements de la reunion de la Commission mixte seront
gardees confidentielles. Toutefois, la Commission peut emettre des declarations
a
la presse le juge approprie.ARTICLE 10
Canal de la communication
Toutes les communications seront effectuees par les voies diplomatiques etablies entre les deux pays.
ARTICLE 11 Obligations financieres
1. L'hote de la reunion fournira
a
ses frais un lieu, des services de secretariat et de transport local pour les reunions;2. Chaque Partie supportera ses propres frais pour assister aux reunions.
ARTICLE 12
Reglement des differends
T outes les differences ou les differends entre les Parties decoulant de !'interpretation et I ou la mise en ceuvre de ce protocole d'accord seront regles a
!'amiable par voie de consultations et I ou des negociations entre les Parties.
ARTICLE 13
Revision
etmodification
Chaque Partie peut demander par ecrit toute revision OU modification de tout OU partie de ce protocole d'accord. Toute revision OU l'amendement qui a ete
accepte par les deux parties entreront en vigueur a cette date que peut etre
determine par les deux Parties et se formeront et partie integrante du present
protocole d'accord.
ARTICLE 14
Entree en vigueur, duree et resiliation
1. Le present protocole d'accord entrera en vigueur a la date de sa signature;
2. Le present protocole d'accord restera en vigueur pour une periode de cinq
(5) ans et a !'expiration de celui-ci sera automatiquement renouvele pour cinq (5) ans par la suite. a mains que l'une des parties souhaite resilier le protocole d'accord dans ce cas, la notification sera faite par ecrit six (6)
mois a l'avance, par la voie diplomatique;
3. En cas de denonciation. les dispositions du present protocole d'accord
restera applicable aux programmes en cours jusqu'a leur achevement, a moins que les parties en conviennent autrement. La resiliation ne sera egalement pas affecter la validite des autres accords sectoriels entre les
parties, y compris ceux qui ont ete signes en application du present
protocole d'accord,

MEMORANDUM OF UNDERSTANDING BETWEEN
THE MINISTRY OF FOREIGN AFFAIRS OF THE REPUBLIC OF INDONESIA
AND
THE MINISTRY OF FOREIGN AFFAIRS AND GUINEANS ABROAD OF THE REPUBLIC OF GUINEA
ON
THE ESTABLISHMENT OF JOINT COMMISSION FOR BILATERAL COOPERATION
The Ministry of Foreign Affairs of the Republic of Indonesia and the Ministry of Foreign Affairs and Guineans Abroad of the Republic of Guinea (hereinafter singularly referred to as the "Party" and collectively as the "Parties");
DESIRING to expand and enhance bilateral relations and cooperation on a lasting and long term basis;
BEING convinced of the necessity of the lasting and effective cooperation in the interests of the Parties;
CONFIRMING their interest in the strengthening of bilateral cooperation between the two countries, based on principles of equality, mutual benefit, and full respect of sovereignty; and
TAKING INTO ACCOUNT the existing agreements between the two countries in various fields;
PURSUANT to the prevailing laws and regulations of the respective countries;
ARTICLE 1
Establishment of the Joint Commission
The Parties hereby establish a Joint Commission hereinafter referred to as the "Commission", to facilitate consultation and cooperation between the two countries in various fields of bilateral, regional and global issues, which may include political, 1
economic, trade, cultural, and technical fields, as well as other fields of common interest.
ARTICLE 2 Objective
The Commission will consider ways and means to promote the aforesaid consultation and cooperation contemplated in Article 1 and to ensure the proper coordination and implementation of this Memorandum of Understanding (MoU).
ARTICLE 3
Rules of Procedure
The Commission will determine its rules and procedures, and, as it deems necessary, may establish Committees, Sub-Committees and/or Working Groups to deal with specific common subjects brought before it.
ARTICLE 4 Scope of Cooperation
The Scope of Cooperation of the Commission will include:
1. To promote bilateral relations and cooperation through the implementation of bilateral projects and mutually beneficial measures;
2. To coordinate the activities of the existing fora between Ministries and Agencies of both countries which are focal points for the implementation of such bilateral agreements with a view to achieving the broad objective in point (1 );
3. To coordinate the work of the various existing Committees, Sub-Committees and Working Groups and make recommendations to these various existing bodies as deemed necessary so as to facilitate the work of these Committees, Sub-Committees and Working Groups;
4. To be regularly kept informed of the result of the meetings of the various
Committees, Sub-Committees and Working Groups.
ARTICLE 5
Composition
1. The Joint Commission will be at the level of Ministers and/or their
representatives who will be Senior Officials;
2. The Joint Commission Meeting will be chaired by the Ministers for Foreign
Affairs or by the Senior Officials representing the Ministers for Foreign Affairs of the Parties, and will comprise of relevant Senior Officials representing
concerned Ministries and Governmental Agencies as well as the relevant
Private Sectors;
3. Each Party will determine the size and the composition of its delegation to the
meeting of the Commission;
4. The Chair of the Joint Commission Meeting will be jointly assumed by the
Head of the respective delegations to the meeting of the Commission. ARTICLE 6
Senior Officials Meeting
1. The preparation for the Joint Commission Meeting will be undertaken by the
Senior Officials of the respective Ministries of Foreign Affairs of the two
Parties;
2. The Senior Officials referred to in Article 6 (1) above will co-chair the meeting
proceeding the Joint Commission Meeting;
3. The Senior Officials will ensure the implementation of all decisions and
recommendations of the Joint Commission. ARTICLE 7
Frequency of Meeting
The Commission will meet every two years or at any time agreed upon by the
ARTICLE 8 Agenda
1. The dates, venue, agenda and other matters will be agreed upon by the Parties;
2. The provisional agenda for the Joint Commission Meeting will be proposed by the Host Country at least two months before the scheduled date of the meeting.
ARTICLE 9
Records
1. The results of the meeting of the Commission which are agreed by both Parties will be in the form of Agreed Minutes;
2. The Host Party will be responsible for the preparation of the Agreed Minutes; 3. All records of the Joint Commission Meeting will be kept confidential.
However, the Commission may issue statements to the Press as deemed appropriate.
ARTICLE 10
Channel of Communication
All communications will be carried out through the established diplomatic channels of the two countries.
ARTICLE 11
Financial Obligations
1. The Host Party of the meeting will provide at its own expense a venue, secretarial services and local transport for the meetings;
2. Each Party will bear its own cost for attending the meetings.
ARTICLE 12
Settlement of Disputes
Any differences or disputes between the Parties arising out of the interpretation and/or implementation of this MoU will be settled amicably through consultations and/or ne9otiations between the Parties.
ARTICLE 13
Revision and Amendment
Either Party may request in writing any revision or amendment of all or part of this MoU. Any revision or amendment which has been agreed by both parties will come into effect on such date as may be determined by both Parties and will form and integral part of this MoU.
ARTICLE 14
Entry into Effect, Duration, and Termination 1. This MoU will come into effect on the date of its signature;
2. This MoU will remain in effect for a period of 5 (five) years and upon the expiry
thereof will automatically be renewed for another 5 (five) years thereafter, unless either Party wishes to terminate the MoU in which case, notification will be made in writing 6 (six) months in advance, through diplomatic channels; 3. In the event of termination, the provisions of this MoU will remain applicable to
ongoing programs until their completion, unless the Parties agree otherwise. The termination will also not affect the validity of other sectoral agreements between the Parties including those that have been signed in pursuance of this MoU, unless the Parties agree otherwise.
IN WITNESS WHEREOF, the undersigned have signed this MoU.
DONE in Jakarta on the Third of August, Two thousand and sixteen, in duplicate, in Indonesian. French, and English languages, both texts being equally authentic. In case of any divergences of interpretation, the English text shall prevail.
