Persaingan dalam bidang perdagangan barang dan jasa berkembang dengan sangat cepat, yang ditandai dengan banyaknya variasi barang dan jasa yang ditawarkan oleh produsen terhadap konsumen. Seiring dengan hal tersebut, merek dagang semakin memegang peranan penting untuk membedakan sumber, kualitas, dan reputasi suatu barang atau jasa dengan barang atau jasa lainnya agar dapat dikenal secara luas oleh para konsumen, yang dapat dicapai salah satunya yaitu melalui kemasan produk atau trade dress. Dewasa ini, seringkali peniruan merek oleh merek lainnya dilakukan melalui kemasan produk yang menimbulkan permasalahan baru dalam perlindungan merek di internasional maupun nasional. Permasalahan yang diangkat dalam skripsi ini adalah mengenai sejauh manakah pengaturan mengenai merek dalam TRIPS Agreement maupun Undang-Undang No. 15 Tahun 2001 tentang Merek mencakup perlindungan terhadap kemasan produk.
Untuk membahas permasalahan dalam skripsi ini penulis melakukan pendekatan secara yuridis normatif. Metode penelitian dengan tahap pengumpulan data yang digunakan adalah studi kepustakaan dan data yang digunakan dalam penelitian ini adalah bahan hukum primer dan bahan hukum sekunder yaitu berupa perundang-undangan yang terkait dengan Merek yang bersifat nasional dan internasional.
Hasil penelitian yang diperoleh menunjukkan bahwa Indonesia harus memperbaharui perlindungan terhadap merek di dalam Undang-Undang No. 15 Tahun 2001 tentang Merek dikarenakan: pertama, TRIPS

Competition in the field of goods and services trade has rapidly grown, as marked by the large number of goods and services’ variation offered by the manufacturers to the consumers. As such, trademark plays a key role to distinguish the source, quality and reputation of the goods or services with other goods or services in order to be widely known by the consumers, which can be achieved through product’s packaging or trade dress. Nowadays, a mark infringement which oftenly conducted by other mark’s owner through the imitation of trade dress give rise to a new issue on the trademarks protection, both international and national. Issues raised in this study is the extent to which the regulations on the trademark in the TRIPS Agreement as well as the Law No. 15 of 2001 on Trademarks covers the protection on trade dress.
The research method used in this study is normative juridical approach. As to the data collection method used in this study is a literature study and the data used in this study are the primary legal materials and secondary legal materials such as conventions or the principles of international and national law which relates to trademark.
The result of the study showed that Indonesia must renew the regulation on the trademarks protection in the Law No. 15 of 2001 on Trademarks due to: First, the TRIPS Agreement already covers the legal grounds on trade dress’ protection as one of the aspects of trademark, but not the case with the Law No. 15 of 2001 on Trademarks. Second, the restriction on the protection against trade dress imitation must be reviewed
