ABTRAK
Kegiatan perdagangan yang kini semakin berkembang membuat pengangkutan barang melalui laut memegang peranan yang sangat penting baik dalam perdagangan nasional maupun internasional. Agar tercapainya kesuksesan dalam pengangkutan barang melalui laut tersebut, Kapal haruslah diawaki oleh Anak Buah Kapal yang kompeten, dalam mengoperasikan kapal. Berkaitan dengan penulisan hukum yang dilakukan, kompetensi anak buah kapal memegang peranan penting dalam mengoperasikan kapal pengangkutan yang meliputi kemampuan untuk menangani kapat disaat kapal itu berlayar, dapat melakukan tindakan keselamatan jika terdapat bahaya yang dapat mengakibatkan suatu kecelakaan pada Kapal. Tujuan penelitian skripsi ini adalah mengetahui tindakan-tindakan anak buah kapal yang tidak kompeten dan akibat hukum dari kecelakaan yang terjadi.
Metode pendekatan yang peneliti gunakan dalam penelitian ini adalah pendekatan yuridis normatif, yang menelaah bahan pustaka primer, sekunder dan tersier, antara lain Rotterdam Rules dan peraturan-peraturan di Indonesia, konsep – konsep pengangkutan laut, dan teori – teori kompetensi seorang anak buah kapal.

JURIDICIAL REVIEW OF INCOMPETENCY OF THE CREW OF ALL WHICH CAUSED ACCIDENTS ON CARGO VESSEL IN ACCORDANCE
WITH ROTTERDAM RULES AND REGULATIONS IN INDONESIA

ABSTRACT
Commercial business, which is in developing nowadays, manifesting the carriage of goods by sea to hold its influence in both national and international commercial business. In order to achieve the goal of carriage of goods by sea, Cargo Vessel is in need to be well equiped and well manned, by its crew for running every vessel operations. In relation to this research, the competency of the crew holds a signifcant role in operating the vessel, which includes the ability to endure any impedement throughtout the voyage carriage of goods in commence, which further leads to any occurence of accident.
The research method of this final project is analytical description, indicating the method would deliver image of the current situation chosen and would then be analyzed based on facts which are secondary data received as an extension of primary, secondary, or even tertiary law, particularly Rotterdam Rules and Regulations in Indonesia. The method of approach is normative juridical where the research would revolve around data concerning shipping law, particularly any issue in regards to competency of the crew. The data-gathering method would be gained through literacy or documentary studies in order to achieve the information on the secondary data.
In this research, writer has the goal to clarify on any incompetency of the crew, which leads to accidents on cargo vessel in accordance to Rotterdam Rules and regulations in Indonesia. It is the conclusion of this research to know on which action of crews can be considered as incompetent, as well as determining any consequence as to the accidents which may occurred and caused any losses and damages to one or all of the parties involved in one carriage of goods by sea.
