Prinsip itikad baik merupakan suatu prinsip yang berkembang dari asas hukum khusus, yang memiliki 2 pengertian yaitu subjektif dan objektif. Hal ini pula yang harus diterapkan dalam pendaftaran desain industri, berdasarkan ketentuan yang terdapat dalam Undang-Undang Republik Indonesia No. 31 Tahun 2000 Tentang Desain Industri, hak desain industri diperoleh melalui pendaftaran desain industri untuk mendapatkan perlindungan hukum. Namun pada kenyataannya, seseorang yang mendaftarkan desain industrinya seringkali tidak memiliki itikad baik terutama mengenai tumpang tindih antara perlidungan desain industri dan karya cipta. Oleh karena itu, timbul permasalahan yakni bagaimana implementasi prinsip itikad baik dalam stelsel pendaftaran desain industri di Indonesia dihubungkan dengan perlindungan karya cipta dan bagaimana bentuk perlindungan hukum bagi pencipta atas pendaftaran karya ciptanya oleh orang lain dalam rezim desain industri.
Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan spesifikasi penelitian bersifat deskriptif analitis. Teknik pengumpulan data yang dilakukan melalui penelitisn terhadap bahan hukum primer, sekunder dan tersier, kemudian dianalisis secara yuridis kualitatif untuk mendapatkan penelitian yang dimaksud.
Berdasarkan hasil penelitian bahwa implementasi prinsip itikad baik dalam stelsel pendaftaran desain industri di Indonesia dihubungkan dengan perlindungan karya cipta belum berjalan dengan baik karena syarat itikad baik tidak dicantumkan secara normatif dalam undang-undang desain industri maupun dalam peraturan pelaksananya sebagai syarat pendaftaran desain industri. Itikad baik dalam rezim hak kekayaan intelektual hanya dikenal dalam Undang-Undang No. 15 Tahun 2001 Tentang Merek dan perlindungan hukum desain industri yang lebih memadai bagi pencipta terkait pendaftaran karya ciptanya sebagai desain industri adalah yang mencakup ketentuan mengenai pendaftaran desain industri yang dilakukan dnegan itikad baik temasuk didalamnya dilakukan pemeriksaan substantif sebelum dikeluarkannya sertifikat desain industri serta ketentuan mengenai larangan pendaftaran desain industri yang merupakan karya cipta milik orang lain secara tanpa hak.

Good faith principle is a principle that developed from the principle of civil law, which has two legal terms mean subjective and objective. This principle also should be applied in industrial design registration, pursuant to the provisions contained in the Law of the Republic Indonesia No. 31 year 2000 Regarding Industrial Design, Industrial design rights acquired through industrial registration to obtain legal protection. But in fact, someone who registered industrial designs often do not have a good faith especially the overlap between industrial design protection and copyright works. Therefore, the problem arises as to how the implementation of good faith principle in industrial design stelsel registration in Indonesia associated with the protection for the creators of their works that been registered by others in the industrial design regime.
The research method used a normative juridical which approached specification is descriptive analytical study. Data collection techniques through this research primary legal materials, secondary, and tertiary, and then analyzed by juridical qualitative to gain its research.
Based on the research, that implementation of the good faith principle in industrial design registration stelsel in Indonesia associated with the protection of copyright works has not been going well for inhibiting factors such as the good faith requirement is not specified normatively in industrial design law, good faith principle on intellectual property regime only known in Law No. 15 oh 2001 regarding Trademark and the legal protection of industrial designs are more adequate for registration related the creator which his works registrated by other in industrial design law are done in good faith circuitry associated with it substantive examination prior to the issuance of certificates of industrial design and also the provisions regarding the prohibition registration of industrial design that was the art work owned by other without right.
