Introduction
This Bushfire Report has been prepared by Lydia Charman Town Planning on behalf of Ms. S Anticevic to support a Development Application (DA) to Tweed Shire Council (Council) for additions and alterations to an existing dwelling located at 38 Altair Street, Tweed Heads South (the site).
The development, involving the additions and alterations to an existing dwelling within a bushfire prone area is required to comply with the provisions of Section 4.14 of the Environmental Planning & Assessment Act 1979 and provide bushfire protection measures in accordance with Planning for Bushfire Protection 2019.
This Bush Fire Assessment Report has been prepared having regards to the provisions of Clause 44 of the Rural Fires Regulation 2013 in support of a Development Application to Tweed Shire Council to carry out a dual occupancy development within the site.
This document has been prepared for use by Tweed Shire Council and NSW Rural Fire Service for determining a Development Application for carrying out development on the site. The document is to be used to assist in the assessment of a Development Application and is not intended to be used for any other purpose. The information provided within this report cannot and does not guarantee complete protection of the subject property and residents from bush fire activity. The author is not liable for any injury, loss of property or loss of life arising from a bush fire at the subject property. The information provided is based on NSW Planning for Bush Fire Protection 2019.
Legislation
(A) ENVIRONMENTAL PLANNING AND ASSESSMENT ACT (EPA ACT)
Planning and development within NSW is regulated by the Environmental Planning & Assessment Act, 1979 (EPA Act). This Act was amended in August 2002 by the Rural Fires & Environmental Assessment Legislation Amendment Act, 2002. In relation to bushfire planning for new residential, rural residential and special fire protection developments in bushfire prone areas in NSW, the following sections of the Act apply:
(i) Section 4.14:
Section 4.14 requires a consent authority to determine if a proposed development that is located within a designated Bushfire Prone Area, or the buffer zone to the Bushfire Prone Land, complies with Planning for Bushfire Protection 2019. (ii) Section 4.15:
“In determining a development application, a consent authority is to take into consideration such of the following matters as are of relevance to the development the subject of the development application:
• The likely impacts of the development (e.g. natural hazards such as bushfire threat);
• The suitability of a site for development (e.g. bushfires) (B) RURAL FIRES ACT 1997
The objectives of the Rural Fires Act are to provide:
- The prevention, mitigation and suppression of fires;
- Coordination of bushfire fighting and prevention - Protection of people and property from fires; and - Protection of the environment.
In relation to the management of bushfire fuels on public and private lands within NSW, Sections 63(1) and 63(2) require public authorities and owners / occupiers of land to take all practicable steps to prevent the occurrence of bushfires on, and to minimize the danger of, the spread of bushfires.
(C) RURAL FIRES REGULATION 2008.
Section 44 of the Rural Fires Regulation 2008 relates to planning for new residential, rural residential and special fire protection purpose developments in bushfire prone areas in NSW and provides details of the matters that are required to be addressed for the issue of a Bushfire Safety Authority under Section 100B of the Rural Fires Act.
(D) THREATENED SPECIES CONSERVATION ACT 1995 (TSC ACT).
The TSC Act aims to protect and encourage the recovery of threatened species, populations and communities as listed under the Act.
The TSC Act is integrated with the EP&A Act and requires consideration of whether a development or an activity (such as the implementation of hazard reduction and asset protection) is likely to significantly affect threatened species, populations and ecological communities or their habitat.
PLANNING FOR BUSHFIRE PROTECTION – 2019
This RFS document provides guidance on the planning and development control processes in
relation to bushfire protection measures for development in bushfire prone areas.

The site
Site location The subject site is located at 38 Altair Street, Tweed Heads South, legal description Lot 10 DP239236
The site and location are shown in the figures below:

Site description The site flat and slightly irregular in shape. The site has an approximate land area of 644.90sqm.
Current improvements on the site include a single storey dwelling and shed. All land parcels adjoining the subject site comprise of similar sized single dwelling houses.
The existing character of the area is low density residential
development comprising of dwellings reflecting the R2 Low Density Residential zoning.
Services All essential services have been made available to the subject site.
Site Access The site currently has an existing driveway crossover to Altair Street.

The Proposal
Proposed Development
The development application seeks development consent for additions and alterations to an existing dwelling comprising the following:
- Demolition of existing entrance porch;
- Demolition of existing front fence block work in the location of the proposed pool;
- Demolition of the existing onsite driveway and pedestrian pathway;
- Two new bedrooms;
- Internal living area;
- Main bathroom;
- New concrete driveway in location of existing;
- New pool compliant fencing;
- Driveway access gate;
- External living area; and - Plungie pool
The proposal includes an increase in internal floor area of some 68.3sqm and a new private open space area of 25sqm to the existing dwellings front elevation.

The subject site is located within the older established residential precinct in Tweed Heads South.
The site forms part of a recent subdivision and is devoid of any vegetation.

Asset Protection Zones (APZ)
An APZ is an area between a bush fire hazard and a building which is managed to minimise fuel loads, inhibit fire paths and reduce the effects of heat, flame, ember and smoke attack. It keeps the effects of the fire away from the building. The size of the APZ is based on vegetation type, slope and BAL provided.
The site is clear of vegetation. BAL 12.5 applies. Vegetation which is s mapped threat is over 88m away at the closet point and is a narrow strip adjoining the Natural Waterway.
The bushfire hazards table provides details of managed land surrounding the site which acts as an asset protection zone in accordance with Table A1.12.3 of PfBFP.
Conclusion
This Bushfire Assessment Report coupled with the Statement of Environmental Effects and supporting documents is considered to suitably demonstrate that the development achieves compliance with PfBFP.
