This document sets out the terms of participation in 783 ABC Alice Springs Centralian Garden Competition (the "Competition").
1. The promoter of this Competition is the Australian Broadcasting Corporation (the "Promoter") (ABN 524 292 78345), 700 Harris Street, Ultimo, New South Wales, Australia.
2. Entry to the Competition is open to residents of Central Australian region. An entrant's residential postcode will determine whether the entrant resides in the region for the purposes of the Competition.
An entrant must be an individual and not a company or organisation. Employees of the Promoter and any person associated with the Competition, and any organisation or individual associated with the provision of the prize(s), are not eligible to enter.
3. Each entry must be entered in accordance with these Terms and Conditions. By entering the Competition, each entrant agrees to be bound by these Terms and Conditions. The Promoter may in its discretion refuse to award any prize to any entrant who fails to comply with these Terms and Conditions. All relevant instructions on the Promoter's website (if any) form part of these Terms and Conditions.
4. Entry into the Competition is free.
5. The Competition closes at 11.59pm AEST on 1/09/10 in Tennant Creek and 6/09/10 in Alice Springs ("Competition Period"). Any entry received after the expiry of the Competition Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries.
6. To enter the Competition, you must:

II. Entrants to the Alice's Most Needy Garden category will need to submit a video entry in 60 seconds or under demonstrating how needy their garden is. Video entries must be submitted in .flv, .wmv, .asf, .avi, .mov, .3gp, .mpg, .mpeg, .mp4 format with 100MB limit.
7. You must not enter the Competition more than once.
8. All entries become the property of the Promoter and will not be returned to the entrants.
9. By submitting your Work to the Promoter, you grant the Promoter and its licensees and assignees a exclusive licence to exercise all rights in perpetuity throughout the world in your Work and all other material provided by you to the Promoter pursuant to this Competition at any time.
10. Without limiting the rights granted to the Promoter under clause 11, you specifically agree that clause 11 grants to the Promoter the non-exclusive right to communicate your Work in whole or in part to the public throughout the world on any media platform and you grant to the Promoter all associated rights necessary to exercise the above rights.
11. Your Work may be edited or adapted at any time by the Promoter in order to:
(i) meet the requirements of broadcasting authorities;
(ii) adhere to any requirements of the ABC Editorial Policies (available at www.abc.net.au/corp );
(iii) ensure your Work meets any legal or classification requirements or to avoid any breach of law;
(iv) use your Work for promotional purposes; and/or (v) use your Work on other ABC media platforms.
12. The entrant whose garden is judged by 783 Regional Program Manager Stewart Brash and Gardening presenter Geoff Miers will win the prize for each category. Chance plays no part in determining the prize winners.
13. The prizes are as follows:
Garden of the Year - Trophy and $400 worth of Water Smart gardening equipment.

Best Tennant Creek Garden-$300 worth of plants.

Best Arid Zone Garden-Certificate and $400 reduction in power bill.
Supported by PowerWater.
Best Public Housing Garden- 1st prize: Certificate and $200 worth of garden products . 2nd prize: $100 worth of plants. Supported by Department of Local Government and Housing Best Lifestyle Garden- $200 worth of ABC Gardening products and 12 month subscription to Organic Gardener magazine and Gardening Australia magazine.

Peter Meech Encouragement Award for Best New Garden in Alice Springs- Certificate and $200 worth of plants and garden products.

Best Water Wise Garden- $200 voucher from nursery or irrigation supplier, one for Tennant and one for Alice Springs. Supported by Department of Natural Resources, Environment, The Arts and Sport.
Alice's Most Needy Garden- The prize will be a newly landscaped garden showcasing arid zone plants and techniques. It will use drip irrigation, mulching, local plants and appropriate fruit trees.
Thanks to the Alice Springs Town Council, the Alice Springs Desert Park, Olive Pink Botanic Gardens and Greening Australia.
14. No component of the prize can be transferred or redeemed for cash. In the event that any of the prizes become unavailable, the Promoter reserves the right to provide a similar product to the same or greater value as the original prize, subject to any applicable laws or written directions made under applicable legislation.
15. You warrant that:
(i) all details provided with your entry are true and accurate;
(ii) you have all necessary rights and licences to grant the rights set out in these Terms and Conditions;
(iii) the exercise of the rights granted to the Promoter in these Terms and Conditions will not infringe the rights of any third parties;
and you will indemnify the Promoter against any loss or damage resulting from any breach of these warranties.
16. You acknowledge that the Promoter is under no obligation to exercise any of the rights granted to it by these Terms and Conditions and any communication of your Work to the public by the Promoter is at the complete discretion of the Promoter.
17. You agree that the Promoter may use your entry and any personal details provided to the
Promoter for any promotional, marketing and publicity purposes of the Promoter in any media without notice and without any fee being paid to you.
18. Decisions of the Promoter and its panel of judges are final and will be binding on each person who enters the Competition and no correspondence will be entered into. The name of each prize winner and the area in which he/she lives will be announced on ABC Local Radio - 783 ABC Alice Springs - and posted on the 783 ABC Alice Springs website.
19. If there is any event that prevents or hinders the Promoter's conduct of the Competition or the Promoter's ability to deliver the prize/s to the prize winner/s of the Competition, the Promoter may, in its discretion, cancel the Competition and recommence it at another time under the same conditions or select another winner.
20. The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error that may occur in the course of the administration of this Competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
21. To the full extent permitted by the law, the Promoter will not be liable for any injury, damages, expenses, or loss whatsoever (whether direct or inconsequential) to persons or property as a result of any person entering into the Competition or accepting or using any prize, including without limitation non-receipt of any prize or damage to any prize in transit.
