7.2 ANNUAL MEETING OF ELECTORS - CONSIDERATION OF MOTIONS

KEY ISSUES

• The City's Annual Meeting of Electors was held on Tuesday, 8 February 2022.

• The minutes of the meeting are attached for noting.

• Decisions made at electors meetings are to be considered at the next Ordinary Council meeting or at the first ordinary Council meeting after that meeting.

It is recommended that the Council note the minutes of the Annual Meeting of Electors and the proposed action for motions carried at the Annual Meeting of Electors.

BACKGROUND

The Local Government Act 1995 (the Act) requires a local government to accept an annual report by 31 December after the relevant financial year and no later than two months after the auditor's report becomes available. The Council accepted the annual report on 15 December 2021.

A local government is then required to hold an annual general meeting of electors of the district. This meeting is to be held no more than 56 days after the local government accepts the annual report for the previous financial year (i.e. by 9 February 2022).

The Annual Meeting of Electors was held on Tuesday, 8 February 2022.

The Local Government Act 1995, section 5.33 requires all decisions made at an electors meeting to be considered at the next Ordinary Council meeting or if that is not practicable at the first Ordinary Council meeting after that meeting If a Council decision is made in response to a decision made at the elector's meeting, the reasons for the decision are to be recorded in the minutes.

The minutes of the proceedings at an electors’ meeting must be available to members of the public before the Council meeting at which decisions made at the electors’ meeting are first considered.

DETAILS

At the Annual Meeting of Electors, held 8 February 2022, 25 motions were passed, one of these motions included a motion where it was requested that each motion presented to Council at the Annual Electors Meeting be allocated its own report:

That each motion carried at this Annual Electors Meeting shall be considered by the City of Swan Council as a separate item, not just ‘noted’ and considered or dismissed en-bloc.

City officers have reviewed each motion and outlined in the table below when each motion is anticipated to be actioned and a report presented to Council. As this approach requires additional research and investigation, and requires the preparation of a high number of reports, these reports will be submitted to Council for consideration over the next few months.

That the City of Swan review and amend:

1. ‘by-laws relating to extractive industries’ which do not apear to have been amended since on 19 October 1982

That the City of Swan:

1. Conduct a baseline study to assess the location and extent of remnant and native vegetation, ex Park and reserves, including private and otherwise held tenure, within the City of Swan (i.e.

floodplain/wetland/bush)

2. Assess the loss of cumulative remnant and native vegetation due to proposed development expected to occur in the next 20 years.

3. Identify where green corridors will be threatened and prepare management plans to maintain and enhance connectivity

4. Propose alternative development solutions if cumulative development will heavily impact on the functionality of urban green and green corridors 5. Manage and as priority preserve such asset as included in the asset

management strategy

Motion 4:

That the City of Swan:

1. Protection of floodplains along the Helena and Swan Rivers in a manner that is consistent with City of Swan biodiversity Strategy and Floodplain Strategy.

2. That no infill is allowed within the 1:100 year floodplain.

3. That the Floodplain Strategy is updated within the next 12 months with input from local environmental catchment groups, DBCA, Swan River Trust, and Traditional Owners.

Motion 5:

That the City of Swan commits funds to support Perth NRM environmental manager and field officers to support and facilitate the activity of volunteer’s catchment groups in the 5 year plan.

That the City of Swan give equal weighting in all future development applications to ‘Urban Development’, and policies governing Community wellbeing, Reconciliation, Biodiversity and Conservation.

That the City of Swan establishes a sub-committee of interested Councillors to work with members of the Helena River Alliance and the Whadjuk Regional Corporation and with appropriate administrative support to develop and implement a plan to restore and appropriately develop the Lower Helena River in manner consistent with a shared vision of “Together, Caring for Country” and the City of Swan’s Reconciliation Action Plan and Biodiversity Policy.

That the City of Swan liaise with the Shires of Mundaring and York to develop a joint working party to coordinate conservation and appropriate development of the Helena River, its floodplain and associated ecosystems.

That the City of Swan approach Development WA (formerly the Metropolitan Regional Authority) to reclaim Lot 1 and 7 Great Eastern Highway (known as Tuohy Gardens) at Midland, and return the Gardens to their original status as Public Open Space.

That the City of Swan appoint/allocate an appropriately qualified staff person to the role of Heritage Officer. Their specific role would be to research and respond to heritage development applications and provide advice on the range of Council interactions that involve a heritage perspective. An alternative could be the Council begin providing payment for independent expert advice provided by appropriately registered Volunteer groups.

That the City of Swan respond positively to Deputation of 2020 by taking action to secure Lots 0-4 and Lot 178 Devon Street, currently owned by WAPC and zoned Parks and Recreation in the Local Planning Scheme and Metro Region Scheme by seeking this lands transfer to the City of Swan, as Parks and Recreation.

That the City of Swan offer to take over the management of this site with the purpose of securing and preserving the site as part of a green corridor conservation habitat site for resident native quenda, echidna and Black Cockatoo.

That the City of Swan commence investigations on the EastLink WA include a slip-lane to left-in access to Beechboro Road together with left-in access from Beechboro to Reid Highway for the following reasons:

- Beechboro Road has become a one of the main exits for Bennett Springs Residents

- Beechboro Road is the sole access in and out of the Western part of Bennett Springs.

- Beechoro Road will becoming increasing busier once Metronet project of Malaga Station is complete and running.

- Greater access to Malaga Station would be created should slip lanes be included.

- People in Bennett Springs, particularly eastern part of the original Bennett Springs estate, will find it more difficult and dangerous to get in and out of their area.

In the interests of all communities along the route of EastLink, I ask the City of Swan Councils and its electors to remove all support for the Orange Route/

East link project
