BRISBANE ROMAN CATHOLIC CATHEDRAL LAND ACT 1981, No. 62

An Act to divest the estate ill fee-simple in certain Iallds and the improvenlents thereon from certain trustees and to vest the estate in fee-simple therein in The Corporatioll of the 1~rustees of the Roman Catholic Archdiocese of Brisbane freed and discharged from all trusts upon which those lands are held
[ASSENTED TO 14 SEP-rEMBER, 1981]
Preamble. Whereas all estate in fee-simple in lands set out and described in the Schedule are vested in James Duhig, TiITIothy Molony and Briall Bolton for all the estate therein of John Bede Polding, Henry Gregory Gregory, Joseph Charles Sumner, John McEneroe, James Hanley (or Hanly), William Augustine Duncan and William Fitzpatrick upon the respective trusts set out in the Schedule:
And whereas each of James Duhig, Timothy MolollY and Brian Bolton are deceased:
And whereas The Corporation of the Trustees of tIle Roman Catholic Archdiocese of Brisbane constituted under the Religiolls Educational and Charitable Institutions Act 1861-1967 is authorized to hold land for the Roman Catholic Churcll in Brisbane:
And whereas it is desirable to vest the estate in fee-sin1ple ill tIle lands set out and described in tIle Schedule in The Corporalioll of tIle Trustees of the Roma.n Catholic Archdiocese of Brisbane freed and discharged from all trusts upon which those lands are presently held.
BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty, by and with tIle advice and consent of the Legislative Assenlbly of Queensland in Parliament assen1bled, alld by the authority of the san1e, as follows:-
1. Short title. This Act may be cited as theBrisbaneROllzall Catholic Catlledral Land Act 1981.
2. The Corporation. In this Act, "the Corporation" means The Corporation of the Trustees of the Roman Catholic Archdiocese of Brisbane constituted under the ReligioLls Educational and Charitable Institutions Act 1861-1967.
3. Divestment of lands in trustees. l~he estate i11 fee-sin1ple in the lands set out and described in the Schedule and tIle impro\'ements thereon are hereby divested from James Duhig, Tin10thy Molony and

Brian Bolton and the trusts on which those lands are presently held are hereby extinguished.
4. Vesting of lands in the Corporation. The estate ill fee-simple in the lands set out and described in the Schedule and tIle inlprovel11ents thereon hereby vest ill the Corporation freed and discharged from all trusts upon which they were held inlmediately before the passing of this Act.

(b) Land situated in the County of The appropriation thereof as a site Stanley, Parish of North for a dwellillg-house, gardell, or Brisbane, being part of other appurtenances for the allotment 4 and allotnlent 5 of clergynlen duly apIJointed to section 33, containing one rood officiate in the Roman Catholic

(c) Land situated in the County of The erection thereon of a Roman Stanley, Parish of North Catholic scl1oo1-house
Brisbane, being allotment 3 and part of allotment 4 of section 33, containing one rood 14 perches more or less;
(d) Land situated in th'e County of St. Stephen's Roman Catholic Stanley, Parish of North church
Brisbane, being allotment 13 of section 33, containing 36 perches more or less;
(e) Land situated in the County of the Roman Catholic cllurch at Stanley, Parish of North Brisbane
Brisbane, being allotment 6 of section 33, containing 36 perches more or less
