SUPREME COURT ACTS AMENDMENT ACT 1982, No. 49

[Reprinted as at 1 May, 1983]

An Act relating to the number of Judges of the Supreme Court and, in connexion therewith, to amend The Supreme Court Act of 1921 as amended

[Assented to 22 October, 1982]

BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:-

1. Short title and citation. (1) This Act may be cited as the Supreme Court Acts Amendment Act 1982.

(2) The Supreme Court Acts 1861-1980, the Supreme Court Act Amendment Act 1979 and this Act may be collectively cited as the Supreme Court Acts 1861-1982.

2. Number of Judges of the Supreme Court. On and after the passing of this Act the number of Judges of the Supreme Court of Queensland shall not exceed eighteen and, at any time when the total number in office of the Judges is less than eighteen, it shall be lawful fo:r the Governor in Council by commission in Her Majesty's name to appoint a duly qualified person to be a Judge:

Provided that the Governor in Council-

( a) shall not be bound to make, either upon the passing of this Act or at any time thereafter, an appointment or appointments as aforesaid incveasing the number in office for the time being of the Judges; and

(b) shall not make any such appointment or appointments increasing to more than eighteen the number in office for the time being of the Judges.
