Compensation where land injuriously affected other than by resump·

Where land taken by the Commissioner is not required, the Commissioner may, with the approval of the Governor in Council, exchange or sell such land and make the necessary transfer for and on behalf of the Crown. If the existing road can be rehabilitated compatible with the railway's use, it must be brought to a substantial condition with reasonable expediency. The question of the adequacy of such substituted road shall, in case of dispute, be decided by the Governor in Council.

Where it is expedient to change the levels of a road for the purpose of constructing a railway, the Commissioner shall pay all reasonable expenses in connection therewith, unless otherwise agreed. The nature of the maintenance must be in accordance with the road on which the railway is constructed. For works for the habitation of owners and occupiers of lands adjoining a railway, the following provisions shall apply:-.

Such works must be carried out immediately after or during the construction or construction of the part of the railway which passes over these lands; If the commissioner so desires, all the last-mentioned installation works shall be constructed under the supervision of the railroad engineer and in accordance with plans and specifications to be submitted to and approved by the commissioner. For the purpose of recovering the amount for which any person is liable by the by-laws under this clause, such liability shall be deemed to be a charge legally prescribed by those by-laws and shall be recovered by the Commissioner notwithstanding the provisions of section one hundred and eight of this Act or any other provision of this Act which limits, affects or otherwise prejudices the provisions of this clause or of any bye-law made under this clause. Determining the qualifications required of all candidates for employment in each of the various branches of the railway service and, if necessary, in each grade of those branches. Examining candidates for employment and issuing certificates to them; holding exams in the local centers of these candidates and, as necessary, of employees who are candidates for promotion; public announcement of these exams and the number of possible vacancies; granting free permits to candidates to enable them to participate in the examination;

Specifying the type or character and extent of examinations or tests, in accordance with the requirements of each of the higher grades of service, to be passed by employees in lower grades who wish to compete for and advance to such higher grades. Regulating the relative rank, position or degree of seniority and the duties and conduct of employees in each of the various branches of the railway service; and determining which of those classes shall be deemed to be higher or lower class in such railway service. Regulation of tasks to be performed by railway workers and discipline in the performance of these tasks, transfer of workers, periodic approval of absence and regulation of the performance of tasks. during holidays and marking violations of these regulations, depending on the nature of the offense, penalties under this law are allowed.

Determination of the ages at which persons employed in the various branches of the railway service shall retire. General regulation of travel on or use and operation of the railways and the maintenance of good order, and regulation of the conduct of employees, and to provide for the proper management of the affairs under the control of the Commissioner, and the protection of the railways and other work of trespass and injury. Prescribing any matter or thing not inconsistent with this Act which is necessary or convenient to be prescribed in order to give effect to any power, duty or authority of the Commissioner under this Act.

PART I--COPY OF AGREEMENT DATED 22ND SEPTEMBER, 1959 THis AGREEMENT made this twenty-second day of September, 1959,

Prescribing a scale of allowances to be paid to every witness summoned under this Act for his traveling expenses and maintenance during his absence from his usual place of residence.

SECTION I-STATEMENT OF ENGINEERING SERVICES

ADVISORY SERVICES

Upon the Minister's approval, supervise the preparation by the Unit of detailed designs, specifications, pieces of material and working drawings for the construction of the Work and, upon completion, review and approve them. After contracts for construction have been awarded, review and approve the supervision of contractors and the inspection of the entire construction by the Unit, so that it will be done in a good, proper and workmanlike manner, in accordance with the specifications and provisions of the contracts, and in accordance with all statutory provisions and requirements and all regulations made thereunder. Premiums on bonds and insurance and fees for permits and licenses required by Engineer in connection with the performance of the services hereunder.

A.9,000,000 cost of the work, (b) a change in the scope or nature of the Engineer's services as described in Section 1 hereof, or (c) a delay of more than 90 calendar days after June 30, 1964 in the completion of the work, will be negotiated fair adjustment of the fixed fee. This Agreement shall terminate upon execution by the Engineering Services Engineer as described in Section 1 of this Agreement and upon payment by the Government of compensation as described in Section 2 of this Agreement, unless earlier terminated as described below in this Termination Clause . If the termination is due to the abandonment or suspension of work by the Government, the Government will pay the Engineer that proportion of the fixed fee that the Engineer's services have actually performed on the date of termination (plus required services thereafter, if any) for the Engineer's total services under this Agreement ( reduced by prepaid payments).

Except where Engineering Services are terminated in terms of the following paragraph of this Termination Clause, if termination will be for any reason other than the strike or indefinite suspension of the Work by the Government, the Government Engineer will pay the full unpaid balance of the Fixed Fee. If Engineer's services are terminated due to failure on the part of Engineer to perform the duties and obligations imposed on Engineer by this Agreement, no part of the balance of the Fixed Fee shall be payable by the Government to Engineer . In witness whereof the parties have caused this Agreement to be executed by their respective representatives duly authorized thereto, as of the day and year first above written.

While Engineer n()W was appointed as advisory and supervising consultant to the special Project Unit established by the Government under the Minister of Transport to undertake part of the Work:. For the Engineering Services, as set forth under Section 1 of this Agreement, the Government shall pay Engineer a Fixed Fee of $570,000 U.S. paid, which is approximately 1.0% (one percent) of the estimated. A Cost of the Work, less any Fixed Fee payments already made under the Agreement between the Government and the Engineer dated 22nd September, 1959.

The Government will pay the Engineer this fixed fee in monthly installments of $9,500 US each, the first of which will be paid to the Engineer by the Government on or before the 15th day of the first month following the month in which the Engineer begins to perform the Engineering Services under this Agreement as described in Section 1 and the subsequent installments will be paid on or before the 15th day of each subsequent month. If such installments reach the sum of the entire fixed fee before the end of the work, no further installments must be paid, and if the sum of such monthly installments does not correspond to the fixed fee at the end of the work, the remaining amount, if any. , shall be paid within 15 days of the completion of the Engineering Services under this Agreement:. The cost of such wages or salaries of the Engineer's temporary employees employed for this job shall include such allowances and charges as may be agreed upon or imposed by the Engineer by reason of the employment of such temporary employees.).

Travel and living expenses of Engineer's employees as may be incurred in connection with the performance of the services below. Premiums on bonds and insurance, including accident and health insurance, and fees for permits and licenses to be obtained by Engineer in connection with the performance of the services hereunder. If such changes lead to (a) an increase or decrease in the scope of the Work, as described on page 1 hereof, resulting in a change of more than 10 percent.
