An Act to provide for the conduct of games of lotto; to amend the Golden Casket Art Union Act 1978 in certain particulars; and for related purposes

[ASSENTED TO 12 JUNE, 1981]

BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:-

1. Short title. This Act may be cited as the Lotto Act 1981.

Collective title conferred by Act of 1984, No.1, s. 1 (3).

2. Commencement. (1) This section and sections 1,28 and 29 shall commence on the day on which this Act is assented to for and on behalf of Her Majesty.

(2) Except as provided in subsection (l) and, without derogating from section 1 7 of the Acts Interpretation Act 1954-1977, except where the contrary intention appears with respect to particular provisions, this Act shall commence on a day to be fixed by Proclamation.

3. Interpretation. (l) In this Act, unless the contrary intention appears-

"agent" means a person appointed as an agent under and for the purposes of this Act;

"Australian Lotto Bloc" means Tattersall, The Lotteries Com­

mission of South Australia and The Lotteries Commission of Western Australia united to form the Australian Lotto

Bloc to promote and operate the game of lotto on a joint basis;

"conduct" in relation to a game of lotto, includes promote, organize. and operate;

"entry form" means an entry form or coupon required by the rules to enable a person to enter or subscribe to a game of lotto;

"inspector" means a person appointed as an inspector pursuant to this Act;

"Manager" has the meaning that it has under the 1978 Act;

"Minister" means the Treasurer or other Minister of the Crown for the time being charged with the administration of this Act. The term includes any Minister of the Crown who is temporarily performing the duties of the Minister;

"Office" means the Golden Casket Art Union Office constituted under the 1978 Act;

"subscriber" means a person whose name appears on the face of the entry form in the space provided for the purpose;

"subscription" means an entry fee payable by a subscriber pur­

suant to the rules to enable him to participate in a game of lotto, exclusive of the agent's fee;

"Tattersall" means the trustees of the will and estate of the late George Adams carrying on business in Melbourne in the State of Victoria under the name or style of Tattersall Sweep Consultation Care of George Adams;

"the 1978 Act" means the Golden Casket Art Union Act 1978 as amended by this Act;

(2) (a) In this Act, a reference to a game of lotto is a reference to any form of game in which the entrants in or subscribers to the game choose or attempt to forecast or select, from a group of numbers, a smaller group of numbers to be drawn on a random basis.

(b) Such a game of lotto that is conducted by the Office may be referred to as "Gold Lotto".

(c) The Governor in Council may at any time after the commence­

ment of this Act by Order in Council declare that the description of the game of lotto in paragraph (a) shall be enlarged by the addition thereto of the words "Additionally, such a reference to a game of lotto includes a reference to any form of competition based upon a comparison between numbers to be drawn on a random basis and the numbers pre­

printed on the entry form of a subscriber.", and upon the publication in the Gazette of the Order in Council, the description of the game of lotto shall be read as including the additional words.

(d) A competition as described by the additional words specified in paragraph (c) that is conducted by the Office may be referred to as 4'Super 66".

(3) In this Act, a reference to games of lotto conducted by the Office includes, unless the contrary intention appears, a reference to games of lotto conducted by the Office on a joint basis pursuant to an agreement under section 10 with games of lotto conducted by other partners of the Australian Lotto Bloc.

4. Powers, etc., of Office additional to those under the 1978 Act.

(1) In addition to the powers, authorities, functions and duties referred to in section 5 (4) of the 1978 Act, the Office shall have and may exercise such powers and authorities and shall perform such functions and duties as are conferred or imposed upon it by or under this Act.

(2) The Manager and Deputy Manager of the Office for the time being in accordance with the provisions of section 6 of the 1978 Act shall be the Manager and Deputy Manager of the Office for the purposes of this Act.

(3) A person appointed to act as Manager of the Office pursuant to section 7 of the 1978 Act shall whilst so acting thereunder be the acting Manager for the purposes of this Act.

5. Officers and employees. (1) (a) In addition to the appointment of inspectors pursuant to section 15, the Governor in Council may appoint such officers as he deems necessary for the effectual adminis­

tration of this Act.

(b) Such officers shall be appointed and hold office under the Public Service Act 1922-1978.

(2) In addition to the employment of persons by the Office under and for the purposes of section 8 (1) of the 1978 Act, the Office may employ persons for the conduct of games of lotto and for the effective administration of this Act so that there are employed by the Office in accordance with the provisions of the said section 8 such and so many persons as are necessary for the conduct of Golden Caskets and games of lotto and for the effectual administration of the Office, the 1978 Act and this Act.

6. Agents. (1) The Office may appoint such and so many agents as it considers necessary in connexion with the conduct of games of lotto.

(2) An agent so appointed may be appointed as an authorized agent or as a subscribers' agent or as such other category of agent as may be prescribed.

(3) A person who desires to become an agent under and for the purposes of this Act may make application to the Office for appointment as such agent.

(4) An application shall be in the prescribed form and the applicant shall comply with all conditions prescribed by the regulations.

(5) Upon consideration of the application, the Office may grant or refuse the application and shall give notice to the applicant of its decision.

(6) Where an application is granted, the Office and the applicant shall enter into an agreement in the prescribed form.

(7) An appointment under this section shall be subject to such terms, conditions or restrictions as are prescribed and to such further terms, conditions or restrictions as the Office in a particular case thinks fit, incorporated in the agreement entered into under subsection (6).

(8) A decision of the Office made on an application or an appoint­

ment pursuant to this section shall be final and conclusive and without appeaL

7. Functions of Office with respect to lotto. Subject to this Act and the directions of the Minister not inconsistent with this Act, the Office-

(a) may conduct games of lotto and do or cause to be done all such acts and things as are necessary for or incidental to the conduct of games of lotto and the exercise or performance of any of its powers, authorities, functions and duties in relation thereto;

(b) may do or cause to be done all such other acts and things as are necessary or convenient for the administration of this Act or the affairs of the Office in relation to such admin­

istration or to give effect to the objects and purposes of this Act;

(c) may, without further authority than this Act but subject to section 8, use subscriptions to meet the expenses of.- (i) conducting games of lotto, including the purchase of

machines and equipment in connexion therewith;

(ii) the administration of this Act; and

(iii) the administration of the Office in respect of its powers, authorities, functions and duties under this Act.

8. Prize money. (1) Subject to subsections (2) and (3), the amount allocated for distribution as prize money in respect of each game of lotto conducted by the Office shall be 60 per centum of the total amount of subscriptions.

(2) An amount calculated in accordance with rules made pursuant to section 16 may from time to time be set apart from the amount allocated for distribution as prize money pursuant to subsection (1).

Any amount so set apart may be accumulated with any other amount so set apart.

(3) Any amount accumulated pursuant to subsection (2), shall be distributed from time to time as additional prize money in respect of such games of lotto and in such amounts as are determined in accordance with rules made pursuant to section 16.

(4) The Office may make rules pursuant to section 16 for the purpose of giving effect to the provisions of this section.

9. Agreement with Tattersall. (1) The Office may, on such terms and conditions as are approved by the Minister, enter into an agreement with Tattersall under which, for an agreed remuneration and in respect of such period or periods of time as shall be agreed upon, Tattersall shall provide facilities and managerial and technical assistance and advice to the Office and the Office shall receive such other assistance from Tattersall as will facilitate the more effective conduct of games of lotto by the Office.

(2) Remuneration payable by the Office under the agreement shall be an expense of conducting games of lotto within the meaning of section 7 ( C).

(3) The agreement may be entered into at any time after the passing of this Act.

10. Agreement with Australian Lotto Bloc partners. (1) Subject to section 11, the Office may, on such terms and conditions as are approved by the Minister, enter into an agreement with the Australian Lotto Bloc to become an Australian Lotto Bloc partner for the purpose of joining with the other partners in the conduct of games of lotto on a joint basis.

(2) The agreement may be entered into at any time after the passing of this Act.

11. Minister may enter into agreement o� arrangement. (1) The Minister may enter into an agreement or arrangement with the Treasurer or other proper officer or authority of another State of the Common­

wealth under the law of which duty is payable in respect of subscriptions to games of lotto conducted by the Office as a partner under an agreement entered into by it pursuant to section 10 providing that, where any such duty is paid by the Office in respect of such subscriptions in compliance with the law in question, it shall be refunded forthwith to the Office.

(2) The entering into such an agreement or arrangement by the Minister under this section is a condition precedent to the entering into an agreement by the Office under section 10.

(3) An agreement or arrangement under this section may be entered into at any time after the passing of this Act.

12. Supervision of drawings, maintenance and security of equipment.

(1) The Auditor-General or a person authorized by him in that behalf.- (a) shall exercise such supervision over equipment used in

connexion with the drawing by the Office of the winning

numbers in games of lotto as will ensure the security and proper operation thereof;

(b) shall supervise the drawing by the Office of the winning numbers in games of lotto and the accuracy of the announced results.

(2) The powers to be exercised and the functions and duties to be performed by the Auditor-General or authorized person with respect to such equipment and each such drawing shall be such as the Auditor­

General from time to time determines.

(3) Where pursuant to an agreement referred to in section 10 the drawing of winning numbers in respect of games of lotto conducted by the Office and other Australian Lotto Bloc partners takes place in another State, supervision of the drawing of the numbers in accordance with the law of the State where the drawing takes place shall be sufficient supervision for the purposes of this Act.

, 13. Payment to Treasury of certain moneys.

(l)

The Manager shall from time to time as directed by the Treasurer pay to the Treasury such of the moneys standing at credit in the relevant accounts kept by the Office under this Act as represent the excess of income over expenditure arising out of the exercise by the Office of the powers and authorities and the performance by it of the functions and duties conferred or imposed upon it by or under this Act.

(2) Moneys paid pursuant to subsection (1) shall, subject to subsection (3), be paid into the Consolidated Revenue Fund.

(3) The Governor in Council may approve that any moneys forming part of the moneys referred to in subsection (2) shall be paid into the Sports and Youth Fund or the Cultural Capital Development Fund or any other Fund established and kept in the Treasury that is nominated by him and, where he so approves, such moneys shall be paid into that Fund or those Funds accordingly.

14. Protection of Office, subscribers and other persons. Notwith­

standing any other Act or law-

(a) the conduct of games of lotto by the Office under and in accordance with this Act and the doing of any act or thing incidental or ancillary thereto is lawful; and

(b) a person who pays a subscription or contributes towards the payment of a subscription or lodges an entry form with the Office or an agent or who acts under the authority or on behalf of a subscriber, contributor or person so lodging and a person who acts under the authority or on behalf of the Minister or the Office or who exercises powers or authorities or performs functions or duties in relation to or in connexion with the conduct of games of lotto under this Act-

(i) shall not be liable to any prosecution or penalty; and

(ii) shall be released and discharged from all actions, suits, claims and demands

to which, but for this Act, he would be liable by reason of such subscription, contribution, lodgment or acting or, as the case may be, the exercise or performance of such powers, authorities, functions or duties.

15. Inspectors. (1) (a) The Governor in Council may appoint such and so many inspectors as he thinks fit for the purposes of this Act.

(b) Appointees shan be appointed and hold office under the Public Service Act 1922-1978.

(2) The Manager and the Deputy Manager of the Office shall be, ex officio, inspectors under and for the purposes of this Act.

(3) A person appointed as an inspector may hold his office in conjunction with any other office he holds in the Public Service.

(4) An inspector for the purposes of this Act any reasonable time-

(a) may enter any part of the premises- (i) not being a dwelling-house, of an agent;

(ii) not being a dwelling-house, of any person whom the inspector suspects on reasonable grounds of conducting a game of lotto;

(iii) not being a dwelling-house, of a person other than an agent whom the inspector suspects on reasonable grounds of receiving entry forms for or SUbscriptions in respect of a game of lotto;

(b) may require any person whom he suspects on reasonable grounds of having the custody, possession or control of any registers, books, records or documents that relate to or that the inspector suspects on reasonable grounds relate to the conduct of a game of lotto-

(i) to produce to him those registers, books, records or documents; and

(ii) to answer any question with respect to those registers, books, records or documents

within such reasonable time as is specified in the requirement;

(c) may make copies of or take extracts from any entry in any such register, book, record or document.

(5)

A person shall not-

(a) prevent an inspector from exercising any power conferred on him by subsection (4);

(b) hinder or obstruct an inspector in the exercise of any such power;

(c) fail to comply with a requirement of an inspector under subsection (4) (b);

(d) furnish to an inspector information that he knows to be false or misleading in a material particular.

It is a defence to a prosecution for an offence under subsection (5) (c) by reason of the failure of the defendant to answer a question referred to in subsection (4) (b) (ii) if he proves that he did not know) and could not with reasonable diligence ascertain) the answer to the question.

(7) A person is not excused from answering a question if required to do so under subsection (4) (b) on the ground that the answer might tend to incriminate him or make him liable to a penalty, but the information furnished by him shall not be admissible against him in any proceedings, civil or criminal, save in proceedings for an offence under subsection (5).

(8) Anything done by an inspector in good faith for the purpose or purporting to be for the purpose of executing this Act shall not subject the inspector personally to any action, liability, claim or demand.

16. Rules. (1) The Office may, with the approval in writing of the Minister, make rules not inconsistent with this Act or the regulations for or with respect to games of lotto and the' conduct by it of such games.

(2) Without limiting in any way the scope and generality of subsection (1), the rules may provide for-

(a) a system or procedure of microfilming or other recording of entry forms entered in games of lotto or a specified portion of such entry forms; and

(b) the placing in safe keeping in manner prescribed by the rules of the microfilm or other record,

and for such microfilming or other recording of an entry form or a specified portion thereof and such placing in safe keeping in manner so prescribed of the microfilm or other record to be conditions precedent to the inclusion of the entry in respect of the entry form in a particular game and to eligibility for or entitlement to any prize.

(3) Section 28A of the Acts Interpretation Act 1954-1977 applies in respect of rules made under this Act as if they were regulations.

17. Accou.nts and au.dit. (1) The Office shall, for the purposes of this Act, at all times keep accurately proper accounts, books and records of its receipts and expenditure and assets and liabilities in such manner and in such form as are prescribed Of, if not prescribed, as the Minister directs.

(2) The provisions of section 14 of the 1978 Act applicable with respect to the accounts, books and records of the Office kept pursuant to that section are applicable with respect to the accounts, books and records of the Office kept pursuant to subsection (1).

(3) Nothing contained in the said section 14 operates to preclude the consolidation of the accounts kept pursuant to that section and the accounts kept pursuant to subsection (1) in relation to the preparation and certification of the Annual Statements of Account of the Office as

referred to in the said section 14, and the provisions of that section are applicable with respect to such consolidated accounts.

18. Investment of temporarily surplus moneys. (1) If at any time the Office is of opinion that part of the moneys standing to the credit of any account kept by it for the purposes of this Act is available for investment, it may invest such part-

(a) on deposit at a bank;

(b) in securities of or guaranteed by the Government of the Commonwealth or of the State;

(c) with an authorized and approved dealer; or

(d) in such other securities as are approved by the Governor in Council by Order in Council, on the recommendation of the Minister.

(2) Every security, safe custody acknowledgment or other document evidencing title issued in respect of any investment shall be held either by the Office or by the Minister on behalf of the Office.

(3) For the purpose of this section, the expression "authorized and approved dealer" means a person who-

(a) is an authorized dealer in the short term money market with established lines of credit with the Reserve Bank of Australia as a lender of last resort; and

(b) is approved by the Governor in Council by Order in Council.

19. Annual report. The report of the Manager to the Minister referred to in section 16 of the 1978 Act shall include a report of the operations of the Office under this Act.

20. Payment of prize to subscriber to be valid discharge. The Office may pay or deliver or cause to be paid or delivered to any person whose name appears on an entry form as the subscriber to a game of lotto conducted by the Office the prize won in respect of that entry and, notwithstanding any Act or law whether relating to infants or persons under other legal disability or otherwise, the payment or delivery of the prize pursuant to this section shall constitute full satisfaction by the Office of its liability in respect of the entry and a valid discharge to the Office.

21. Restriction on conduct of lotto. A person other than the Office shall not conduct a game of lotto.

Penalty: $2 000.

22. Prohibition on participation by minors. (1) A person concerned in the conduct of a game of lotto shall not accept from a person who is under the age of 18 years an entry form for, and a subscription respect of, an entry in a game of lotto.

(2) For the purposes of this section, a person concerned in the conduct of a game of lotto includes an agent.

(3) It is a defence to a prosecution for an offence against subsection (1) if the defendant proves that the game of lotto referred to in the complaint was conducted by the Office and that the defendant had no reason to believe, and did not believe, that the person from whom he accepted an entry form for, and a subscription in respect of, an entry . in the game of lotto was under the age of 18 years.

(4) A person under the age of 18 years shall not enter or subscribe to a game of lotto.

Penalty for a contravention of subsection (4): $100.

23. Offences by persons who are not agents. (1) A person-

(a) shall not act as or by advertisement or by any other means howsoever hold himself out to be an agent or accept or cause to be accepted an agent's fee unless he is an agent;

(b) shall not accept or cause to be accepted any subscription unless he is the Office or an agent.

(2) A person does not commit an offence against subsection (1) by reason only of the fact that he-

(a) arranges conjointly with another person or other persons for the completion of an entry form in his name or the name of any one or more of those persons or any other name or designation; or

(b) receives, in connexion with such an arrangement and whether or not he is the instigator thereof, the subscription or any part thereof from another person or other persons, provided that such subscription or part thereof is paid to the Office or an agent in conjunction with the entry form.

24. Forgery and like offences. (1) A person shall not­

(a) forge or counterfeit- (i) any-

(A) completed or partly completed entry form; or

(B) paper or writing resembling a completed or partly completed entry form

containing a number purporting to be or to include a winning number in a game of lotto; or

(ii) any entry in any book, document, voucher or writing relating to the conduct of a game of lotto;

(b) knowingly utter or use any such entry form, paper or writing or any such entry in any such book, document, voucher or writing;

(c) fraudulently take or fraudulently convert to his own use or to the use of another person any prize or part of a prize in a game of lotto or any moneys paid by way of subscription.

Penalty: $1 000.

(2) In subsection (1), the expression "forge" has the meaning that it has in section 486 of The Criminal Code and each of the expressions

"utter" and "knowingly" has the meaning that it has in section 1 of The Criminal Code.

25. Offences and general penalty. A person who contravenes or fails to comply with any provision of this Act is guilty of an offence and, save where a specific penalty is otherwise provided or provision is otherwise made with respect to the offence, is liable to a penalty of

$500.

26. Summary proceedings. (1) Offences against this Act may be prosecuted in a summary way under the Justices Act 1886M 1980.

(2) A prosecution for an offence against this Act may be commenced within one year from the time when the matter of complaint arose or within 6 months after the matter of complaint comes to the knowledge of complainant, whichever is the period later to expire.

(3) Proceedings for an offence against this Act may be instituted by the Manager or by a person authorized in writing in that behalf generally or in a particular case by the Manager.

27. Regulations. (1) Governor in Council may make regulations, not inconsistent with this Act, for or with respect to-

(a) the displaying in those parts, to which the public has access, of the premises of an agent of the rules relating to games of lotto or of extracts from those rules;

(b) regulation of the functions and performance of duties of agents, including the functions and performance of duties of different categories of agents;

(c) advertisements relating to. games of lotto;

(d) unclaimed prize money in respect of games of lotto, including the period of time after which prize money becomes unclaimed prize money, the manner of payment or disposition of unclaimed prize money and deduction therefrom of postage and other expenses in connexion with such payment or disposition;

(e) offences against the regulations and prescribing the amount of any penalty for any offence against any regulation, provided that any such penalty shall not exceed $200;

(f) all matters required or permitted by this Act to be prescribed where such matters are to be or may be prescribed by the regulations or where the method of prescription is not otherwise provided;

(g) all matters that may be convenient for the administration of this Act or that may be necessary or expedient to achieve the objects and purposes of this Act.

(2) The power to regulate conferred by this section includes the power to prohibit.

28. Amendments of Act No. 19 of 197ft (1) The Golden Casket Art Union Act 1978 is amended by-

(a) in section 4-

(i) inserting after the term "agent" and its meaning the following term and meaning:-

" "art union", where it occurs in the meaning of the term "Golden Casket", means, subject to the provisions of this Act with respect to the conduct of Golden Caskets, a scheme or device for the gift, disposal or distribution of any money, prize or thing of value or of any right thereto or any share therein that may by this Act be a prize in a Golden Casket, depending upon or determinable by lot or drawing (whether out of or by means of a box or other receptacle or machine or other equipment) or determinable by any manner of chance whatsoever;";

(ii) omitting the words "within the meaning of the Art Unions and Amusement Act 1976," occurring in the meaning of the term "Golden

Casket";

(b) in section 11, inserting after the words "such conduct is lawful"

the words "and subject to this Act alone";

(c) omitting section 14 and substituting the following section:-

"14. Accounts and audit. (1) The Office shall at all times keep accurately proper accounts, books and records of its receipts and expenditure and assets and liabilities in such manner and in such form as are prescribed or, if not prescribed, as the Minister directs.

(2) The Manager shall as soon as practicable after the end of each

financial year prepare in such form as is prescribed or, if not prescribed,

as the Minister directs statements of account with respect to the financial operations of the Office for that year (in this section called the "Annual Statements of Account"). The Annual Statements of Account shall-

(a) include a statement setting forth in summarized form

particulars of transactions of the financial year question

and a balance sheet showing the financial position of the Office as at the end of that year;

(b) be certified as correct by the Manager.

(3) Forthwith upon completion of the preparation of the Annual Statements of Account and their certification as correct by the Manager, the Office shall lay the same and the accounts of the Office referred to subsection (1), together with proper vouchers in support thereof and all books, papers, writings and records of the Office relating thereto, before the auditor appointed pursuant to subsection (5) to examine the accounts of the Office.

(4) Until the Annual Statements of Account have been audited pursuant to this section and laid before the Legislative Assembly pursuant

to section 16, no such statement shall be sold or made available to any person other than-

(a) the Minister or the Auditor-General;

(b) a person acting in aid of the Minister or the Auditor-General;

or

( c) an officer or employee of the Office.

(5) At least once in each year the Auditor-General or an authorized officer within the meaning of the Financial Administration and Audit Act 1977-1978 shall audit the accounts of the Office and shall have with respect to such audit and accounts all the powers and authorities conferred on him by that Act as if the Office were a Department of the Government of the State.

The fee payable by the Office in respect of the audit shall be fixed by the Auditor-General.

(6) The Auditor-General shall certify whether the Annual Statements of Account prepared on behalf of the Office-

(a) are prepared in the form required by this Act;

(b) are in agreement with the accounts of the Office; and

(c) in his opinion, fairly set out the financial transactions for

the period to which they relate and show a true and fair view of the state of affairs at the close of that period on a basis consistent with that applied in respect of the financial year last preceding,

and, after such certification, shall deliver those statements to the Manager.

(7) The Auditor-General shaH report to-

(a) the Minister where the Minister is the Treasurer; or

(b) the Minister through the Treasurer where the Minister is not the Treasurer

the result of each audit carried out pursuant to this section and shall, if he thinks fit, furnish with the report recommendations to the Minister or to the Manager with respect to financial transactions of the Office and the manner of operating and maintaining its accounts.

A copy of such report and recommendations, if any, shall be furnished to the Manager.

The Minister or, as the case may be, the Manager shall give due consideration to the report and recommendations, if any, of the AuditorM General made pursuant to this subsection.

(8) In this section the expression "financial year" means the period commencing on 1 July in any calendar year and concluding on 30 June in the next succeeding calendar year.";

(d) omitting section 16 and substituting the foHmving section:­

"16. Annual Report. (1) As soon as is practicable after the expiration of the financial year, the Manager shall prepare and furnish to the Minister a report on the operations of the Office throughout that year.

(2) The report shall include such statements of account and other financial and relevant information as may be prescribed, together with the certificate of the Auditor-General prescribed by section 1 4 (6),

(3) The Minister shall lay the report of the Office before Legislative Assembly within 14 sitting days from the day on which he receives the report.

( 4) In the section, the expression "'financial year" has the UH.'4UA,Ull!">

that it has in section 14.".

(2) Go/den Casket Art Union Act 1978 as so amended may be cited as the Golden Casket Art Union Act 1978-1981.

29. Validation provision with respect to certain Golden Caskets.

The conduct of Golden Caskets by the Office under the authority of the Golden Casket Art Union Act 1978 and the doing of any act or thing incidental or ancillary to such conduct prior to the commencement of this section shall be taken to be and always to have been lawfuL
