ORDER I----INTERPRETATION Interpretation

WE, Leslie Brovm, President of the Industrial Court, and Harry James Harvey, James Philip Bennett, and Alan Muir Taylor, Members of the Industrial Conciliation and Arbitration Commission, in terms of the powers and authorities vested in us by "The Industrial Conciliation and Arbitration Act of do hereby make Rules of Court under the said Act as follows:-.

ORDER II-PROCEEDINGS GENERALLY Form of Proceedings

Where anything is required to be in any of the prescribed forms, it is sufficient if it has the same effect. The competent secretary may modify any such forms to suit the individual case. Any motion, appeal, summons or application may be withdrawn by leave of the Court or Commission upon notice of such withdrawal:.

Subject to the power of delegation, any case to be commenced in the Commission shall be assigned by the Chairman to one or more members of the Commission. For the purpose of summoning any person to attend a compulsory conference (under section 39 of the Act), the summons shall be issued by the Registrar or the Industrial Magistrate in Form 2 of the Schedule hereto. n) PROCESS FOR ENFORCEMENT OF SANCTIONS. Proceedings for the enforcement of penalties incurred by law for offenses other than those to be tried and determined by the court shall be commenced by complaint before a justice of the peace.

For the purposes of such proceedings, all Registrars or Deputy Registrars of Magistrates' Courts shall be deemed to be Registrars of Industrial Offenses Courts. The judge of the time and place fixed for the hearing of the appeal and the industrial judge shall ensure that the parties are notified thereof. Invitations must be on form no. Proposals must be on form no. 4 of this list.

Such application shall be made by the resident and the Secretary of the respective Union. Any officer of the Court or Commission shall, when requested by the Registrar, serve any process or document required to be served by the Registrar, and the fee in connection with such service shall be paid in the first instance by the party having the conveyance of the case.

ORDER VIII-AGED AND INFIRM WORKERS

Provided that the provisions of the said Acts relating to the limitation of the time within which appeals may be filed or filed, and to the order of imprisonment in case of failure to comply with an order of magistrates for the payment of money, and in case of failure to recover such money by execution against the goods and chattels of a person, liable to make such payment shall not apply to the hearing and determination of an appeal in respect of an amount due to the State Insurance Office (Queensland) or to the enforcement of a decision of the Industrial Judge therefor. If the Industrial Judge is unable to attend at the hour fixed for the hearing of any proceeding, the Clerk of Small Sessions may adjourn the Court and adjourn all matters fixed for such day and hour as he thinks fit. The provisions of Rules 14 to 18 of Order IV of the Rules of Court made under the "Industrial Conciliation and Arbitration Act, 1961" shall apply, so far as they are applicable, to appeals against decisions of the Industrial Magistrate on applications for accident insurance. policies (including a determination by an Industrial Magistrate or any question arising at a hearing or determination of a referral), apply. 34; The Workmen's Compensation Acts, 1916 to and any subsequent Acts amending the said Acts or in superseding them; or Regulations made thereunder.

ORDER X--APPEALS FROM THE DECISIONS OF INDUSTRIAL MAGISTRATES MADE UNDER "THE APPRENTICES AND

In the matter of the conversion into dollars and cents of monetary amounts prescribed in awards and industrial agreements; and In the matter of an application by the Public Service Commissioner for. THE Public Service Commissioner applied by Notice of Motion for a General Order "that all sums of money prescribed in A-wards of the Commission and in Industrial Agreements made under "The Industrial Conciliation and Arbitration Acts, 1961 shall be converted into and prescribed in dollars and/or Cents with effect from 14 February 1966, and that such Awards and Industrial Agreements shall be amended accordingly". In the grounds and reasons for the application it was pointed out that in terms of the Currency Act 1963 the currency or currency of Australia is the dollar, and the denominations of money in the currency of Australia are dollars and cents, and the date of commencement of the legislation was proclaimed as 14 February 1966.

The jurisdiction of the Commission to provide for sums of money in Awards and Agreements to be expressed in what is now commonly referred to as decimal currency was not disputed, but there was disputation as to how the current sums of money to decimal conversion currency should be effected become In respect of these rates it was argued that they should be converted according to the basis set out in section 8 of the Currency Act 1963. In respect of these rates it was argued that they should also be converted according to the same basis as weekly rates except that fractions of a cent in three decimal places must be expressed, the third decimal must be increased by one where the fourth decimal is five or more - if less than five the third decimal to remain unhealthy.

This scheme provided for the conversion of aU sums of money shown in premiums into exact arithmetical equivalents — amounts to be shown to two decimals, the second decimal to be increased when the third decimal is five or more; where a final amount payable to an employee results in a fraction of a cent exceeding point:five (·5) of a cent payment payable to the next cent. It is this latter scheme which has been proposed as the scheme to be adopted in the Commonwealth Awards. There are some rewards from this commission which already provide for payment with three decimal points of a penny for both hourly workers and piece workers or contract workers, and we believe that on this account it will be necessary to extend these amounts in the conversion to decimal currency by three decimals.

We propose to adopt the proposed decision of the Crown and to make general formulation of its terms. (ii) That in the case of weekly rates and rates prescribed in respect of a period exceeding one week, the equivalent amount of money in the currency referred to in the Commonwealth Currency Act 1963, calculated on the basis laid down in Article 8 of that law contains a fraction of a cent, this fraction is deemed to be 1 cent; (iii) lilat in the case of rates other than those specified in paragraph", graph (ii) of this Order, being the equivalent amount of money in the currency provided for by the Monetary Act 1963 of the Commonwealth, calculated on the basis set out in Article 8 of that law includes a fraction of a cent, this fraction is expressed in reference to such an equivalent amount as a decimal fraction of 1 cent, up to three decimal places (the figure of the third decimal place is increased by 1 in the case that the figure to the fourth decimal place is 5 or more). In or after the reference herein to any provision of the Cemmonwealth Currency Act 1963, a reference is included to any amendment, any corresponding provision which replaces or is made in its place in lieu of the coming operation. or in substitution for that law or in lieu of its coming into effect. operation of any provision of that law and whether adopted before, on or after the date of the issuance of this decision: v) .
