Any objection to the approval of an application for provisional permission to establish a crematorium may be lodged with the local authority by any person likely to be affected by the establishment.
1) The Local Authority will notify the applicant in writing of the decision on the application. The Local Authority will notify the relevant applicant in writing of any such extension. All plans, specifications and other information and details must be certified in the manner required by the Local Authority.
Where the holder of a crematorium permit wishes-. a) Construction of a new crematorium in place of the crematorium for which he has the license (in this section referred to as "the existing crematorium") and which is rendered unfit for use as a crematorium by fire, storm or other accident; or. For the purpose of providing properly and adequately to meet the requirements of the locality served by the crematorium, providing a new crematorium and discontinuing the use of the existing crematorium. before commencing the construction or provision of a new crematorium or the proposed alterations, renovations, repairs, additions to or alterations, the holder of the crematorium license must apply for and obtain approval from the local authority for the construction or provision of a new crematorium or the carrying out of the proposed alterations, renovations, repairs, additions to or remodeling of the existing crematorium. Application for approval of construction cpf new crematorium etc. A written application for an approval, which must be obtained in accordance with § 4 M of this Act, is submitted to the Municipality and must-. If the officer in charge of a crematorium cremates or permits the cremation of any human body before receiving all the permits and certificates required to be obtained under this section. such officer is guilty of a misdemeanor and liable to a fine not exceeding one thousand dollars, or to imprisonment at hard labor for a term not exceeding two years, or to both such fine and imprisonment. The officer in charge of the crematorium shall file and keep in the office of the crematorium all permits and certificates that he must receive in accordance with this article and immediately upon the request of a person authorized in this behalf by the Minister of Health. and Home Affairs shall deliver any such document to such person. An officer in charge of a crematorium who fails to comply with any provision of this subsection shall be guilty of an offense and liable to a fine not exceeding two hundred dollars.
This subsection applies so as not to require the officer in charge of the crematorium to keep in his office any such permit or certificate after the expiry of fifteen years from the date of the cremation to which it relates. Provided that the Governor in Council, and notwithstanding anything to the contrary contained in any enactment, law, rule or legal process, may make regulations providing for the exhumation and cremation of the remains of any human body which has been buried for a period of not less than than a year.
(5) The Governor in Council may at any time grant a license to any legally qualified medical practitioner authorizing such practitioner to sign cremation permits and certificates in the prescribed form and to grant permission to cremate any human body after death as provided by subsections 1 and two hereof, and may at any time revoke any such licence. Such provisions shall be laid before Parliament within fourteen sitting days of publication, if Parliament is in session; or, if not, within fourteen meeting days after the commencement of the next session. All matters required or permitted under this Act, other than sections five, 5A, six, seven and eight hereof, shall be prescribed, except such matter (if any) as is required to be prescribed otherwise than by statute or, as the case may be, executive order. The power to make a statute or ordinance shall include power to prohibit either generally or to meet special cases. Any fine prescribed by any statute or order under this Act shall be summarily recoverable under "The Justices Acts, 1886 to 1958," and shall, on recovery, be paid into the general fund of the local authority concerned.
A by-law or, as the case may be, ordinance under this Act may be repealed, amended, altered, amended or otherwise modified by another such by-law or ordinance. Provided, that nothing in this Act shall be read as prejudicing any provisions of "The Local Government Acts, 1936 to 1960," and "The City of Brisbane Acts, 1924 to 1960," in so far as the provisions empower a Local Authority or the Brisbane City Council to establish and maintain crematoria.

The cremation authority must give the minister one month's notice in writing of the opening or closing of any crematorium. Unless he is satisfied that the death of the deceased has been duly registered on production of a death registration certificate under the Registration of Births, Deaths and Marriages Act; or. After the cremation of the remains of a deceased person, the ashes must be handed over to the person who applied for the cremation, if he so wishes.
In the case of ashes temporarily left in the care of the cremation authority and not removed within a reasonable time, the person requesting cremation will be given fourteen days' notice before the remains are buried. Each cremation authority shall maintain a register of all cremations carried out by the cremation authority in Form D of the Annex hereto. If the Governor grants such application, he will issue to the applicant a permit in form E of the Appendix hereto.
A permit issued under the provisions of section 5 of the "Cremation Acts, 1913 to 1935," is in Form F of this Schedule.
