RESOLUTION
The Minutes of the Development Assessment Unit Meeting of Council held on 28 July 2015 be confirmed.
ITEM-2 DA NO. 1328/2015/HA/A - SECTION 96 (1A) MODIFICATION TO AN APPROVAL FOR THE CONSTRUCTION OF A TEMPORARY SALES OFFICE - LOT 4 DP 253552, NO. 121 OLD PITT TOWN ROAD, BOX HILL
RESOLUTION
The Section 96 be approved subject to the following conditions of consent.
Condition Nos. 10 and 29 be deleted and replace as follows:
10. Minor Engineering Works
The design and construction of the engineering works listed below must be provided for in accordance with the following documents and requirements:
a) Council’s Design Guidelines Subdivisions/ Developments b) Council’s Works Specifications Subdivisions/ Developments
PAGE 2 Any variance from these documents requires separate approval from Council.
Works on existing public roads or any other land under the care and control of Council must be approved and inspected by Council in accordance with the Roads Act 1993 or the Local Government Act 1993. A separate minor engineering works application and inspection fee is payable as per Council’s Schedule of Fees and Charges.
i. Driveway Requirements
The design, finish, gradient and location of all driveway crossings must comply with the above documents and Council’s Driveway Specifications.
The proposed driveway must be built to Council’s medium duty standard.
The driveway must be 6m wide at the boundary splayed to 7m wide at the edge of the road pavement. The driveway must be a minimum of 6m wide for the first 6m into the site, measured from the boundary.
A separate driveway application fee is payable as per Council’s Schedule of Fees and Charges.
ii. Localised Pavement Widening
In addition to the new driveway crossing above, the following additional works in Old Pitt Town Road must be carried out prior to the issue of any Occupation Certificate (either Interim or Final Occupation Certificate) being issued:
Prior to issue of any Occupation Certificate
Interim widening to allow for a westbound passing lane, generally in accordance with drawing 9976/SK239 by J. Wyndam Prince dated 23 July 2015.
Within 8 months of the issue of any Occupation Certificate
The existing road pavement in Old Pitt Town Road must be locally widened near the proposed driveway so that there is sufficient space/ width for a vehicle turning left into the site to not impede through traffic travelling east. Similarly, widening must occur on the opposite side of the road so that there is sufficient space/ width for a vehicle turning right into the site to do so without impeding through traffic travelling west.
iii. Disused Layback/ Driveway Removal
All disused laybacks and driveways must be removed and replaced with kerb and gutter together with the restoration and turfing of the adjoining footpath verge area.
iv. Earthworks/ Site Regrading
Earthworks are limited to that shown on the approved plans. Where earthworks are not shown on the approved plan the topsoil within lots must not be disturbed.
v. Stormwater Drainage – Rural
Stormwater runoff is to be dispersed over the rear of the site via a level spreader/
absorption trench or similar, in lieu of a formal legal point of stormwater discharge via a piped connection/ outlet to a natural watercourse, generally as shown on the concept plan Drawing 997603/DA00 to Drawing 997603/DA05 Revision B.
29. Completion of Engineering Works
An Occupation Certificate must not be issued prior to the completion of all engineering works covered by this consent, in accordance with this consent. This does not extend to the localised pavement widening in Old Pitt Town Road required by Condition 10(ii), which must instead occur within 8 months of an Occupation Certificate being issued.

The Section 96 Application be approved subject to the following:

The development being carried out in accordance with the following approved plans and details, stamped and returned with Development Consent 1563/2010/LA as amended by the approved plans and details, stamped and returned with Section 96 Consent 1563/2010/LA/A, except where amended by other conditions of consent.

No work (including excavation, land fill or earth reshaping) shall be undertaken prior to the issue of the Construction Certificate, where a Construction Certificate is required.
2. The addition of the following condition:
11A. Screen Planting
Screen planting is to be provided along northern (side) boundary between the dwelling as approved by Development Consent 1563/2010/LA and the common boundary of No.
19 and No. 21 Telfer Road. The screen planting is to extend for the full length of the building envelope along this boundary. The screen planting species is to be capable of having a mature height of greater than 4.0 metres.
NB: Further late submissions received from the adjoining owner were tabled and discussed at the meeting.
