3.4 PROPOSED EXTRACTIVE INDUSTRY - LOT 201 (NO.1528) GREAT NORTHERN HIGHWAY, UPPER SWAN (DA194-18)

KEY ISSUES

 This application is for the continued extension of clay operations at the subject lot and for the expansion of such activities for Phase two in a northerly direction for another 10 years.

 It is proposed that the existing pit will extract 12,000 tonnes of clay per annum, with extraction occurring over a period of three weeks and carting of the clay material will occur approximately 3-4 weeks over the summer months.

As such, the site will only be operational for 6-7 weeks in a 12 month period.

 Due to a the lack of market demand in the construction industry, it is estimated that there will be a significant reduction in vehicle movements from approximately 4,400 to 700 combined truck movements (in and out of the site) over the 6-7 weeks of the year.

 The land is zoned 'Rural' under the Metropolitan Region Scheme (MRS) and 'Landscape' under the City of Swan's Local Planning Scheme No.17 (LPS17). An 'Extractive Industry' is an 'A' use within this zone; which means that the use is not permitted, but can be considered after giving special notice by way of advertising.

 The application was advertised for a period of 21 days to surrounding landowners within 1km radius, sign on site and notice in the local newspaper.

At the close of advertising a total of 13 submissions were received; eight objections, four non-objections and one stated neither, but provided comments to consider.

 The objections and concerns raised from the residents relate primarily to dust, traffic, access, amenity and noise. The applicant has supplied accompanying technical plans and information which City staff considers compliant and addresses the concerns raised.

 One specific comment was raised in relation to the applicant/owner contributing to the Apple Street/Great Northern Highway roundabout. Given the significant reduction in vehicle movements and the timing of the roundabout unknown, there are no conditions relating to a contribution to the upgrade of this infrastructure. City staff consider this appropriate given there is no need or nexus to warrant a contribution.

 Main Roads WA has considered the application and has no objections to the development and associated vehicle movements on Great Northern Highway,

 The application is consistent with the Western Australian Planning Commission’s State Planning Policy 2.4 – Basic Raw Materials, which identifies the site for future extraction as the highest category of ‘Priority Resource Location’. Extraction of basic raw materials is integral to the continued development of the State and the proposed development is considered appropriate in this location.

 It is noted that in accordance with clause 32 of the Metropolitan Region Scheme (MRS), the application requires determination by the Western Australian Planning Commission (WAPC).

It is recommended that the Council resolve to grant conditional approval for the Extractive Industry (Clay Excavation) and Licence for 10 years on Lot 201 (No.1528) Great Northern Highway, Upper Swan.

AUTHORITY/DISCRETION

In accordance with the requirements of Notice of Delegation RES 2014/01 Resolution Under Clause 32 of the Metropolitan Region Scheme (9 May 2014), the application is to be forwarded to the Western Australian Planning Commission for a dual determination.

DETAILS OF THE PROPOSAL

This application is to extract abundant clay over approximately 39ha, north of the existing extractive clay industry at Lot 201 Great Northern Highway and Lot 135 Coondaree Parade, Upper Swan.

The southern portion of the site has been historically utilised for extractive clay industry purposes for over 20 years and is now being used as water detention basins. The northern portion of the land comprises of approximately 39ha and of abundant clay, where some extraction has already occurred. The subject of this application is to continue to extract clay in a northerly direction, inclusive of a new licence for up to 10 years.

Other key aspects of the proposal include the following:

 Approximately 12,000 tonnes of clay per annum will be extracted from site;

 Due to a the lack of market demand in the construction industry, it is estimated that there will be a significant reduction in vehicle movements from approximately 4,400 to 700 combined truck movements (in and out of the site) each year.

 It is expected that clay will be extracted over a period of 3 weeks and carting of the clay material will occur approximately 3-4 weeks over the summer months.

As such, the site is in operation for 6-7 weeks in a 12 month period;

 The proposed hours of operation are from 7:00am - 6:00pm from Monday to Saturday. No operation will occur on Sundays or Public Holidays;

 A maximum depth of 7m is proposed;

 Bunds have been established along the boundary of the site and vegetative screening is currently planted on the along the boundaries;

 Temporary structures will be placed on site over the duration of the development;

DESCRIPTION OF SITE

The site is situated on the eastern side of Great Northern Highway and north of Coondaree Parade, in the suburb of Upper Swan. The other closest intersections are on the western side of Great Northern Highway at Apple Street (north-west) and Station Street (west). Refer to Location Plan Attachment.

The subject lot is irregular in shape and comprises of a total of 76ha. There is a freehold owned Drainage Reserve (Lot 135 Coonadree Parade) which is to the benefit of the City and dissects the lots into two parcels. Refer to Site Plan Attachment.

The southern portion of the site has been historically utilised for extractive clay industry purposes and are now being used as water detention basins.

The site is situated amongst 8ha rural lots and is also directly abutting other extractive industries. The closest residential property is approximately 150m east from the boundary of the operations.

Public consultation was completed as follows:

Method: Letters to all properties within 1,000m from the subject property, sign on site, notice in the Local Newspaper and on the City's website.

Submissions Received:

A total of 13 submissions were received:

 Traffic (5);

 Timing of Rehabilitation (4);

 Visual Amenity (3);

 Noise (3); and

 Hours of Operation (3)

A Schedule of Submissions has been prepared by the Applicant and is attached.

CONSULTATION WITH OTHER AGENCIES AND/OR CONSULTANTS

In addition to the public consultation, the following service providers and government agencies were invited to provide comment on the proposal.

All agencies that responded offered no objection; however Main Roads WA (MRWA) provided specific advice notes and recommendations. These comments and recommendations are discussed within the content of this report as well as attached in the Schedule of Submissions. It is noted that the Department of Biodiversity, Conservations and Attractions did not provide a response.

DETAILS

Zoning and Permissibility of Use

The subject site is zoned 'Landscape' under the City's Local Planning Scheme No.17. An 'Industry - Extractive' is an 'A' use within this zone. This means that the use is not permitted unless the local government has exercised its discretion by granting planning approval after giving special notice by way of advertising.

Objectives of the Landscape Zone

The objectives of the Landscape Zone are to -

(a) provide for low density rural residential development and associated rural-residential activities, recognizing the visual characteristics of the landscape;

(b) ensure as far as practicable, that the environmental and landscape characteristics of the area are not compromised by development and the use of the land for either rural or residential purposes;

(c) encourage the rehabilitation of degraded areas through selected replanting of indigenous flora.

With reference to Objective (a), the quarrying of land to obtain material such as clay is not considered a productive rural-residential activity. However, the extraction of clay material which is used for the production of brick product for construction purposes is considered to contribute to the economic base of the region. Furthermore, the type of resource is considered a 'Priority Resource Location', which is consistent with the Western Australian Planning Commission’s State Planning Policy 2.4 – Basic Raw Materials. On this basis it is considered that the proposal fulfils in part this objective.

Accompanying the application is technical information which contains management measures to mitigate against environmental impacts for dust, noise and vibration, which compliance is further discussed in the content of this report. In terms of the visual characteristics of the landscape, the resource activity is concealed from the primary road through mature vegetation, low lying bunds and previous excavation areas utilised as water detention basins. Ultimately the rehabilitation of the land will fully restore the pre- development rural character of the site and therefore will comply with Objectives (b) and (c).

Applying discretion to the use and works, involves assessment against the concerns raised by surrounding owners.

Dust

Six out of the eight objectors raised concern regarding the impacts of dust.

In accordance with the Dust Management Plan, the applicant has identified a range of control procedures to manage dust, including dust suppression (watering), covering trucks with tarpaulin, daily monitoring of weather conditions, containment bunds and complaints procedure.

Over the course of the extractive industry operation, a total of 4 complaints have been received relating to dust, which were received between 2008 - 2010. City staff investigated the dust concerns and concluded the impact did not derive specifically from this site and on the other occasions was a result of a once off malfunction to dust suppression measures at the wheel wash facility. In all occasions, the applicant was responsive and prompt to action concerns raised.

City staff are satisfied that the measures contained within the report should mitigate against dust impacts on the surrounding properties and recommend compliance to this report as a condition of planning approval.

Traffic, Safety and Road Upgrades

Five out of the eight objectors raised concern regarding the amount of traffic and increase to accidents.

Unlike the historic operations from the site, this application involves a significant reduction in the number of vehicle movements from 4,400 movements to 700. These truck movements are proposed to occur over a maximum of 6-7 weeks per year.

Main Roads WA has considered the application and accompanying Traffic Impact Assessment prepared by Shawmac and has no objections to the development and associated vehicle movements on Great Northern Highway, subject to additional conditions:

1. When Coondaree Parade is suitably constructed to the satisfaction of the City of Swan (and on advice from Main Roads) access must be removed from Great Northern Highway and all access to the site shall be via Coondaree Parade.

2. The driveway to Great Northern Highway shall be sealed from the edge of the seal of the carriageway for 20m or to the property boundary, whichever is the greater. This condition is being imposed to prevent material from the site being tracked onto Great Northern Highway.

3. No new vehicle access shall be permitted onto the Great Northern Highway reserve.

Coondaree Parade is not suitably constructed at this point, therefore it not used as a primary access to the site. These works will be undertaken by the City, in consultation with Main Roads WA as part of the future intersection upgrades.

Future Intersection Upgrades

The Upper Swan Local Structure Plan was endorsed by the Western Australian Planning Commission (WAPC) on the 17 January 2018. Principally, the Structure Plan identifies that the intersection of Apple Street and Great Northern Highway will require upgrading to accommodate the expected additional traffic, in the form of a roundabout of approximately 60m in diameter.

One submission was received from Planning Solutions on behalf of the landowner at Lot 4 Great Northern Highway (south-west of the subject site). The comments received suggested the City to consider the applicant/owner contributes to the infrastructure for the proposed Apple Street/Great Northern Highway four-leg round about in the form of a Development Contributions Plan (DCP), as well as concerns with access to and from the site.

In response to the above, City staff can advise that City, MRWA, affected landowners and Satterley have been in consultation regarding the design, access (pre, during and post development), land acquisition/ceding and funding. MRWA's discussions and submission does not suggest that a contribution is warranted from the applicant/owner.

This is perhaps explained by virtue of a significant reduction in vehicle movements to and from the site. Furthermore, City staff has advised that no additional contributions are warranted.

Page 7 Site Rehabilitation

Four out of the eight objectors raised concern with the timing of rehabilitation and resultant visual impact. It is considered more practical and effective that the full rehabilitation will be completed by the end of the lifespan of the facility, as opposed to occurring on a stage by stage basis. Ultimately the rehabilitation of the land will fully restore the pre-development rural character, with amenity basins. Refer to the Attached site visit photos.

A condition is recommended ensuring that all works are to be done in accordance with the Rehabilitation Plan, to the satisfaction of the City.

Visual Amenity

Three of the eight objectors raised concern regarding the impacts to the visual amenity.

The landowners who have expressed concerns regarding the visual amenity are between 1200m - 1300m from the extraction site. There are bunds which have been established along the primary road which also have established mature vegetation and appropriately screen the extraction activities.

The predominant area of the subject site has already been extracted for clay over the site for the past 20 years. The area proposed for phase 2 is essentially to continue removing the remaining clay from an existing pit. This extraction further north is not considered to add any further undue visual impacts which would compromise the amenity of the locality.

Noise

Three out of the eight objectors raised concern regarding the impact of noise from the extractive industries, particularly from trucks and equipment used.

In accordance with the Noise Management Plan, the clay extraction process does not involve blasting or major noise-generating practices. Noise generated from work on site is largely from trucks and earthmoving equipment, which is similar to that used for farm machinery. All equipment aims to minimise noise generation, such as using broadband reversing beepers.

City staff are satisfied that the measures contained within the report should mitigate against noise impacts on the surrounding properties and recommend compliance to this report as a condition of planning approval.

Hours of Operation

Three of the eight objectors raised concern about adhering to the hours of operation.

It is noted that the hours of operation remain at 7:00am - 6:00pm from Monday to Saturday. No operation will occur on Sundays or Public Holidays. The hours of operations are compliant with the Environmental Protection (Noise) Regulations 1997. A condition of the hours of operations is recommended as a condition of planning approval.

Page 8 Extractive Industry Local Law

It is worth noting that the applicant has also submitted an application for an Extractive Industry Licence under the By-Law relating to Extractive-Industry. Licences can be issued on a 10 yearly basis following approval being granted by the WA Planning Commission (WAPC).

The application has been advertised, mindful of the requirements of the City's By-Laws and therefore will not require further advertising at a later date. Once planning approval is granted by the WAPC, it is recommended that the licence be issued under delegated authority. Until this time, the application for the licence should be deferred.

OPTIONS AND IMPLICATIONS

Option 1: Council may resolve to grant approval for the Extractive Industry at Lot 201 (No.1528) Great Northern Highway, Upper Swan and Lot 135 Coondaree Parade, Upper Swan subject to conditions.

Implications: The application will be forwarded to the Western Australian Planning Commission for determination under Cl.32 of the Metropolitan Region Scheme.

This is the recommended option.

Option 2: Council may resolve to recommend refusal for the Extractive Industry at Lot 201 (No.1528) Great Northern Highway, Upper Swan and Lot 135 Coondaree Parade, Upper Swan for the following reasons:

1. The Extractive Industry will have an adverse impact on the amenity of the locality as is not consistent with the objectives of the Landscape Zone.

Implications: The applicant will have a right of review by the State Administrative Tribunal.

This is not the recommended option.

CONCLUSION

This application is to extract abundant clay over approximately 39ha, north of the existing extractive clay industry at Lot 201 Great Northern Highway and Lot 135 Coondaree Parade, Upper Swan. In addition, this application requests a new licence and development approval be issued to permit the continued operations for approximately another 10 years.

The proposal is considered to be of minor scale and is unlikely to cause significant impacts on the existing or future amenity of the rural locality. The objections and concerns raised from the residents relate primarily to dust, traffic, access, amenity and noise. The applicant has supplied accompanying technical plans and information which City staff considers compliant and addresses the concerns raised.

The application was also referred to various Departments with no objections, subject to specific conditions from the Department of Water, Environment Regulation and Main Roads WA.

The application is consistent with the Western Australian Planning Commission’s State Planning Policy 2.4 – Basic Raw Materials, which identifies the site for future extraction as the highest category of ‘Priority Resource Location’. It is recommended approval, subject to conditions.

It is noted that in accordance with clause 32 of the Metropolitan Region Scheme (MRS), the application also requires determination by the Western Australian Planning Commission (WAPC).

That the Council resolve to:

1) Approve the proposed Extractive Industry and Licence (10 years) at Lot 201 (No.1528) Great Northern Highway, Upper Swan and Lot 135 Coondaree Parade, Upper Swan subject to the following conditions:

1. This approval is for an "Industry-Extractive" use and the works proposed shall be in accordance with the Clay Extraction Management Plan, prepared by Land Insights stamped date received 16 March 2018.

2. This approval is valid for ten (10) years from the date of approval. Following this period, the development shall not be continued and the land must be returned to the sites pre-excavation conditions as reasonably practicable unless further development approval is sought and granted.

3. Approval for this development application has been based on clay being extracted over a period of 3 weeks and carting over an additional 3-4 weeks annually during the summer months. Variance from this will require further assessment and approval.

4. Operating times are to be limited to 7:00am to 6:00pm, Monday to Saturday.

No works are to occur on Sundays or Public Holidays.

5. The depth of the excavation is limited to a maximum of 7 metres below natural ground level.

6. A record must be made, kept on site and be made available on the request to the City of Swan Manager of Health & Building Services of all occurrences where site activity has ceased due to dust being observed crossing the site boundary.

A record of the action taken to rectify the dust nuisance should also be made.

7. Traffic movements shall not exceed 700 (two-way) vehicles per year, in accordance with the Traffic Impact Assessment (Revision B) dated 14 June 2018, to the satisfaction of the City.

8. All truckloads of material shall be securely covered to prevent any dust escape during transport.

9. When Coondaree Parade is suitably constructed to the satisfaction of the City of Swan (and on advice from Main Roads WA) access must be removed from Great Northern Highway and all access to the site shall be via Coondaree Parade.

10. No new vehicle access shall be permitted onto the Great Northern Highway reserve, to the satisfaction of Main Roads WA.

11. No earthworks shall encroach onto Great Northern Highway reserve.

12. The driveway to Great Northern Highway shall be sealed from the edge of the seal of the carriageway for 20m or to the property boundary, whichever is the greater. This condition is being imposed to prevent material from the site being tracked onto Great Northern Highway.

13. All works are to be done in accordance with the Rehabilitation Plan, to the satisfaction of the City of Swan.

14. Annual reports are to be submitted to the City by 31 July of each calendar year detailing rehabilitation works undertaken and a schedule of works completed and proposed for the following year.

17. Access onto the site shall be restricted to that shown on the approved plan.

18. Earthworks, footings and/or structures are not to extend over any lot boundaries.

19. Earthworks over the site and batters must be stabilised to prevent sand blowing, and appropriate measures must be implemented within the time and in the manner directed by the City in the event that sand is blown or drifts from the site.

20. The applicant is to ascertain the location and depth of any services that may interfere with this development. Any adjustment to these services required as part of this approval, must be arranged by the applicant prior to works commencing on the site. Any adjustment must be approved by the relevant service authorities and will be at the applicant's expense.

21. Any additional development, which is not in accordance with the application (the subject of this approval) or any condition of approval, will require further approval.

2) Forward the application to the Western Australian Planning Commission for determination in accordance with Clause 32 of the Metropolitan Region Scheme.

3) Upon planning approval issued by the Western Australian Planning Commission under Clause 32 of the Metropolitan Region Scheme, the proposed Extractive - Industry Licence (10 years) can be issued under Delegated Authority by the City of Swan.

4) Advise all those who made a submission of Council’s decision accordingly.

MOTION that the Council resolve to:

1) Adopt the staff recommendation with the following modification to Condition 12:

“The driveway to Great Northern Highway shall be sealed from the edge of the seal to the carriageway for 20 m or to the property boundary, whichever is the greater. The applicant/owner shall maintain the driveway free of mud, sand and other material.”

2) Note the reason for changing the staff recommendation is to ensure that material is not transported from the driveway of the site onto the Great Northern Highway by vehicles.
