Executive Summary

Development Services

Activity levels remain steady for the Development Assessment team with applications

generally being processed within IDAS timeframes. It should be noted that Council continues to receive and process a significant number of amendment applications to extend the currency period and/or amend plans of development. This trend aligns with the existing economic cycle. It is positive to see that works commenced this month includes the 64 multiple dwelling units at 5 - 7 Nelson Street known as Riviera Mackay Apartments.

A total of 24 Survey Plans were sealed in July 2014 which is a significant increase from the previous month of June 2014. Similarly, the total of approved construction work for July 2014 was $10,082,197 which is significantly higher than the July 2013 figure of $4,751,011.

Operational Works approved includes civil works for health care centre, commercial premises and undefined use (gym) in Paget.

Within the Health & Regulatory team, a strong emphasis was placed on assessing increased numbers of applications and inspections associated with outdoor events. Staff also organised and facilitated the very successful Responsible Pet Ownership Day on 26 July, where the community took advantage of pet information, discounted registrations and micro chipping.

The incident statistic summary details a summary of the Development Services incident performance. These are incidents involving injury only, not motor vehicle, loss, theft or damage.

Three incidents were reported for the month. Incident No.1: A staff member was turning scooter into driveway and slipped on gravel, falling onto right side/chest. No time was lost.

Incident 2 & 3 are for the same incident, as two Officers were affected and both Officers are required to submit reports, therefore they have been given separate Report Numbers. Both Local Laws Officers were threatened by a member of the public who had become abusive when told their dog was no longer available for pick up, despite being informed previously.

No time was lost.

Draft Mackay Region Planning Scheme – Review of Residential Provisions Feasibility

As part of the review of the Draft Mackay Region Planning Scheme (DMRPS), the feasibility of residential development requirements are being reviewed. Findings from an external review indicated that some improvements to the Draft Planning Scheme’s residential provisions can be made, which is currently being considered.

Focus

Planning and Development Bill and Planning and Environment Court Bill

As part of the government’s reform agenda, the Sustainable Planning Act 2009 (SPA) is being replaced with legislation aimed at facilitating the prosperity of Queensland. The Queensland Government has released the new Planning and Development Bill and the Planning and Environment Court Bill for consultation.

The purpose of the new legislation is to facilitate the prosperity of Queensland, by giving effect to a planning system that balances community wellbeing, economic growth and environmental protection. The draft bills are the culmination of the government’s reform of the planning and development assessment system including planning reform initiatives already implemented, such as the new State Planning Policy and new Regional Plans. New features relate to planning schemes, development assessment provisions and processes, dispute resolution procedures, temporary instruments and charges for trunk infrastructure.

The new legislation seeks to streamline plan-making and development assessment processes, better define concepts and terminology and reduce timeframes to create more opportunities for positive development in Queensland. The new bill, once enacted, will have significant impacts on Council’s development assessment systems and procedures, planning schemes and related policies. The Bills are being reviewed with the intent to make a submission.

Submissions close 26 September 2014.

Planning

The average number of applications for July decreased to 49 which is a decrease on June but is above the lows in the Economic Cycle in January 2014.

Council will need to continue to monitor the activity levels to see if the rising trend line since January continues.

The applications received in July were for seven Dual Occupancies, one Multiple Dwelling Unit, one Industrial building, eleven requests to amend conditions/extend currency periods and one Rural Residential Sub-division application as well as 14 Setback requests and eight Dwelling House Overlay applications.

Applications are in general being processed within IDAS timeframes and as detailed in another part of this report.

It should be noted that Council continues to receive and/or has processed a significant number of amendment applications to extend the currency period and/or amend the plans of development this month. This is a reflection of the current economic cycle.

Of note was the approval of Stage 14 of Royal Sands Estate for 20 lots as well as the Consent Order for Stages 4A, 4B and 4C of Plantation Palms Estate for 395 lots.

The Impact applications carried forward is consistent with similar trends. Due to the notification period required for these applications, they cannot be lodged and completed within a calendar month.

The number of amended applications in the various stages are consistent with recent months.

The total of approved construction work for the Month of July was

$10,082,197 which is significantly higher than July 2013 of $4,751,011. The July 2014 total was also slightly higher than the previous month of June which had a total value of $7,556,722.

Engineering

The number of Operational Works applications that were received for the month of July was 9 which is a slight increase from the 8 that were received in the previous month of June. Development Engineering issued 10 approvals in July with 90% meeting their target timeframe. 26 Operational Works applications have been carried forward; these applications may be under an applicant’s response period, an extension period or a Council issue period.

The number of Survey Plans sealed in the month of July was 24 which is a significant increase from the previous month of June.

16 new Plan Sealing applications were received in July, those that have not have been approved for sealing are under assessment or Action Notice (Information Request).

39 Minor Works application were lodged in July. Throughout the month, 38 applications were approved with 62 carried forward.

The following performance results were achieved:

decided in 40 days with average being 11 days.

 MCU Impact applications – 100%

decided in 40 days with average being 28 days.

The Development Assessment Innovation Project is now known as the Focus on Development Project and has commenced on the 12 May 2014 for accelerated low risk applications. Specialised fast- track/streamlined applications for multiple dwellings and industrial buildings have commenced and will be reported on once a statistically significant number of applications have been received.

The number of new Operational Works applications received for July was 9. Out of the 9 new applications 1 Decision Notice was issued, 4 applications remain in the Decision Making Period, 1 application is in the Not Properly Made Period, 2 applications in the Information Request Period, 1 application in the Extension of Information Request Period. Overall timeframes for the month of July were or are going to be met.

Client Requests

Overall, numbers of client requests received remained steady when compared to the previous month. There were slight decreases consistent across all service areas apart from Local Laws where there was a 10% increase due to abandoned vehicle and animal related requests, particularly barking dogs, aggressive dogs and wandering dogs.

Although, with the increased numbers of these requests received, Officers still were able to maintain a 60% completion rate for abandoned vehicles, and aggressive and wandering dogs.

Outdoor events have featured predominantly this month with Environmental Health Officers assessing increased numbers of applications and carrying out inspections with respect to conditions of approval and temporary food.

Monthly Infringements Activity

Total Infringements issued from 01 July to 31 July 2014 was 791

Infringements required to be issued by Officers this month increased across the full spectrum of regulatory activities undertaken, apart from development compliance, which remained steady.

Numbers of infringements issued relating to regulated parking increased from 524 in June to 745 in July. This 30% increase has been attributed to further improvements to coordination, modifications to patrolling regimes, and fine weather.

A summary of YTD Infringement Data has not been provided in this report as this is the first month on the 2014/15 year.

Out and About – Responsible Pet Ownership Day

The Responsible Pet Ownership Open Day was held on Saturday, 26 July 2014.

Discounted registrations and micro chipping were available as well as stalls from Jaimon Boarding Kennels, Hillcrest Boarding Kennels, Canine Control Council, Soi Dog Foundation (animal refuge in Thailand), RSPCA Education Mobile Unit (EMU) and Andergrove Vets. $5,706.00 was taken on the day for registration & micro chipping, which included:

Month’s Highlights

Development application lodgements remain consistent based on previous month’s, however lodgements are still down compared to the same time last year. 50% of applications are lodged online via the eDA service.

The number of Planning advice enquiries remains steady with 38% of enquiries being received and answered, in person, at the Development Services Counter.

On average, planning advice enquiries are responded to in less than 1 day, which is well within KPI requirements.
