There are a number of drink driving laws in the Northern Territory.
If you are found breaking these laws certain penalties apply. If you are found breaking these laws a second or third time the penalties are much more severe.

Some people charged with drink driving offences must go to court while others will be issued with an infringement notice.

If you are caught driving with a Blood Alcohol Count (BAC) between 0.05 and 0.08 and it is your first offence, police can issue an infringement notice instead
of taking you to court. The infringement notice imposes a fine of$ I 00 and results in cancellation of your licence. If you wish to take the charge to
court you can object within 28 days.
YOU WILL HAVE TO GO TO COURT IF:

your (BAC) was .15 or moreQ
you object to an infringement notice.If you have a BAC of .15 or more or a prior drink driving offence (including an interstate offence) your licence will be suspended on the
spot, until the case comes to court.

in charge of a vehicleQ
involved in an accident to undergo a preliminary breath test.@J
A blood sample is taken from everyone aged 15 years or more who goes to a hospital or treatment centre after being the driver of a motor vehicle that has been involved in a crash. A blood sample may also be taken if the treatment staff are not sure whether the patient was driving or not.0
NT Police officers may require any person found driving or in charge of a commercial motor vehicle to undergo a preliminary breath test.OTHER VEHICLES
All of the offences listed on the other side of this pamphlet apply only to the drivers of motor vehicles such as cars, trucks and motor bikes.
