HEREAS the Crown land hereinafter described has since the commencement of the Act of the Parliament; of Our Colony of Victoria numbered 3(i0 (being the " A c t to Amend and Consolidate the Laws relating to the Sale and Occupation of Crown Lands") been lawfully permanently reserved from sale by the Governor of Our said Colony with the advice of the Executive Council of the same for. the purposes hereinafter appearing and possession of such land lias been given Now know ye that in order to promote sound learning in Our said Colony and to provide a site for a School of Medicine and Surgery in connection with the University of Melbourne We of Our own special grace have granted and for Us Our heirs and successors do hereliy grant unto the University of Melbourne incorporated under and by- virtue of an Act of the Lieutenant-Governor and Legislative Council of Our said Colony made and passed in the sixteenth year of Our reign numbered thirty-four intituled " A n Act to Incorporate and Endow the University of Melbourne " and tp their successors all that piece or parcel of land in the said Colony containing Three acres three roods and twenty-five perches or thereabouts situated in the County of Bourke City of .Melbourne at Carlton commencing on the west side of Madeline-street at a point on aline formed by the prolonga- tion of the north boundary of the University reserve bounded thence by that line bearing west six chains fifty-four links thence by lines bearing respectively south seven minutes east five chains ninety-eight links and east six chains fifty-three links to the aforesaid street and thence by that street bearing north five chains ninety-eight links to the point of commence- ment and shown with the measurements and abuttals thereof in the map drawn in the margin of these presents and-therein coloured yellow Together with all tho rights members privi- leges and appurtenances whatsoever tortile same belonging or in anywise appertaining Reserving and accepting unto Us Our heirs and successors, the use of all such parts of the said land as shall be-required for making railways canals water- courses reservoirs drains or sewers over in upon or through3 8 CROWN GRANT OF MEDICAL SCHOOL GROUND.
the same with full and free liberty of ingress egress and re- gress into out of and upon the said land for such purposes To have and to hold the said land and premises unto the University of Melbourne and their successors' Provided never- theless and we do hereby expressly declare that this Our Royal Grant is and shall be subject to the conditions provi- sions and declarations hereinafter mentioned (that is to say) That the said land hereby granted and the buildings for the time being thereon shall be at all times hereafter maintained and used as and for a School of Medicine and Surgery and offices and conveniences and for garden pleasure and recrea- tion grounds connected therewith under and in accordance with the said Act and with such statutes and regulations as shall from time to time be made by the Council of the said University in pursuance of the said Act and for no other pur- pose whatsoever I'rovided also and we do hereliy further declare that if the body politic and corporate of the said
LTniversity shall be dissolved or by any means become extinct and be no longer existent or shall permit or suffer the said land and premises or any part thereof to be used for or applied to any other than the purpose aforesaid or shall alienate or attempt to alienate in fee-simple or for any less estate or interest the said land and premises or any part thereof save and except under and in pursuance of some law now or hereafter to be in force within the said Colony it shall be lawful for Us Our heirs and successors by any person or persons duly authorized in that behalf by the Governor or other officer for the time being administering the government of Our said Colony to re- enter upon the said land or any part thereof and to hold pos- sess and enjoy the same as fully and effectually to all intents and purposes as if this Grant had not been made I N TESTI- MONY whereof Wre have caused this Our Grant to be sealed with the Seal of our said Colony.
