Environmental Protection (Controlled Waste) Regulations 2004 Part 4, Regulation 49
Exemption Number 01/2019
In accordance with regulation 49(1), I am satisfied that:
(a) the circumstances in which this exemption is requested are justifiable and accountable; and
(b) the exemption will not adversely affect the operation of the Environmental Protection (Controlled Waste) Regulations 2004.
and I HEREBY EXEMPT Rotary Club of Swan Districts Inc. from Part 2 and 3 of the Environmental Protection (Controlled Waste) Regulations 2004 on the terms and conditions set out in this notice.
Activity to which this exemption applies
1. The transport on a road of used lead acid batteries (ULABs), packed on wrapped pallets, by members of the Rotary Club of Swan Districts Inc.
collected from WesTrac Pty Ltd, 128 Great Eastern Highway, South Guildford and unloaded at C.D. Dodd Scrap Metal Recyclers, 521 Dundas Road, Forrestfield.
Exempted regulations
Rotary Club of Swan Districts Inc. is exempted from compliance with the following regulations;
• Part 2 and 3 of the Environmental Protection (Controlled Waste) Regulations 2004
Conditions of exemption
This exemption is subject to the conditions specified below:
1. The exemption applies to the Rotary Club of Swan Districts Inc. only for the specified Activity.

2. The Rotary Club of Swan Districts Inc. must keep a record of the amount (weight) of ULABs transported and unloaded at C.D. Dodd Scrap Metal Recyclers for at least three years from the day on which the waste is unloaded at the waste facility.
3. Upon request by the CEO, the Rotary Club of Swan Districts Inc. must provide a written report relating to the transportation and unloading of the ULABs.
Period of exemption
This exemption begins on the date of this notice and ends on 30 July 2024.

(i) In accordance with subregulation 49(2) the CEO may by written notice revoke or vary this exemption notice at any time.
BREACH OF NOTICE
(ii) In accordance with subregulation 49(2E) if a condition subject to which an exemption is given is breached, the exemption ceases to have effect and you will be subject to all relevant offences in the Regulations.
