1 INTRODUCTION

1.1 PURPOSE

The purpose of this report is to provide information that fulfils the Reporting Conditions for Licence Number L8988/2016/1 that has been issued to B&J Catalano Pty Ltd under the

Environmental Protection Act 1986, by the Department of Environment Regulation (DER), for the period 10th January

2017 to 30 June 2021. This report is due by 10 January 2020.

The full Licence and the conditions that pertain to it are included as Appendix 1 to this document. This report provides an environmental assessment on the emissions and discharges from the Premises.

1.2 BASIS OF ASSESSMENT

The gravel quarry on Lot 83 Great Northern Highway (the Premises) has been assessed as a prescribed premises, under Category 12 (Screening, etc. of material) of Schedule 1 of the Environmental Protection Regulations 1987:

“Category 12 is applicable to premises on which material extracted from the ground is screened, washed, crushed, ground, milled, sized or separated.”

The Premises has been approved as having a production or design capacity of 240,000 tonnes per annual period.

2 BACKGROUND

2.1 GENERAL COMPANY DESCRIPTION

The Company was established in 1962 as a transport and earth moving operation in the South West of Western Australia and since then have expanded into the Metropolitan and Midwest regions with over 300 employees. B&J Catalano Pty Ltd operate a number of basic raw material quarries and its customers include large corporations, local and state government, mining companies, builders and contractors. The company have their head office in Brunswick Junction and contact details are as follows:

2.2 DESCRIPTION OF PREMISES

2.2.1 Location

The Donningtons Gravel Quarry is located within the Shire of Chittering. The site is located approximately 5km south-west of the Chittering townsite and approximately 11km north-east of Muchea in Western Australia.

2.2.2 Community and Sensitive Premises

The surrounding land use includes farming, extractive industry operations, tree plantations and rural small holdings. There are several sensitive residential receptors within 1000m of the extraction stages as depicted on Figure 1.

2.3 PROCESS DESCRIPTION

The site activities involve the use of a mobile plant to crush and screen up to 240,000 tonnes of gravel per year, dependent on demand.

The plant comprises the following:

A primary jaw crusher

Screening plant

Secondary impactor

Radial stacker

Trailer mounted diesel generator

Loader

Bulldozer

The process comprises gravel preparation, processing and rehabilitation.

2.3.1 Gravel Preparation

Topsoil will be stripped and placed in windrows along the edges of the working area to serve as a noise, stormwater and visual barrier.

A bulldozer will rip the laterite and then blade it into the crusher sites until a large raw material stockpile has accumulated.

The raw material will be loaded into the crusher using a front-end loader.

2.3.2 Processing

Electric primary and secondary crushers, powered by self-contained diesel generators, crush the laterite into smaller fragments.

The screening plant screens out the product to correctly sized gravel, which is then stacked into stockpiles.

The gravel is then loaded from stockpiles to road trucks and taken off-site.

2.3.3 Rehabilitation

Progressive rehabilitation will be undertaken as excavation in each area is completed.

The completed excavation floor will be deep-ripped in two directions.

Overburden, followed by topsoil is spread across the surface. The rehabilitated area is raked to remove rocks and then seeded with pasture grass as outlined in the rehabilitation section of the EIL report (Lundstrom Environmental Consultants Pty Ltd, 2016).

Contour bunds are constructed in each extraction stage during rehabilitation to attenuate surface water flows and prevent rill erosion.

Rehabilitation has commenced in the stages in which the product stockpiles have been removed as detailed in Section 3.

Revegetation

Screening vegetation was planted along a 500m strip along Maddern Road to the east of Stages 5 and 6. Plate 1 in Appendix 2 shows the growth of the plants to date. This area (approximately 0.4ha) forms a part of the total 2.7ha of native revegetation required as a condition of the Clearing Permit 6678.

The remainder of revegetation in accordance with CPS 6678 was undertaken in winter 2019.

Plates 2 and 3 in Appendix 2 show that this revegetation has a good strike rate and is

progressing well.

3 PREMISES OPERATION

The premises operation in December 2020 is shown on Figures 2a and 2b.

Extractive operations at the premises commenced in late December 2016 and are now complete aside from some reprocessing activities on Stages 1 and 2 and completion of rehabilitation commitments for all stages as detailed below.

Additional screening of remaining stockpiles in Stages 1 and 2 was nearing completion in December 2020 (see Plate 4 in Appendix 2). Preparation of these stages for rehabilitation is scheduled to commence in early 2021.

All product stockpiles have been removed from Stages 3 to 8. Earth has been smoothed on Stages 3,4, 7 and 8 and contour bunds are being constructed (see Plates 5 and 6 in Appendix 2).

Rehabilitation of Stages 5 and 6 is complete and these stages are now in maintenance and

management (see Plate 7 in Appendix 2). The performance of the rehabilitation will be assessed in winter 2021.

3.1 QUANTITIES OF RAW MATERIALS MINED

A total of 239,760 tonnes of gravel has been extracted from this site during this reporting period, which is within the approved premises production capacity. The extraction has been distributed as follows:

3.2 COMPLIANCE DOCUMENTATION

Compliance documentation has been submitted for each of the Stages 2 to 8 in accordance with the

conditions of Works Approval W5979/2016/1 prior to commencement of extraction in each of these

stages.

3.3 STORMWATER DETENTION BASINS

All stormwater detention basins in each stage have been constructed to capture 2 hours rainfall from

a 1 in 10-year Average Recurrence Interval rainfall event. Photographs of detention basins are shown

on the photographic plates (8 to 18) attached as Appendix 2. During a site inspection on 7

th

December

2020, it was observed that the detention basin in Stage 3 had burst and the overflow had created a

gully. This basin and the gully was repaired soon after using material from a nearby overburden

stockpile. There was no evidence of stormwater overflow from any of the other detention basins.

4 DUST MANAGEMENT

Measures implemented to reduce dust during extraction operations include:

Application of water using a 15kL water cart on unsealed roads and sprinklers on product stockpiles to reduce dust lift-off

Internal roads have been surfaced with gravel to minimise dust lift-off

Adherence to speed limits on unsealed roads to reduce dust lift-off

All loads are covered to reduce dust generation from product transport.

There has been no requirement to apply dust suppressants to the product stockpiles.

5 DUST MONITORING

Dust monitoring was not undertaken during the reporting period because there was no crushing on

site during this time. There is no requirement for dust monitoring when the crusher is not operating

at the site.

6 REPORTING

This Annual Environmental Report & Audit Compliance Report are required to be submitted by 10

th

January 2021.

Information that fulfils specific reporting conditions of the Licence including complaints management, noise verification reports and dust trigger exceedances are provided below.

6.1 COMPLIANTS MANAGEMENT

No known complaints have been received during the reporting period. The Environmental Health Officer at the Shire of Chittering was contacted via email and voicemail in November and December 2020 to check if there had been any complaints, but no reply was received. On this basis, it is assumed there have not been any complaints.

6.2 NOISE VERIFICATION REPORTS

A Noise Verification Report was undertaken by Lloyd George Acoustics in February 2019 at the commencement of Stage 4 operations (see Appendix 4 of 2019 AER report). The noise verification

was conducted under ‘worst case’ wind direction and speed conditions. The assessment found that

higher than predicted LA10 noise levels may occur at the closest sensitive receptor. It was suggested that this could be mitigated by 3m high stockpile mounds between the crushing plant and dozer working areas and the eastern residences. This was put in place during the crushing operations.

No further noise verification assessments were undertaken as it was difficult to distinguish noise associated with the operations from that occurring as a result of roadworks associated with the Northern Link construction, as well as finding a suitable time of worst-case scenario wind conditions.

6.3 DUST TRIGGER EXCEEDANCES

As discussed in Section 5 there was no requirement for dust monitoring at the site during the reporting period therefore there are no dust trigger exceedance events to report.

Catalano’s have a water cart on site which is employed to keep the unsealed roads and stockpiles

damp during dry, windy conditions.

Introduction

This Introduction is not part of the Licence conditions.

DER’s industry licensing role

The Department of Environment Regulation (DER) is a government department for the state of Western Australia in the portfolio of the Minister for Environment. DER’s purpose is to advise on and implement strategies for a healthy environment for the benefit of all current and future Western Australians.

DER has responsibilities under Part V of the Environmental Protection Act 1986 (the Act) for the licensing of prescribed premises. Through this process DER regulates to prevent, control and abate pollution and environmental harm to conserve and protect the environment. DER also monitors and audits compliance with works approvals and licence conditions, takes enforcement action as appropriate and develops and implements licensing and industry regulation policy.

Licence requirements

This Licence is issued under Part V of the Act. Conditions contained within the Licence relate to the prevention, reduction or control of emissions and discharges to the environment and to the monitoring and reporting of them.

Where other statutory instruments impose obligations on the Premises/Licensee the intention is not to replicate them in the licence conditions. You should therefore ensure that you are aware of all your statutory obligations under the Act and any other statutory instrument. Legislation can be accessed through the State Law Publisher website using the following link:

For your Premises relevant statutory instruments include but are not limited to obligations under the:

Environmental Protection (Unauthorised Discharges) Regulations 2004 – these Regulations make it an offence to discharge certain materials such as contaminated stormwater into the environment other than in the circumstances set out in the Regulations.

Environmental Protection (Controlled Waste) Regulations 2004 - these Regulations place obligations on you if you produce, accept, transport or dispose of controlled waste.

Environmental Protection (Noise) Regulations 1997 – these Regulations require noise emissions from the Premises to comply with the assigned noise levels set out in the Regulations.

You must comply with your licence. Non-compliance with your licence is an offence and strict penalties exist for those who do not comply.

Licence holders are also reminded of the requirements of section 53 of the Act which places restrictions on making certain changes to prescribed premises unless the changes are in accordance with a works approval, licence, closure notice or environmental protection notice.

Licence fees

If you have a licence that is issued for more than one year, you are required to pay an annual licence fee prior to the anniversary date of issue of your licence. Non payment of annual licence fees will result in your licence ceasing to have effect meaning that it will no longer be valid and you will need to apply for a new licence for your Premises.

Ministerial conditions

If your Premises has been assessed under Part IV of the Act you may have had conditions imposed by the Minister for Environment. You are required to comply with any conditions imposed by the Minister.

Premises description and Licence summary

An application for a new concurrent works approval and licence was received by the Department of Environment Regulation (DER) on 15 July 2016. The application is to conduct a gravel extraction operation at Lot 83 Great Northern Highway, Chittering.

The application proposes the use of a mobile crusher and screen with a design capacity of 6000 tonnes per day and a nominated throughput of 240,000 tonnes per year hence the premises is a prescribed premises for the purposes of Part V of the Environmental Protection Act 1986 (EP Act) in category 12.

Category 12 screening etc. of material is defined in the Environmental Protection Regulations 1987 as premises on which material extracted from the ground is screened, washed, crushed, ground, milled, sized or separated.

B. & J. Catalano Pty Ltd (the applicant) was established in 1962 as a transport and earth moving operation in the south-west of Western Australia and since then has expanded into the

Metropolitan and Midwest regions with over 300 employees. The applicant operates a number of basic raw material quarries and its customers include large corporations, local and state

government, mining companies, builders and contractors.

The application supporting documentation outlines that the proposal is to extract gravel within 8 operational stages with a total area of 40.2 hectares under an Extractive Industry Licence (EIL).

Planning approval and an EIL have been granted by the Shire of Chittering for the operation for a period of five years, expiring 30 June 2021. The proponent may apply for an extension of the EIL for two further periods of up to two years each, bringing the total potential lifetime of the operation to nine years. The area is zoned as ‘Agricultural Resource’ in terms of the Shire of Chittering Town Planning Scheme No. 6.

An application for a permit to clear native vegetation (CPS 6678/1) under the EP Act was received by DER in July 2015. The clearing permit was granted by DER in August 2016.

There is no history of prosecution or of any formal statutory compliance/enforcement notices issued under the EP Act by DER to B. & J. Catalano Pty Ltd.

The Lot 83 Great Northern Highway Gravel Quarry is located within the Shire of Chittering. The site is located approximately 5km south-west of the Chittering town site and approximately 11 kilometers (km) north-east of Muchea.

The proposed extraction area is located next to the Darling Scarp within the southern section of the Dandaragan Plateau. The property lies in the Swan-Avon Region. The surrounding land use includes farming, extractive industry operations, tree plantations and rural small holdings.

The application supporting documentation details that Lot 83 consists of cleared grazing land, areas of remnant native vegetation, remnant pine plantations, rehabilitated clay pits and associated detention ponds from the previous clay extraction operations undertaken by owner Austral Bricks (WA) Pty Ltd. Clay extraction was undertaken in the southern section of Lot 83 between 2003 and 2013 under previously approved EILs. There is no infrastructure on site associated with this previous operation.

There are several sensitive residential receptors located within 1000 metres (m) of the extraction stages. Map reference A depicts the sensitive receptor located within Lot 83. Licence conditions 1 General

1.1 Interpretation

1.1.1 In the Licence, definitions from the Environmental Protection Act 1986 apply unless the contrary intention appears.

1.1.2 For the purposes of this Licence, unless the contrary intention appears:

‘Act’ means the Environmental Protection Act 1986;

‘Annual Audit Compliance Report’ means a report in a format approved by the CEO as presented by the Licensee of specified by the CEO from time to time and published on the Department’s Website;

‘annual period’ means a 12 month period from 1 January to 31 December in the same year;

‘averaging period’ means the time over which a limit is measured or a monitoring result is obtained;

‘CEO’ means Chief Executive Officer of the Department of Environment Regulation;

‘Stage’ means stage 1 to 8 defined in the map of extraction stages in Schedule 1 maps.

1.1.3 Any reference to an Australian or other standard in the Licence means the relevant parts of the standard in force from time to time during the term of this Licence.

1.1.4 Any reference to a guideline or code of practice in the Licence means the version of that guideline or code of practice in force from time to time, and shall include any amendments or replacements to that guideline or code of practice made during the term of this Licence.

1.2 Premises operation

1.2.1 The Licensee shall ensure the limits specified in Table 1.2.1 are not exceeded.

1.2.2 The Licensee is authorised to operate stage 1.

1.2.4 The Licensee shall maintain all stormwater detention basins in each stage to capture 2 hours rainfall from a 1 in 10 year Average Recurrence Interval rainfall event.

1.2.5 The Licensee shall ensure that there is no stormwater overflow from each stage unless in the event of a greater than 1 in 10 year Average Recurrence Interval, 2-hour duration rainfall event.

2 Emissions

2.1 Fugitive emissions

2.1.1 The Licensee must undertake the fugitive dust management requirements in Table 2.1.1

3 Monitoring

3.1 General monitoring

3.1.1 The Licensee shall ensure that all monitoring equipment used on the Premises to comply with the conditions of this Licence is calibrated in accordance with the manufacturer’s specifications.

3.1.2 The Licensee shall, where the requirements for calibration cannot be practicably met, or a discrepancy exists in the interpretation of the requirements, bring these issues to the attention of the CEO accompanied with a report comprising details of any modifications to the methods.

3.2 Monitoring of fugitive emissions

3.2.1 The Licensee shall utilise dust management measures including, but not be limited to:

(a) continuous dust monitoring for operational management purposes for particulate matter 10 micrometres or less in diameter (PM10) between each operational stage and residences within 1000 m;

(b) dust monitoring stations to be located between operations and residences (depicted in the map of site and surrounds in Schedule 1 maps) as specified below:

o Between residence A and stages 1 to 8;

o Between residence S1 and stages 3, 4, 5, 6, 7, 8;

o Between residence S2 and stages 7 and 8;

o Between residence S3 and stage 6;

o Between residence S4 and stage 5; and o Between residence S5 and stage 8.

(c) automatic feedback (SMS text message or equivalent) to the quarry manager or supervisor if a trigger level of 0.5 mg/m3 of PM10 is reached over a one hour averaging period;

(d) meteorological monitoring to provide wind data to assist in determining the source of dust;

(e) the dust monitoring system is to be used at all times the quarry is in operation;

(f) in the event the trigger value is reached, and the dust is attributable to operations at the Premises, management measures (use of water cart, sprays or other appropriate methods) are to be promptly activated to control the dust to avoid further exceedance of the trigger value;

(g) the Licensee shall reduce the trigger level if necessary in response to verified complaints or other evidence of off-site impacts;

(h) the Licensee shall continuously improve site dust management through identification of dust sources and identifying and implementing improved dust controls; and (i) the Licensee shall keep a written log, signed by the responsible person, of dust

trigger exceedance events including identification of the sources of dust and action taken to control dust.

4 Information

4.1 Records

4.1.1 All information and records required by the Licence shall:

(a) be legible;

(b) if amended, be amended in such a way that the original and subsequent amendments remain legible or are capable of retrieval;

(c) except for records listed in 4.1.1(d) be retained for at least 6 years from the date the records were made or until the expiry of the Licence or any subsequent licence; and

(d) for those following records, be retained until the expiry of the Licence and any subsequent licence:

(i) off-site environmental effects; or

(ii) matters which affect the condition of the land or waters.

4.1.2 The Licensee must submit to the CEO within 90 days after the end of the Annual Period, an Annual Audit Compliance Report indicating the extent to which the Licensee has complied with the Conditions of this Licence for the Annual Period.

4.1.3 The Licensee shall implement a complaints management system that as a minimum records the number and details of complaints received concerning the environmental impact of the activities undertaken at the Premises and any action taken in response to the complaint.

4.2 Reporting

4.2.1 The Licensee shall submit to the CEO Noise Verification Reports (NVRs) at the commencement of the operation of stage 4 and stage 5. The reports shall contain verification of compliance with the Environmental (Noise) Regulations 1997 at the closest sensitive receptor to that stage depicted in the map of site and surrounds in Schedule 1 maps.

4.2.2 The NVRs are to be prepared by a person competent in environmental noise

assessments who has qualifications and experience that qualifies them for membership of the Australian Acoustical Society or the Association of Australian Acoustical Consultants.

4.2.3 The Licensee shall submit to the CEO an Annual Environmental Report within 90

calendar days after the end of the annual period. The report shall contain the information listed in Table 4.2.1 in the format or form specified in that table.

3 Executive summary of proposal and assessment

An application for a new concurrent works approval and licence was received by the Department of Environment Regulation (DER) on 15 July 2016. The application is to conduct a gravel extraction operation at Lot 83 Great Northern Highway, Chittering.

The application proposes the use of a mobile crusher and screen with a design capacity of 6000 tonnes per day and a nominated throughput of 240,000 tonnes per year hence the premises is a prescribed premises for the purposes of Part V of the Environmental Protection Act 1986 (EP Act) in category 12.

Category 12 screening etc. of material is defined in the Environmental Protection Regulations 1987 as premises on which material extracted from the ground is screened, washed, crushed, ground, milled, sized or separated.

B. & J. Catalano Pty Ltd (the applicant) was established in 1962 as a transport and earth moving operation in the south-west of Western Australia and since then has expanded into the Metropolitan and Midwest regions with over 300 employees. The applicant operates a number of basic raw material quarries and its customers include large corporations, local and state government, mining companies, builders and contractors.

The application supporting documentation outlines that the proposal is to extract gravel within 8 operational stages with a total area of 40.2 hectares under an Extractive Industry Licence (EIL).

Planning approval and an EIL have been granted by the Shire of Chittering for the operation for a period of five years, expiring 30 June 2021. The applicant may apply for an extension of the EIL for two further periods of up to two years each, bringing the total potential lifetime of the operation to nine years. The area is zoned as ‘Agricultural Resource’ in terms of the Shire of Chittering Town Planning Scheme No. 6.

An application for a permit to clear native vegetation (CPS 6678/1) under the EP Act was received by DER in July 2015. The clearing permit was granted by DER in August 2016.

There is no history of prosecution or of any formal statutory compliance/enforcement notices issued under the EP Act by DER to B. & J. Catalano Pty Ltd.

 The applicant is required to conduct periodic sampling and analysis to assess for the risk of acid sulphate soils.

 The applicant is required to retain stormwater on site and no discharge of pit-water shall occur without prior approval.

4 Decision table

All applications are assessed in line with the Environmental Protection Act 1986, the Environmental Protection Regulations 1987 and DER’s Operational Procedure on Assessing Emissions and Discharges from Prescribed Premises. Condition L1.2.1 sets premises production capacity limits. 240,000 tonnes is the Licence Holders maximum nominated annual throughput.

Compliance documentation for stage 1 was received by DER on 5 January 2017. This has been assessed as meeting the requirements of the conditions of works approval W5979/2016/1. A water management plan submitted as part of works approval application (W5979/2016/1) states that there will be no overflow from the extraction stages due to the construction of detention basins that have capacity to hold a 1 in 10 year, 2-hour duration Average Recurrence Interval (ARI) rainfall event. This has been taken to mean that there will be no overflow under normal rainfall conditions. The risk of the overflow from the detention basins has been assessed below.

Condition 1.2.3 sets the requirement that the Licensee is to operate stages 2, 3, 4, 5, 6, 7 and 8 once compliance documentation has been submitted in accordance with the conditions of the Licence.

Emission description

Emission: Overflow of stormwater beyond designated stormwater detention basins to land that drains towards the west towards Yalyal Brook. Yalyal Brook is a tributary of Ellen Brook. The overflow event could happen in a greater than 1 in 10 year, 2-hour ARI rainfall event.

Impact: Ellen Brook is subject of a water quality improvement plan to reduce nutrients and other contaminants entering the Swan River.

Controls: Yalyal Brook is located more than 2 km downstream from the extraction
