In such cases any vessel exceeding 5 knots seaward of the outermost buoys is deemed to comply with rule 91.6(1)(b) and the speed limit of 5 knots applies to all vessels inshore of the outermost buoys except vessels , which is in operation. in water skiing. Advisory Note 3.7(i) regarding areas reserved for a purpose allowing the speed limit of 5 knots to be exceeded within 200m of the shore: Due to the large intertidal areas experienced in this district and the low slope of many beaches , the outermost buoys must be placed more than 200 meters from the water's edge at high tide, or less than 200 meters at low tide.

3A ADDITIONAL REGIONAL NAVIGATION SAFETY RULES

The Council is not responsible for any damage or loss that may occur to any vessel using a mooring, whether authorized or not, including damage caused by:. a) any break or defect in the owner's moorings or any part thereof; or. b) the act of any person to cause damage to the owner's moorings or any part thereof, where the damage is caused by any vessel moored at such moorings, or by any perils of the sea, or by navigation of any vessel within the mooring. website, or any other cause. The costs incurred may be recovered from the owner, master or agent of the vessel as a debt due to the Board.

COMMERCIAL OPERATIONS

Any license issued by the Council must be available for inspection at all times by a harbormaster or an enforcement officer or guard of honor of the launch, or any prospective customer of the operation. a) The Council has the right to impose a fee on each new commercial operation application received and each license or license renewal issued by it. These rates are subject to annual review and are published as part of the Council's Annual Plan process.

In addition to complying with any requirements for operational plans under clause 5.1.8, any license holder shall, on request, provide audit certificates or other similar documents relating to any ISO quality assurance program or any certification under the Occupational Health and Safety (Adventure Activities) Regulations 2011. Any person or entity that incurs or is likely to incur charges under this bye-law must declare such activities to an authorized council officer as soon as possible; and upon oral or written request by an authorized Council officer, provide that officer with their full name and address and any other information reasonably requested to enable invoicing and recording in relation to those charges. A written receipt including the address of the Tasman District Council must be provided immediately if such payment is accepted.

It shall be a defense to any prosecution for a violation of these statutes if the defendant proves:. i) the act or event to which the prosecution or infringement relates was necessary for the purpose of saving or protecting life or health or preventing serious damage to property; and. ii) the defendant's conduct was reasonable in the circumstances; and. iii) the effects of the act or event were adequately mitigated by the defendant after it occurred. If a person is observed committing an offense of infringement (as set out in Maritime Law or Schedule 3, Trespassing Offenses and Penalties in these Regulations) by a Harbor Master, an Enforcement Officer or a Constable; or the officer has reasonable grounds to believe that such an offense has been committed by that person; an infringement notice relating to that particular offense may be served on that person. If a person is observed committing an offense by the Harbor Master, an enforcement officer, a constable or an honorary enforcer; or the officer has reasonable grounds to believe that such an offense has been committed by that person; a warning may be issued for this offence.

If any goods are landed or deposited or left on a wharf or warehouse without the permission of an authorized officer of the Council, the Council may remove the goods from the wharves and the consignor or consignee shall pay all costs of moving or removing the goods. If the consignor or consignee fails to move or re-stack said goods in accordance with instructions, the Council may cause such goods to be moved and/or re-stacked. Such bills of lading, bills of lading or manifests and other documents or accounts shall contain full and true particulars of the weight and dimensions of such cargo, shall be duly certified as correct and in a form acceptable to the Council.

In the event of default in payment of any debts owed in respect of such goods, the Council may sell such goods and retain sufficient proceeds from such sale to cover the outstanding debt and all reasonable expenses in connection with the administration of the sale. Upon notification to the owners, consignors or consignees of any goods, or to the master, owner or agent of the vessel discharging or receiving the same, that room is not available for the proper storage of such goods within the warehouse, the Council shall not be liable for any loss or damage which may be caused to the goods, by the elements or otherwise, while they are at the wharf. The Council shall not be liable for loss or damage to goods in storage, by fire, fire-fighting water, vermin, earthquakes, theft, robbery or other similar causes, unless due to the Council's negligence.

Torrent Bay Lagoon This 3-knot area within a 100m arc of the center point of the outer end of the public jetty always counts. Note: The site-specific provisions in these bylaws relating to the waters of Nelson Lakes National Park only apply if permitted by the version of the Nelson Lakes National Park Management Plan (administered by the Department of Conservation) in effect at any given time . b) Areas reserved for swimming and other passive activities.

The speed limit is only lifted from the confluence of the Lee River to the sea when the flow at Wairoa at Irvines exceeds 20 cumecs. a).

The speed limit has been raised for all waters (including tributaries) downstream from the confluence of the Mangles, up to the district boundary. Cobb Reservoir All vessels and persons other than those authorized by the dam operators for maintenance or monitoring purposes are prohibited (for all purposes including (but not limited to) sailing, mooring, swimming, walking and diving) on closer to the dam than the line formed between a pair of white posts with black stripes on each bank (approximately 200 m from the face of the dam), unless authorized in writing by the Harbourmaster. Note: The 200 m line from the beach at Kerr Bay is marked by orange triangles on either side of the bay.

Note: Only the main tributaries are shown, however the speed limit is raised at all times in the main branch of the Buller River and all tributaries (including their tributaries) from the Murchison downstream to the district boundary.
