REPORT TITLE:

Circuses - Jack Evans Boatharbour SUMMARY OF REPORT:

The Reserves Trust has received 2 requests to conduct circuses at the former Border Caravan Park site in Jack Evans Boatharbour. To streamline the approval process for such requests, it is recommended the trust delegate authority for the issuing of temporary licences under Section 108 of the Crown Lands Act 1989 to the Reserves Trust Executive Manager.

RECOMMENDATION:

That the Trust:-

1. Issues a temporary licence under the provisions of Section 108 of the Crown Lands Act, 1989 to Circus Sunrise to occupy the former Border Caravan Park site in Jack Evans Boatharbour to conduct a circus from 10 April 2000 to 30 April 2000. The issuing of a licence will be subject to Development Consent being obtained subject to payment of the fees detailed in this report.

2. Issues a temporary licence under the provisions of Section 108 of the Crown Lands Act, 1989 to Ashton’s Circus to occupy the former Border Caravan Park site in Jack Evans Boatharbour to conduct a circus from 12 June 2000 to 25 June 2000. The issuing of a licence will be subject to Development Consent being obtained subject to payment of the fees detailed in this report.

3. Delegates authority to the Executive Manager of the Reserves Trust to issue temporary licences under the provisions of Section 108 of the Crown Lands Act, 1989 for circuses at the former Border Caravan Park site in Jack Evans Boatharbour.

REPORT:

The Trust has received two request to hold circuses at the former Border Caravan Park site in Jack Evans Boatharbour.

Circus Sunrise wish to use the site from the 10April to 30 April 2000 performing 13 to 20 April with a minimum of 5 days per week showing.

The Ashton’s Circus wish to utilise the site from June 12th to June 25th 2000.

Under the provisions of Section 108 of the Crown Lands Act, 1989 a reserve trust may, in respect of the whole or any part of a reserve, grant temporary licences for grazing or any other prescribed purpose. Clause 32 of the Crown Land Regulation 1995 lists those prescribed purposes including: “Camping using a tent, caravan or otherwise; Entertainments; Shows”.

The Trust consented to the utilisation of this areas for previous circuses receiving no complaints whilst providing an additional attraction to Tweed Heads.

Council fees and charges for a circus, rodeo or variety show are:- tent erection $33.00

rent first night $113.00 each additional night $64.00 deposit $73.00

It is proposed that these charges apply to the above requests.

To streamline the approval process for such request, it is possible for the Trust to delegate authority for the issuing of temporary licences to the Reserves Trust Executive Manager.

There is it recommended the Trust:

1. REPORT TITLE:

Call for Expressions of Interest to Operate Markets - Kingscliff, Pottsville, Knox Park- Murwillumbah and Recreation Reserve-Tweed Heads

SUMMARY OF REPORT:

The current approvals to conduct the markets at Kingscliff, Tweed Heads Recreation Ground, Knox Park Murwillumbah and Pottsville expire on 30 June 2000.

On the previous occasion that Council and the Reserves Trust consented to extending these approvals Council resolved that the existing operators also be advised that prior to issuing any subsequent approvals Council will call for expressions of interest from the community.

The markets have not been the subject of any major incidents or complaints to Council or the Trust. They benefit the community, encourage visitors and tourists and provide income to stall holders and participants.

Therefore it is considered appropriate that the Trust continue to consent to operation of the markets.

Given the impending expiry date it is appropriate that expressions of interest now be sought to allow the approval process to proceed.

Should the Reserves Trust consent to calling for expressions of interest to operate markets a separate report will be put to Council.

RECOMMENDATION:

That Reserves Trust consents to the calling of expressions of interest from persons wishing to operate the Kingscliff, Tweed Heads-Recreation Ground, Knox Park-Murwillumbah and Pottsville markets from 1 July 2000 for a three (3) year period.

REPORT:

The current approvals to conduct the markets at Kingscliff, Tweed Heads Recreation Ground, Knox Park Murwillumbah and Pottsville expire on 30 June 2000.

On the previous occasion these approvals were extended Council and the Trust resolved that the existing operators also be advised that prior to issuing any subsequent approvals Council will call for expressions of interest from the community.

Given the impending expiry date of June 2000 it is appropriate that expressions of interest now be called.

Traditionally, approvals were granted for a 3 year period. However in more recent times Council has issued approvals for the lesser period of 12 months.

The markets have not been the subject of any major incidents or complaints to Council or the Trust. They benefit the community, encourage visitors and tourists and provide income to stall holders and participants.

Therefore it is considered appropriate that the Trust continue to consent to operation of the markets.

It is likely that the existing market managers of the Kingscliff, Pottsville, Knox Park Murwillumbah and Tweed Heads Recreation Ground Markets will seek to have their existing approvals to operate the markets extended.

However, it is appropriate that Council seek through public expressions of interest the most appropriate person or group to manage the markets, rather than simply continuing to renew approvals with the existing managers. It may well be that following this process the existing managers are the successful applicants.

This type of competitive process may result in improvements in terms of payments to Council for use of the respective area for markets, and also achieving the best possible management practices are in place.

The existing managers pay to Council 15% of total income from stall fees. In calling for expressions of interest a successful applicant may be willing to pay to Council a higher percentage.

The criteria on which expressions of interest are likely to be assessed are:

• Suitable experience in market operations or management

• Demonstrated business operation skills

• Willingness to comply with Council policies

• Financial return to Council

• Possible benefits to community based organisations

CONCLUSION

It is appropriate that Council call for expressions of interest to operate the markets prior to making a determination about approvals. This will permit the most advantageous submission and resulting improvements to be identified. The outcome of this process will be reported to Council and the Reserves Trust.
