34;Actual owner"-A person who, apart from being defined in this Act as such, would, in law, be the owner of the shares or other things in question;. Act: The term includes any person who performs the duties of Chief Inspector; . 34; Declared Area"- Any part of the State in respect of which there is a notification under this Act notifying that that part is a declared area of the specified category in respect of any disease;.
34;Infected area"-Any part of the country in respect of which there is-. a) a notice by which the Minister has notified the part which is an infected area;. 2A) Every member of the police is ex officio an honorary inspector under this Act and has and exercises powers, functions and duties of Honorary Inspector The Governor in Council may from time to time by order in council— (i) constitute any part of the State as a district for the purposes of (ii) alter the boundaries of any district, (iii) abolish any such district.
A certificate referred to in this subsection is void unless it is produced to the inspector within 14 days of its completion. No stock shall be imported from an adjacent State or territory of the Commonwealth at any transit point, except at a transit point designated from time to time by the Governor in Council by Order in Council. 3c) No stock shall be imported by vessels from another State or Territory of the Commonwealth, except at a point of entry or port of entry designated from time to time by the Governor in Council by order.
No compensation under this Act shall be payable to an owner in respect of the destruction of an animal pathogen by order, in accordance with this Act, of the Minister or his delegate or of an inspector or a Government veterinary officer. Where a permit issued under this subsection is subject to conditions contained therein or signed thereto, the owner of the stock for which such permit is issued shall cause the conditions to be complied with in all respects. Any such request shall be made in writing and shall contain full details of the reasons therefor.
If an owner receives compensation under this section, he is not entitled to receive compensation for storage under section 15 of the Act. (2) (a) Subject to the provisions of paragraph (a) of subsection four of this section, the Chief Inspector may from time to time other grant and renew and authorize the grant and transfer of boarding kennel licenses under this Act of the following kinds:-. ii). No one may at any time use premises as a boarding kennel, unless he is then the holder of a valid boarding kennel license or boarding kennel (veterinary) license in accordance with this Act granted for the premises in question.
If the Governor in Council considers it necessary or desirable, he may by regulation define for the purposes of this section the meaning of the term "treatment". A person may not, without the written consent of the Minister, establish or maintain a laboratory. It is irrelevant that the act was committed without authorization or contrary to the instructions of the director or employer.
The regulations may provide that the approval of the Chief Inspector is the standard applicable to a particular matter.
SCHEDULE II
Prescribing standards for and regulating the construction, maintenance, operation and registration of cattle watering facilities, spraying facilities and equipment and other places used or to be used for the processing of livestock; prescribing fees to be charged in connection with the use of any such facilities or to be charged in connection with the handling of stock by an inspector; prescribing and regulating the sampling and testing of fluids used in such dives, installations, equipment and other places; Prohibiting or regulating the storage of food waste or other material or matter in facilities generally or in prescribed areas throughout the country or in any part of the country. Prescribing and regulating the registration and control of pigs generally or prescribed pigs throughout the country or in any part of the country and prohibiting or regulating the movement of pigs for the purpose of slaughter from pigs registered under this AOT.
Prescribing the method of determining the value of destroyed stocks under this Act. Prescribing forms for returns, notices, bills of payment and any documents or writings under this Act and providing for the verification of any of them by statutory declaration.
