Driving while disqualified or suspended has been a motoring offense in Victoria for almost a century and carries one of the harshest penalties in the Road Safety Act 1986 (Vic). The effect of the penalty section and sub-s 2 is that a person charged with a second or subsequent offense of driving while disqualified or suspended must receive a prison sentence of at least one month. II LEGISLATIVE HISTORY OF s 30 OF THE ROAD SAFETY ACT 1986(VIC) This section provides an overview of the main legislative reforms to the offense of driving while disqualified or suspended provided for in s 30 of the Road Safety Act 1986 (Vic).

Surprisingly, the second reading speech and subsequent debates make no mention at all of the amending provision. 52 Schedule 1 of the Road Safety Act 1986 (Vic) lists the minimum disqualification periods for driving under the influence. 53 Schedule 5 of the Road Safety Act 1986 (Vic) lists the minimum suspension periods for excessive speed.

Whether the license is suspended or disqualified and the length of the suspension or disqualification will be determined by the relevant statutory provision. S 24 notices: Under s 24 of the Road Safety Act 1986 (Vic), the Roads Corporation has the power to suspend, in a wide range of circumstances, a license or permit at any time it thinks fit.64. 6 The defendant's awareness of the license interference Due to the processes by which a driver's license can be suspended or disqualified, it is entirely possible that a person appearing in court for a second offense of driving while disqualified or suspended may not have previously been in court for it. crime.

It is also possible for a driver's license to be suspended or denied by a court in the absence of the suspect. In Victoria, an adult defendant sentenced to a term of imprisonment for driving while disqualified or suspended may serve that term in one of the following ways.

Both Watson's findings and the statistics above suggest that the deterrent function of the sentencing provision in s 30 is questionable. To sentence an accused to a term of imprisonment in circumstances where that person was not sufficiently aware of the consequences of driving while disqualified or suspended is abhorrently unfair.

In a recent sentencing review carried out for the Victorian government, Freiberg indicated that the law relating to s 30 of the Road Safety Act 1986 (Vic) would need to be reviewed if other proposed changes to the Sentencing Act 1991 were to be adopted ( Vic).158 Then what are the possible alternatives. Some legitimacy would be returned to the mandatory sentencing provision in s 30, as the defendant would be informed by the court of the consequences of driving while disqualified or suspended. Knowledge of current penalties for driving while disqualified or suspended among drivers is also lacking.

A comparison with other offenses contained in the Road Safety Act 1986 (Vic) has revealed that the offense in s 30 is less serious but carries one of the harshest penalties.
