SUMMARY OF REPORT:
Tweed Shire Council proposes to construct additional car parking and bollards within Carlin Reserve, also known as Point Danger Park, Tweed Heads. The land on which the works are proposed is described as Lot 7061 DP 1068882 which forms part of the Tweed Heads Reserve R57974.
The proposed works are required to facilitate additional car parking at Point Danger and to prevent illegal car parking on the public reserve area. It has been reported that vehicles are currently driving over the kerb and across the public reserve to use the site as a car park, particularly during major events in the area. The proposed works would provide additional formalised car parking along the road at Point Danger and associated bollards to prevent further illegal car parking on the site.
The proposed works are scheduled to commence in June 2016 and would extend for a duration of approximately three weeks. These works would be undertaken by contractors (to be appointed) on behalf of Council.
As the subject site is managed by the Tweed Reserves Trust, the proposed works necessitate an approval from the Trust for a licence to undertake the works at the site.
It is therefore recommended that the Tweed Reserves Trust provide approval to issue a licence for temporary access onto Lot 7061 DP 1068882 to undertake the proposed works.
RECOMMENDATION:
That the Tweed Reserves Trust approve issuing a licence for temporary access onto Lot 7061 DP 1068882 as manager of the land to undertake the proposed works within Carlin Reserve.

The proposed works have been assessed as Exempt Development under Schedule 1 (car parks) of the State Environmental Planning Policy (Infrastructure) 2007 (SEPP Infrastructure). Under the SEPP Infrastructure development for a purpose specified in Schedule 1 is exempt development if it is carried out by or on behalf of a public authority and meets the development standards specified in Schedule 1. The development standards for a car park under Schedule 1 require that the car park must be open (unenclosed).

As Lot 7061 DP 1068882 is identified as being managed by the Tweed Reserves Trust, the proposed works necessitate an approval from the Trust for a licence to undertake the works at the site.
It is therefore recommended that the Tweed Reserves Trust provide approval to issue a licence for temporary access onto Lot 7061 DP 1068882 to undertake the proposed works.
OPTIONS:
The options for consideration of the Tweed Reserves Trust are:
1. Provide approval as the manager and operator of Lot 7061 DP 1068882 for issuing a licence for temporary access to the site to undertake the proposed works.
2. Request additional information.
3. Refuse Tweed Shire Council’s request to provide endorsement of the works.
CONCLUSION:
This report provides an outline of a proposed project by Tweed Shire Council requesting an approval as the manager of Lot 7061 DP 1068882 to issue a licence for temporary access to the site to undertake the proposed works.

The proposed works are in response to complaints from the community regarding parking at the site, particularly during major events in the area. Council has responded to each complainant advising them of the proposal. Additionally, Council has consulted with the RSL regarding the proposal and have received their endorsement.
