The sum obtained at the rate so stated shall be paid by the Commissioner to the Council, and shall be expended by the Council in and after the destruction of the vermin on the said lands. Said statement must be certified as correct by the council's chairman and clerk.
PART III
Where possible, the other members of the committee are taxpayers or persons resident in the district who are representatives of taxpayers in the district:. The governor can also appoint one of the members as the president of the council. The other board members and auditors shall hold office until the first annual election after the establishment of the district:.
Every male District Collector of the Board who has attained the age of eighteen years:. Any officer of or a shareholder in a company that is a ratepayer of the District Board. Notwithstanding a vacancy in the office of a member of a Board, the business of the Board shall be conducted by the member or members currently in office, who shall have all the powers of the Board.
No: a resolution adopted at a meeting of the Board of Directors is a withdrawal or. withdrawn or amended at a subsequent meeting, except in accordance with the following provisions:~~!~~~8~f. Where such rate is levied by necessity, an order under the hand of the Commissioner shall be sufficient power to seize: The Commissioner shall, on receipt of the proceeds of any rate or rates as hereinabove mentioned, pay the same in favor of the Board of the Bank designated by the Board:.
Where any such rate is levied on account of hardship, a warrant issued by the President and under the seal of the Board shall be sufficient authority for seizure.
PART IV
Amounts so paid may be paid at the rates set forth in subsection (4) of this Agreement. The rate so calculated shall be paid by the owner or occupier in respect of his land, or by the owner or occupier of the land for the time being, and shall be recoverable in accordance with the Commissioner or any person so authorized by him. proceedings in any court of competent jurisdiction or by summary proceedings. In any case where the lands are not a vermin-fenced area not only by reason of the erection of a fence under this section, but by reason of said fence and pre-existing vermin fences or dog-proof fences, the fences of any vermin-fenced district or districts, or fence off the property, in whole or in part, of any owners or occupiers (each of whom is hereinafter referred to as a "private owner"), said lands are fenced areas with vermin, then the owners or users referred to in subsection (2) of this article shall, in addition, to bear the costs of this subsection, to pay to the board of each such district and to each such private owner one-half the value at the time of erecting a fence in accordance with this section of such portion of the vermin fence or dog fence of such district or such private.
For the purposes of this section, the Director of Lands is deemed to be the occupier of Crown land. In every case where a fence is erected in terms of section 154 of this Act, section 156 of the Vermin Act, 1914, or section 159 of the Vermin Act, 1905, the Governor may, on the recommendation of the Commissioner, declare the grounds by proclamation. indicated on the plan (in relation to the said fence) under subsection (1) of the said section 154 or of the said section 156 or of the said section 159 (as the case may be), as the lands which will be benefited by the said fence, to to be a vermin-fenced district for the purposes of this Act. 2) The power conferred by subsection (1) hereof may be exercised without any petition and notwithstanding that the provisions of section 45 have not been complied with in the particular case: Provided that-. a) the proclamation shall assign a name to the District constituted thereby and shall define its boundaries; and (b) subsection (4) of said section 45 applies.
PART V
CI Special Area" means the land for the benefit of which a loan is desired or intended to be applied or which is described in the order of the Bank for the granting of a loan. Any application shall be left to the clerk of the Preliminary Council. The Council may make by-laws in accordance with dispositions of land occupiers in a given area;
All loans granted to the Council under this Act shall be spent by the Council in accordance with the Bank's requirements. Power of Commissioner to withhold installments of loan from members of committee. Lands belonging to different debtors may be included in one petition for sale and the court may make such orders as to the apportionment of costs and expenses and attending to the sale of the said lands or any part thereof as shall be deemed just.
For the purposes of this section-. (a) Land shall be deemed to be enclosed when at least three-quarters of the total length of its boundaries are enclosed by vermin, dog or rabbit fencing. If the resident to whom the notice of termination has been given has failed to -. i.) define the boundary line using pins; or (ii.) have the boundary line defined by a.
PART VI
It shall be sufficient in any notice required under this Act Suffioienoy of notice. if the notice clearly and reasonably states the purpose of Leof. Subject to section 213, the following provisions apply to any notice or demand under this Act to be given or made to the owner or occupier of any land. Any such notice or demand shall be deemed to have been duly served if the same has been served. a) given to the owner or occupier personally;.
In the case of the Crown, all Notices must be sent by post to the National Director. Where there is more than one owner" or occupier of the same land, service upon any of them in the manner aforesaid shall be deemed to be service upon all. Any order, summons, notice or other such document to be confirmed. by a board must be sufficient by the board.
Power to suspend certain repayments. of the Vermin Act, 1914, or to a lessee of land under Division IV. of said Part VI.; and. b) at least fourteen annual installments in connection with the said loan are due for payment after the sixteenth day of October, nineteen hundred and thirty. 34; Tenant" means a tenant to whom an advance has been made under section 202 of the Vermin Act, 1914, or under the corresponding provision of any Act so repealed: .. 34;Loan" includes an amount spent or a amount advanced under Part IV. or section 202 of the Vermin Act, 1914, or under the provisions corresponding thereto, respectively in any Act so repealed, as well as a loan to a District CQuncil) Vermin Board or Vermin Trust.
