TECHNICAL DIRECTIVES FOR THE DETERMINATION OF GROWTH QUOTAS (KPt) OF TEXTILES AND CLOTHING (tpt) FOR APPROVED EXPORTERS OF TEXTILE AND CLOTHING OF SMALL-SCALE BUSINESSES AND COOPERATIVES (ETTPT-PKK) IN THE QUOTA YEAR OF 1999 AND PROCEDURES FOR PARTNERSHIP IN THE EXPORT QUOTAS OF TPT BY ETTPT-PKK (Decision of the Director General of International Trade No. 18/DJ-PLN/III/1999 dated March 19, 1999)

THE DIRECTOR GENERAL OF INTERNATIONAL TRADE, Considering :

a. that in connection with the issuance of the Minister of Industry and Trade No. 84/MPP/Kep/3/1999, it is necessary to stipulate its technical directives;

b. that it is therefore necessary to stipulate a decision of the Director General of International Trade. In view of:

1. Decree of the Minister of Industry and Trade No.374/MPP/Kep/8/1998 concerning the provisions on the export of textile and clothing;

2. Decree of the Minister of Industry and Trade No. 84/MPP/Kep/3/1999 on the determination of growth quotas (KPt) for the export of textiles and clothing to the United States, European Community, Norway, Canada and Turkey for the quota year of 1999 as well as partnership in the export of textile and clothing;

3. Decision of the Director General of International Trade No. 11/DJ-PLN/Kep/XI/1998 on procedural directives for the application and quotas allocation of the export of textile and clothing.

DECIDES: To stipulate:

THE DECISION OF THE DIRECTOR GENERAL OF INTERNATIONAL TRADE ON TECHNICAL DIRECTIVES FOR THE DETERMINATION OF GROWTH QUOTAS (KPt) OF TEXTILE AND CLOTHING (TPT) FOR APPROVED EXPORTERS OF TEXTILE AND CLOTHING OF SMALL-SCALE BUSINESSES AND COOPERATIVES (ETTPT-PKK) IN THE QUOTA YEAR OF 1999 AND PROCEDURES FOR PARTNERSHIP IN THE EXPORT QUOTAS OF TPT BY ETTPT-PKK.

Article 1

(1) Referred to as Approved Exporters of Textile and Clothing of Small-scale Businesses and Cooperatives (ETTPT-PKK) shall be ETTPT which have production units of Textile and Clothing (TPT) and are in the form statutory bodies including small-scale cooperatives.

(2) Criteria of ETTPT-PKK for obtaining the Growth Quotas (KPt) as meant in paragraph (1) shall be as contained in Technical Directives No. 1 attached to this decision.

Article 2

In the framework of the fostering and development of ETTPT-PKK, Fixed Quotas (KT) for ETTPT-PKK originating in Growth Quotas (KPt) with the maximum quantity of 6% of base-level quotas shall be determined.

Article 3

The realization of quota allocations for ETTPT-PKK whose name have “star marks” as stipulate in the Attachment to the Decree of the Minister of Industry and Trade No. 84/MPP/Kep/3/1999 shall postponed.

Article 4

(1) ETTPT-PKK whose allocations have “star marks” and which already settle administrative and other requirements in which their documents are in accordance their physical conditions (production units) shall promptly report to the Team for the Assessment of Feasibility of Small-scale Businesses and Cooperatives of review.

(2) If the revaluation result of the Team for the Assessment of Feasibility of Small-scale Businesses and Cooperatives state that the documents are not the same as/in accordance with their physic (production units), the Directorate General of International Trade shall promptly abolish “star mark” (liquidate so that the quotas can be realized immediately by the relevant ETTPT-PKK.

(3) If the revaluation result of the Team for the Assessment of Feasibility of Small-scale Businesses and Cooperatives state that the documents are not the same as/in accordance with their physical conditions (production units), quota allocation having “star marks” shall be nullified and be distributed pro rata to ETTPT-PKK as Flexibility Quotas (KF) for May 1999.

(2) ETTPT-PKK receiving Quotas which originate in both Fixed Quotas (KT), Growth Quotas (KPt), Purely Provisional Quotas (KSM), Remainder Purely Provisional Quotas (KSMS), Special Shift Quotas (KSS), Flexibility Quotas (KP) and Carry-forward Quotas (KP) and failing to realize their export themselves shall be obliged to promote partnership with other ETTPT-PKK realizing their exports themselves by observing principles of mutual need, mutual strengthening and mutual benefit. (3) In the realization of every opening or registration of Export declaration (PEB), negotiation of L/C or

contracts at foreign exchange banks, loading approval by Custom and Excises Offices as well as restitution at Bapeksta, exporters shall be obliged to enclose partnership documents in the export declaration specifying names of exporters of PKK QQ PMB (medium-and large-scale company) group.

Article 6

This decision shall come into force as from the date of stipulation. Stipulated in Jakarta

OBTAINING GROWTH QUOTAS OF TEXTILE AND CLOTHING

This technical directives constitute the implementation of Articles 3 of the decree of the Minister of Industry and Trade No. 84/MPP/Kep/3/1999.

1. criteria of ETTPT-PKK are as follows : a) possesing production units;

b) belonging to Indonesian citizens;

c) the total assets of companies are not surpassing RP 600,000,000 (six hundred million rupiahs), excluding land and building for business places;

d) being independent, not subsidiaries or branches of companies owned, controlled or affiliated both directly and indirectly to medium and large-scale businesses;

e) being businesses in the form of statutory bodies including cooperatives.

2. Based on every application for the allocation of KPt, the Team for the Assessment of Feasibility of Small-scale Businesses and Cooperatives conduct administrative selection and field evaluation of applicants for the granting of KPt in 1999 which are determined on the basis of the Decree of the Minister of Industry and Trade No. 523/MPP/Kpp/11/1998.

The Administrative and field evaluations are aimed at obtaining the truth of data contained in licensing documents of applicant ETTPT with filed conditions, among other including:

a. Administration

1) data on companies (company profile);

2) deeds of establishment of companies or cooperatives;

3) business licences of small-scale industries or corporate registry numbers; 4) decisions on recognition of ETTPT

5) documents required by other provisions. b. Field evaluation

1) to evaluate the truth of addresses of factories;

2) to evaluate the existence of production units in the said addresses; 3) to evaluate the number of workers;

OF ETTPT-PKK

This technical directive constitutes the implementation of Article 2 of the Decree of the Minister of Industry and Trade No. 84/MPP/Kep/3/1999.

That in the framework of the fostering and development, fixed quotas originating in KPt with the maximum quantity of 6% of base-level quotas are allocated to ETTPT-PKK with the following stipulations:

a. The validity period of KPt allocated to ETTPT-PKK fulfilling the requirements is from January to December 31 of the current quota year.

b. ETTPT transferring part of categories in the previous quota year are only entitled to obtain categories not transferred.

c. ETTPT transferring all categories (five categories) of KPt in the previous quota year are not entitled to obtain KPt forever.

ETTPT-PKK

This technical directive constitutes the implementation of Article 3 of the Decree of the Minister of Industry and Trade No. 84/mpp/Kep/3/1999.

Paragraph (1) The quota quantity for ETTPT-PKK originating in KPt are at the maximum of 6% of the base-level quotas including for ETTPT-PKK in Bali as high as 20% (twenty percent) of the growth quotas total in 6%.

The quantity of quotas allocation is calculated in pro rata by the following formula : Total KPt available

Number of applicants of KPt fulfilling requirements

• Total KPt available is the total of growth quotas for the respective categories in quota countries with the maximum quantity 0f 6% of base-level quotas.

• Number of applicants of KPt is the number of ETTPT-PKK already fulfilling the requirements and provisions in force.

If the calculation result shows that the total of KPt for certain does not deserve export (at the minimum of 50 dozens to USA and at the minimum of 2,400 pcs or 20 dozens to EC, Canada, Turkey and Norway. Paragraph (2) Names of ETTPT obtaining approval of ETTPT-PKK for the quota year of 1999.

Paragraph (3) The realization of KPt for ETTPT-PKK whose names have “star marks” is postponed. The postponement is enforce, to ETTPT-PKK possesing production units but whose factories change in addresses without reporting or changing/adjusting to their licensing documents.

Paragraph (4) ETTPT whose allocations have “star marks” and which already adjust administrative and other requirements in force for ETTPT-PKK in which their documents are in accordance with their physical conditions (production units) promptly report to the Team for the Assessment of Feasibility of Small-scale Businesses and Cooperatives for revaluation (from SP-CPKt).

In the case of the revaluation result of the Team for the Assessment of Feasibility of Small-scale Businesses and Cooperatives stating that the documents are already in accordance with physical conditions (production units), the Directorate General of International Trade abolishes (liquidates) “star marks” so that quotas can be promptly realized by the relevant ETTPT-PKK.

In the case of the revaluation result of the Team for Assessment of Feasibility of Small-scale Businesses and Cooperatives stating that the documents are not the same/in accordance with physical conditions (production units), quota allocations having “star marks” (liquidate) is nullified and to be distributed pro to ETTPT-PKK as KF in May 1999.

TO REALIZE INDIVIDUALLY EXPORT QUOTAS OWNED

In the framework of developing and increasing the capacity of small-scale businesses and cooperatives to become self-reliant ETTPT in exporting TPT, the following regulations are stipulated :

1. ETTPT-PKK receiving KPt realize themselves quotas obtained/owned and KPt can not be transferred to other parties for more than 2 (two) categories per quota country.

2. ETTPT-PKK receiving quotas which originate in KT, KPt, KSM-S, KSS, KF and KP and failing to realize export themselves, the relevant ETTPT-PKK are obliged to promote partnership with other ETTPT-PKK realizing their export themselves by observing principles of mutual need, mutual strengthening and mutual benefit.

3. In the realization of every opening or registration of the Export Declaration (PEB), negotiation of L/C or contracts At foreign exchange banks, loading approval by Customs and Excise Offices as well as restitution at Bapeksta, exporters are obliged to enclose partnership documents in export declaration containing names of exporters of PKK QQ PMB (medium-and large-scale companies).
