THE STIPULATION OF GROWTH QUOTAS (KPt) OF TEXTILE AND CLOTHING IN THE QUOTA YEAR OF 2000 FOR DESTINATION COUNTRIES OF
THE UNITED STATES, EUROPEAN UNION, NORWAY, CANANDA AND TURKEY AS WELL AS PARTNERSHIP IN THE EXPORT OF TEXTILE AND CLOTHING (TPT)

THE MINISTRY OF INDUSTRY AND TRADE,
Considering:
That with the export of textile and clothing (TPT) to destination countries of the United States, the European Union, Norway, Canada and Turkey starting in the quota year of 2000, it is necessary to stipulate the allocation of fixed quotas of TPT to Approved Exporters of Textile and Clothing of the group of Small-scale businesses and cooperatives (ETTPT-PKK) derived from Growth Quotas (KPt) to the respective ETTPT (approved exporters of textile and clothing) already fulfiling the relevant requirements.
In view of:
1. Law No. 1/1995 on small-scale businesses;
2. Decree of the Minister of Industry and Trade No. 374/MPP/Kep/8/1998 concerning provisions on the export of textile and clothing as already amended by the Decree of the Minister of Industry and Trade No. 366/MPP/Kep/6/1999;
3. Decree of the Minister of Industry and Trade No. 559/MPP/Kep/10/1999 on criteria for small-scale businesses and cooperatives to obtain growth quotas in 2000;
4. Decree of the Minister of Industry and Trade No. 560/MPP/Kep/10/1999 on the team for assessment of feasibility of small-scale businesses and cooperatives to obtain growth quotas in 2000.

THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE ON THE STIPULATION OF GROWTH QUOTAS (KPt) OF TEXTILE AND CLOTHING IN THE QUOTA YEAR OF 2000 FOR DESTINATION COUNTRIES OF THE UNITED STATES, EUROPEAN UNION, NORWAY, CANANDA AND TURKEY AS WELL AS PARTNERSHIP IN THE EXPORT OF TEXTILE AND CLOTHING (TPT)
Article 1
Referred to as Approved Exporters of Textile and Clothing of the Group of Small-scale Businesses and Cooperatives (ETTPT-PKK) shall be approved exporters of textile and clothing (ETTPT-PKK) which have production units in the form of small-scale statutory bodies/cooperatives according to the Small-scale Businesses Law No. 9/1995 Chapter 3 Article 3 and Chapter 5 Article 20 on the fostering and development in the field of small-scale businesses already fulfilling requirements in accordance with results of evaluation of the Team for Assessment of Feasibility of Small-scale Businesses and Cooperatives to obtain growth quotas in 2000.

(1) Growth Quotas (KPt) shall be allocated on a prorata basis to ETTPT-PKK fulfilling the said requirements in accordance with the following provision :

(2) ETTPT-PKK obtaining the growth quotas in 2000 shall be as contained in the Attachment to this decree. (3) The growth quotas as meant in paragraph (2) shall be effective from the date of stipulation up to December
31, 2000.
Article 4
(1) In the framework of the fostering of ETTPT-PKK, the growth quotas obtained shall be realized by themselves by exporting textile and clothing according to categories of quotas obtained/owned and can not be transferred to other ETTPT.
(2) ETTPT failing to realize the export themselves can promote partnership as meant in the Decision of the Director General of Foreign Trade No. 18/DJPLN/KP/III/1999 dated March 19, 1999 on technical directives for the stipulation of Growth Quotas (KTt) of Textile and Clothing to ETTPT-PKK in the quota year of 1999 and procedures for partnership in the export of TPT quotas by ETTPT-PKK.
Article 5
ETTPT obtaining KPt in 2000 shall be monitored periodically and in the case of ETTPT which receive KPt being found not to be in accordance with the criteria as meant in the Decree of the Minister of Industry and Trade No. 599/MPP/Kep/10/1999, the relevant ETTPT are subjected to measure in the form of the freezing of the remaining KPt allocated and the quotas already realized do not become fixed quotas and the relevant ETTPT will not obtain KPt in the following year.
Article 6
To instruct the Director General of Foreign Trade to allocate KPt for the year of 2000 on a prorata basis to ETTPT-PKK as meant in Article 3 paragraph (2).
Article 7
This decree shall come into force as from the date of stipulation.
