SERVER PULSA BERDASARKAN UNDANG-UNDANG NOMOR 5 TAHUN 1999 TENTANG LARANGAN PRAKTIK MONOPOLI DAN
PERSAINGAN USAHA TIDAK SEHAT
ABSTRAK
Industri telekomunikasi selular di Indonesia memiliki banyak sektor yang dapat dijadikan lahan bisnis, diantaranya adalah penjualan pulsa elektrik dari berbagai macam operator telepon selular, salah satunya Telkomsel. Pada pertengahan kuartal tahun 2011, Telkomsel memberlakukan bentuk sistem distribusi baru untuk pulsa elektrik bernama hard cluster berupa pembagian wilayah yang menimbulkan polemik karena pengusaha server pulsa selaku pihak penjual merasakan sistem baru tersebut merugikan karena menghambat proses dan mengurangi omzet yang didapat dari penjualan pulsa tersebut. Penelitian ini bertujuan untuk menganalisis bagaimana kedudukan dari sistem distribusi tersebut dalam UU No.5 Tahun 1999 dan bentuk-bentuk pengawasan yang dapat diterapkan pada sistem distribusi tersebut.
Penelitian ini dilakukan dengan menggunakan metode pendekatan yuridis normatif yang menitikberatkan penelitian terhadap asas dan norma serta bersifat deskriptif analisis untuk menganalisis antara perundang-undangan yang berlaku dengan praktik yang terjadi di lapangan. Teknik pengumpulan data dilakukan dalam dua tahap yaitu penelitian kepustakaan untuk memperoleh data sekunder dan penelitian lapangan melalui wawancara untuk memperoleh data primer guna mendukung pemahaman terhadap masalah yang diteliti.

The mobile telecommunication industry in Indonesia has a lot of sectors that can be made into business. One of them are the sale of electrical cellullar phone credit from a wide range of mobile phone
operator, including Telkomsel. In the middle of the quarter in 2011,
Telkomsel enacting new forms of distribution system for electrical cellullar
phone credit called hard clusters of subdivisions which give rise to
polemics, because owner of electrical cellullar phone credit server feels the new system is detrimental because it inhibits the process and reduce turnover obtained from the sale of these credits. This research aims to analyze how the position of the distribution system in Law No. 5/1999 and forms of supervision that can be applied to the distribution system.
This research was conduct by using a judicial normative approach that emphasizes study of principles and norms as well as descriptive analysis to analyze applicable legislation to the practice in the field. Techniques of data collection is done in two stages, study literature to obtain secondary data and field study to obtain primary data to support the understanding of the problems.
The result of this research shows that distribution agreement that formed the basis of the implementation of the hard cluster distribution system have been filled all the elements and can be considered a covered
agreement which is one of the prohibited agreement according to Law
