DECREE OF THE GOVERNOR OF BANK INDONESIA

NUMBER: 8/32/KEP.GBI/2006

CONCERNING

ESTABLISHMENT OF THE SPECIAL TEAM IN PREPARATION FOR

IMPLEMENTATION OF THE BASEL II BANK CAPITAL FRAMEWORK IN

INDONESIA

THE GOVERNOR OF BANK INDONESIA,

Considering: a. whereas as an institution dependent on public trust, the national banking system must at all times operate on the basis of prudential principles with reference to the applicable regulations, international standards and sound banking practices;

b. whereas following the publication of the International Convergence of Capital Measurement and Capital Standards – A

Revised Framework (Basel II) document in June 2004, it is necessary to amend the existing regulation concerning the minimum capital adequacy requirement for commercial banks and other related regulatory provisions;

c. whereas following the instruction of the Governor of Bank Indonesia for Basel II implementation to commence in 2008, adjustments and improvements are necessary, among others, in banking infrastructure and the formulation of comprehensive preparatory measures to enable Basel II to be properly implemented by Bank Indonesia and the banking system;

d. now therefore to ensure the proper implementation Basel II, it is deemed necessary to order the immediate establishment of a

Special Team with members representing a cross-section of institutions in a Decree of the Governor of Bank Indonesia;

In view of: 1. Act Number 23 of 1999 concerning Bank Indonesia (State Gazette of the Republic of Indonesia Number 66 of 1999, Supplement to the State Gazette of the Republic of Indonesia Number 3843) as amended by Act Number 3 of 2004 (State Gazette of the Republic of Indonesia Number 7 of 2004, Supplement to the State Gazette of the Republic of Indonesia Number 4357);

2. Act Number 7 of 1992 concerning Banking (State Gazette of the Republic of Indonesia Number 31 of 1992, Supplement to the State Gazette of the Republic of Indonesia Number 3472), as amended by Act Number 10 of 1998 (State Gazette of the Republic of Indonesia Number 182 of 1998, Supplement to the State Gazette of the Republic of Indonesia Number 3790);

3. The International Convergence of Capital Measurement and

Capital Standards – A Revised Framework (Basel II) document published in June 2004.

HAS DECREED:

To order: THE ESTABLISHMENT OF THE SPECIAL TEAM IN PREPARATION FOR IMPLEMENTATION OF THE BASEL II

BANK CAPITAL FRAMEWORK IN INDONESIA

Article 1

(1) To build understanding of the substance of Basel II and formulate comprehensive measures for Basel II implementation, it is deemed necessary to arrange for

coordination between Bank Indonesia, banks and other relevant institutions through establishment of a Special Team.

(2) The task of the Special Team referred to in paragraph (1) is to conduct activities as appropriate to the individual tasks stipulated in this Decree.

(3) The Special Team shall consist of the Steering Committee, Working Group and Technical Team with membership as listed in the Appendix to this Decree and constituting an integral part of this Decree.

(4) In carrying out its tasks, the Special Team may be assisted by resource persons as appropriate to the needs of the Team.

Article 2

The tasks of the Special Team include the following:

a. Study and research all national discretions in the Basel II document that are relevant for application in the selected approaches for improvement to the standards for calculation of bank capital.

b. Present the results of the study referred to in item a. in the form of policy recommendations to provide the basis for amendment of the regulations concerning calculation of bank capital.

c. Serve as a resource for drafting of regulations for calculation of bank capital as referred to in item b.

Article 3

(1) The tasks of the Steering Committee include the following:

a. Monitoring progress by the Working Group on the national discretions study; b. Convening regular meetings at least once every 3 (three) months to provide

guidance to the Working Group on the national discretions study;

c. Presenting the national discretions study to the Board of Governors of Bank Indonesia.

(2) The tasks of the Working Group include the following:

a. Determining the national discretions for study and discussion within a 1 (one) year period;

b. Convening regular meetings at least once every 1 (one) month for study and discussion of national discretions;

c. Formulating and drafting the national discretions study and other actions as deemed necessary for development of policy recommendations;

d. Presenting the national discretions study and recommendations for decisions to the Steering Committee for further deliberation;

e. Presenting revisions to the national discretion study to the Steering Committee. (3) The tasks of the Technical Team include the following:

a. Coordination in the Steering Committee and Working Group meetings; b. Facilitation for the Steering Committee and Working Group meetings;

c. Secretarial support, including but not limited to recording and writing of minutes and other support tasks.

Article 4

(1) The initial tenure for the Special Team shall commence on 1 January 2006 and end on 31 December 2006.

(2) The tenure of the Special Team may be extended for the 1 (one) following year, if deemed necessary.

Article 5

Expenses incurred by the Special Team in the performance of its duties shall be charged to the budget of the Directorate for Banking Research and Regulation – Bank Indonesia qq Basel II Initiative.

Article 6

Any matters not provided for in this Decree shall be stipulated at a future date.
