FOURTH AMENDMENT TO PRESIDENTIAL DECREE NO. 41/1973 ON BATAM ISLAND INDUSTRIAL ESTATE
(Presidential Decree No. 113/2000 dated August 4, 2000) THE PRESIDENT OF THE REPUBLIC OF INDONESIA
Considering:
That to better intensify the development of Batam Island Industrial Estate, it is deemed necessary to amend presidential Decree No. 41/1973 on Batam Island Industrial Estate as already amended several times, the latest by presidential Decree No. 94/1998;
In view of:
1. Article 4 sub-article (1) of the Constitution 1945;
2. Presidential Decree No. 41/1973 on Batam Island Industrial Estate as already amended the latest by presidential Decree No. 94/1998;
D E C I D E S To stipulate:
PRESIDENTIAL DECREE CONCERNING THE FOURTH AMENDMENT TO PRESIDENTIAL DECREE NO. 41/1973 ON BATAM ISLAND INDUSTRIAL ESTATE
Article 1
To amend a number of provisions in Presidential Decree No. 41/1973 on Batam Island Industrial Estate, which has been amended several times, the latest by Presidential Decree No. 94/ 1998,as follows:
1. To amend the provision of Article 2 so that it shall read as follows: Article 2
(1) Fostering, controlling and management of Batam Island Industrial Estate shall respectively be conducted by and accounted for to:
a. The Board of Patrons of Batam Island Industrial Estate; b. Batam Island Industrial Estate Development Authority; c. Batam Island Industrial Estate Management Company
(2) In undertaking their tasks, the Board of Patrons of Batam Island Industrial Estate and Batam Island Industrial Estate Development Authority shall be accountable to the President.”
2. To amend the provision of Article 3 so that it shall read as follows: Article 3
(1) The Board of Patrons of Batam Island Industrial Estate shall be assigned the following:
a. Undertaking fostering of the implementation of the policy to develop and control construction on Batam Island undertaken by Batam Island Industrial Estate Development Authority;
b. Coordinating the policies of the central government which are connected with the development of Batam Island;
(2) The structure of the Board of Patrons of Batam Island Industrial Estate shall comprise:
1. Chairman concurrently member: Minister of Industry and Trade
2. Member : a. Minister of settlement and Territorial Development b. Governor of Riau Province.”
3. To amend the provision of Article 4 so that it shall read as follows :
Article 4
(1) Batam Island Industrial Estate Development Authority shall be responsible for the development and growth of Batam Island Industrial Estate and shall be assigned the following :
a. Developing and controlling the construction on Batam Island as an industrial estate;
b. Planning the need for infrastructure installations and facilities; c. Developing and controlling transshipment activities on Batam Island;
d. Accommodating and examining applications for business licenses filed by businessmen and pass them on to the government agencies concerned;
e. Ensuring that the procedure for licensing and the provision of services needed in establishing and running business on Batam island may run in a smooth and orderly manner in order to be able to arouse the interest of businessmen to invest on Batam Island.
(2) The structure of Batam Island Industrial Estate Development Authority shall comprise:
a. Chairman;
b. Deputy for operations;
c. Deputy for Administration and Planning; d. Deputy for Supervision and Control.
(3) In implementing its tasks, Batam Island Industrial Estate Development Authority shall be assisted by a team of Assistants comprising local officials representing: The ministry of Industry and trade;
The finance ministry;
The ministry of settlement and territorial development.
(4) In developing the growth of Batam Island Industrial Estate and implementing its daily tasks, Batam Island Industrial Estate Development Authority shall receive and take into account the guidance and briefing provided by the Board of Patrons of Batam Island Industrial Estate.
(5) Batam Island Industrial Estate Development Authority shall be domiciled and have their head office on Batam Island.”
Article II
This presidential decree shall take effect as from the date of stipulation.
