DECREE OF THE MINISTER OF FINANCE NO. 572/KMK.01/2000 DATED DECEMBER 26, 2000 ON THE IMPOSITION OF PROVISIONAL ANTI-DUMPING

IMPORT DUTY ON CARBON BLACK

THE MINISTER OF FINANCE,

Considering :

a. That in the line with Government Regulation No. 34/1996 and the Decree of the Minister of Industry and Trade No. 261/MPP/Kep/9/1996, PT Cabot Indonesia and PT Karbon Indonesia as domestic producers of carbon black have filed a request/complaint for an investigation into the product manufactured by companies of India, South Korea and Thailand;

b. The request as meant in point a has met the requirements for an inquiry into the said product, and the Indonesian Anti Dumping Committee has conducted a series of probes covering announcements in the mass media, opportunities allowed to the parties interested in the case to convey information and responses as well as verification of available evidence;

c. That based on results of the inquiry as referred to in point b, the Indonesian Anti Dumping Committee has positively obtained initial proof of the presence of the said dumped goods, which cause losses to the relevant domestic industries;

d. That in order to prevent further losses in the course of investigation, it is deemed necessary to stipulate the imposition of provisional anti-dumping import duty on carbon black.

In view of :

1. Law No. 7/1994 on ratification of the Agreement Establishing the World Trade Organization (Statute Book of 1994 No. 57, Supplement to Statute Book No. 3564);

2. Law No. 10/1995 on customs affairs (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3612); 3. Government Regulation No. 34/1996 on anti dumping import duties and countervailing duties (Statute Book

of 1996 No. 51, Supplement to Statute Book No. 3639); 4. Presidential Decree No. 234/M/2000;

5. The Decree of the Minister of Industry and Trade No. 261/MPP/Kep/9/1996 on the procedure and requirements for requesting inquiries into dumping goods and or subsidized goods.

Taking into account :

The letter of the Minister of Industry and Trade No. 1065/MPP/II/2000 dated November 8, 2000 on the application of provisional anti dumping import duty on carbon black from India, South Korea and Thailand.

To stipulate :

THE DECREE OF THE MINISTER OF FINANCE CONCERNING THE IMPOSITION OF PROVISIONAL ANTI-DUMPING IMPORT DUTY ON CARBON BLACK.

Article 1

(1) Provisional anti-dumping import duty shall be imposed on carbon black, tariff heading 2803.00.190.

---Article 2

The Director General of Customs and Excise shall carry out the provisions stipulated in this decree.

Article 3

This decree shall come into force as from the date of stipulation for a maximum period of four months as from the said date.

For public cognizance, this decree shall be announced by publishing it in the State Gazette of the Republic of Indonesia.
