HOLIDAYS ACT 1951 (Act 369) No. 863.

HARI KELEPASAN AM DI NEGERI MELAKA BAGI TAHUN 2012 PUBLIC HOLIDAYS IN THE STATE OF MELAKA FOR THE YEAR 2012

Pada menjalankan kuasa yang diberikan oleh subseksyen 9(1) Akta Hari Kelepasan 1951 [Akta 369], Pihak Berkuasa Negeri menetapkan hari-hari yang dinyatakan dalam Jadual menjadi hari-hari kelepasan am Negeri bagi tahun 2012.

2. Jika mana-mana Hari Kelepasan Am Negeri jatuh pada hari kelepasan mingguan maka hari yang berikutnya hendaklah menjadi hari kelepasan am, dan jika hari sedemikian adalah sememangnya hari kelepasan am maka hari yang berikutnya hendaklah menjadi hari kelepasan am.

3. Jika Hari Kelepasan Am itu jatuh pada hari Sabtu, maka hari Sabtu itu juga adalah merupakan Hari Kelepasan Am dan tidak diganti pada hari-hari lain.

In exercise of the powers conferred by subsection 9(1) of the Holidays Act 1951 [Act 369], the State Authority appoints the days specified in the Schedule to be State Public Holidays for the year 2012.

2. If any State Public Holidays falls on a weekly holiday then the day following shall be a public holiday, and if such day is already a public holiday then the day following shall be a public holiday.

3. If any State Public Holiday falls on a Saturday, then that day is considered as a State Public Holiday and will not be replaced by any other day.

Bahawasanya sewa yang dikenakan bagi tanah tersebut dan yang kena dibayar bagi tahun ini masih belum dibayar dan, mulai dari 1hb Jun, adalah dalam tunggakan.

Dan ambil perhatian bahawa, jika jumlah yang dinyatakan dalam ruangan akhir itu tidak dibayar dengan sepenuhnya dalam tempoh tiga bulan tersebut, maka saya yang bertandatangan di bawah ini, menurut kuasa-kuasa yang diberi oleh seksyen 100 Kanun Tanah Negara, akan mengisytiharkan dengan jalan perintah tanah berkenaan dilucuthak kepada Pihak Berkuasa Negeri.

Bahawasanya notis tuntutan dalam Borang 6A Kanun Tanah Negara, telah diserahkan kepada tuan punya tanah yang dimiliki menurut G.M. MCL 1364, Lot 2748, Mukim Bukit Rambai, Daerah Melaka Tengah pada 28 Julai 2005 dan juga satu catatan mengenai penyerahannya telah dituliskan dalam daftar pada 4 Ogos 2005.

Bahawasanya tuan punya tanah telah gagal menyerahkan (membayar) sebanyak RM28,918.50 (Ringgit Malaysia: Dua Puluh Lapan Ribu Sembilan Ratus Lapan Belas dan Sen Lima Puluh sahaja) seperti yang dinyatakan dalam notis tersebut pada atau sebelum 27 Oktober 2005.

Whereas the amount specified in column (4) as prescribed in such notice has not been paid to the Land Administrator on or before 23 August 2011.

Therefore, I by this Order declare such land forfeit to the State Authority.

NOTICE OF REVERSION TO THE STATE

Bahawasanya, menurut peruntukan seksyen 100 Kanun Tanah Negara, tanah yang dijadualkan di bawah ini telah dengan jalan perintah diisytiharkan dilucuthak kepada Pihak Berkuasa Negeri.

Notis adalah dengan ini diberi bahawa pelucuthakan tersebut telah berkuat kuasa pada hari ini dan bahawa, oleh kerana tanah itu menjadi kepunyaan Pihak Berkuasa Negeri—

(a) apa-apa jua hakmilik atau kepentingan atas tanah itu yang dahulunya ada atau yang boleh timbul adalah dipadamkan; dan

(b) dokumen hakmilik keluaran bagi tanah itu adalah tidak sah dan boleh dirampas oleh Kerajaan.

Whereas, pursuant to the provision of section 100 of the National Land Code, the land scheduled below has by order been declared forfeit to the State Authority.

Notice is hereby given that such forfeiture has this day taken effect and that, in consequence of its vesting in the State Authority—

(a) any time or interest in the land heretofore substituting or capable of arising is extinguished; and

(b) the issue document of title to the land is void and is impoundable by the State.

Pada menjalankan kuasa-kuasa yang diberi oleh Bab 4 Bahagian Sepuluh Kanun Tanah Negara, notis adalah dengan ini diberi bahawa adalah dicadangkan untuk menyediakan suatu dokumen hakmilik daftaran sementara berhubungan dengan tanah yang diperihalkan dalam Jadual di bawah ini kerana sebab-sebab berikut—

Dokumen hakmilik daftar (Buku Daftar) yang asal telah rosak.

2. Selepas penyiaran notis ini dalam Warta, Pendaftar atau Pentadbir Tanah tidak akan menerima untuk pendaftaran mana-mana suratcara urusniaga yang menyentuh tanah itu, atau memasukkan apa-apa kaveat sendirian di bawah seksyen 322 atau apa-apa kaveat pemegang lien di bawah seksyen 330 berkenaan dengannya, sehingga pemasukan itu dalam dokumen hakmilik daftaran sementara telah disahkan di bawah seksyen 175F.

3. Mana-mana orang atau badan yang mempunyai kepentingan dalam tanah tersebut boleh memohon dalam masa tiga bulan daripada tarikh penyiaran notis ini dalam Warta kepada Pentadbir Tanah dalam Borang 10F bahawa nama tuanpunya/mana-mana orang yang mempunyai kepentingan berdaftar atau kepentingan yang boleh didaftarkan dimasukkan dalam dokumen hakmilik daftaran sementara.

Saya, Mas Muhammad Hakim bin Masika, Penolong Pentadbir Tanah Daerah Melaka Tengah, pada menjalankan kuasa yang diberikan oleh seksyen 263 Kanun Tanah Negara, dengan ini memerintahkan supaya dijual tanah yang diperihalkan dalam Jadual di bawah ini;

Dan saya selanjutnya memerintahkan—

(a) supaya jualan itu, hendaklah secara lelongan awam, yang akan diadakan pada 13 Januari 2012 (Jumaat) jam 10.00 pagi di kawasan Pejabat Tanah Melaka Tengah, Melaka; dan

(b) bahawa harga rizab bagi maksud jualan itu hendaklah RM105,000.00 (Satu Ratus Lima Ribu Ringgit sahaja).

dan

(ii) sebelum baki harga belian diselesaikan, jumlah wang yang dinyatakan dalam subperenggan (i) hendaklah dikreditkan ke dalam akaun penggadai untuk tujuan mengurangkan jumlah wang yang kena dibayar kepada pemegang gadaian;

(d) baki harga belian hendaklah diselesaikan dalam masa tidak lebih daripada satu ratus dua puluh (120) hari dari tarikh jualan, iaitu, tidak lewat dari tarikh 14 Mei 2012 dan bahawa tiada apa-apa lanjutan masa bagi tempoh yang telah dinyatakan; dan

(e) di mana harga belian sepenuhnya tidak diselesaikan sebelum atau pada tarikh yang ditentukan dalam perenggan (d), jumlah wang yang dibayar sebagai deposit di bawah perenggan (c) kepada pemegang gadaian hendaklah dilucuthak dan dilupuskan mengikut cara yang dinyatakan di bawah seksyen 267.

And I further order—

(a) that the sale shall be by public auction, to be held on the 13 January 2012 (Friday) at 10.00 a.m. at the premises of the Land Office of Melaka Tengah, Malacca; and

(b) that the reserve price for the purpose of the sale shall be RM105,000.00 (One Hundred and Five Thousand Ringgit only).

2. I find that amount due to the chargee at this date is RM112,629.00. Name of Chargee is Bank Muamalat Malaysia Berhad.

3. The sale shall be subject to the following conditions:

(a) the bidder possesses, the sum equivalent to ten per centum (10%) of the reserve price specified under paragraph 1(b) above: RM10,500.00 (Ten Thousand and Five Hundred Ringgit only);

(b) the full amount of the purchase price may be paid immediately after the fall of the hammer by the successful bidder to the chargee;

(c) where the full amount of the purchase price is not paid after the fall of the hammer by the successful bidder—

(i) then, the sum specified in paragraph (a) shall be paid to the chargee and it shall be retained as a deposit until the full purchase price has been paid; and

(ii) pending the settlement of the balance of the purchase price, the sum specified in subparagraph (i) shall be credited into the account of the chargor for the purpose of reducing the amount due to the chargee;

that is, not later than 14 May 2012 and there shall be no extension of the period so specified; and

(e) where the full purchase price is not settled on or by the date specified in paragraph (d), the sum paid as deposit under paragraph (c) to the chargee shall be forfeited and disposed of in manner specified under section 267.
