INTRODUCTION

The existence of customary law communities existed long before the independence of the Republic of Indonesia on August 17, 1945. This was also related to the existences of communal rights of customary law communities which were referred to as customary rights of indigenous peoples. These customary rights exist because of the legal relationship between indigenous peoples (as subjects) and their ulayat (as objects) which gives birth to the authority of the subject to carry out legal actions against the customary rights. Customary rights is a traditional right, it can be said that everything is unwritten so it is vulnerable in terms of proof and legal protection.

OBJECTIVES

This study intends to answer the problem: (1) how is the form of legal protection against customary rights of indigenous and tribal peoples in land regulation in Indonesia so far, and (2) how is the ideal concept of legal protection for customary rights of indigenous peoples in land regulation in Indonesia legal certainty?

METHODOLOGY

This study uses a normative juridical approach, type of analytical descriptive research. The main data source in this study is secondary data. The secondary data includes: primary legal material in the form of legislation and court decisions specifically the decisions of the Constitutional Court, secondary legal materials such as books, journals, seminar results and research results, and tertiary legal materials in the form of legal dictionaries and encyclopedias. The analysis was carried out qualitatively.

SIGNIFICANCE

This research is expected to contribute to (i) the Government, the People's Legislative Assembly of the Republic of Indonesia and the Regional Government both provincial and district and indigenous people in enforcing ulayat rights; and (ii) as the reference for further Ulayat right research in in protecting legal community in land regulation in Indonesia

FINDINGS/RESULTS

In this research found that (1) Legal protection of the customary rights of indigenous and tribal peoples in land regulation in Indonesia is contained in the Constitution (the Constitution of the Republic of Indonesia in 1945) and in the Basic Agrarian Law (Law No. 5 1960) along with the regulations below.

The form of protection is the recognition of the existence of customary rights as long as in reality they are still alive. Since recognition is only normative, the legal certainty of the existence of customary rights in indigenous and tribal peoples is lacking (2) The ideal concept of legal protection for customary rights of indigenous peoples in land regulation in Indonesia with legal certainty is that normative recognition is needed, more than that it is also necessary to confirm the ulayat rights of the customary law community in the form of declaratory stipulations. CONCLUSIONS

Thus, the concept of customary land rights conceptually can be concluded as a right that cannot be separated from the customary law community. In a sense, the existence of customary rights depends on the existence of customary law communities. Customary rights are a form of socio-magical ties as well as juridical ties to the area of customary law communities (ulayat) which include everything that grows and develops above the customary area.
