Abstract

On the basis of MPR Decree No.IV / MPR / 1978, a policy on land affairs, known as the chess discipline in the land sector, was published in Presidential Decree Number 7 of 1979, one of which included land administration discipline. How to conduct an orderly administration of land affairs to support the implementation of the authorities, duties and functions of the National Land Agency. This study uses normative juridical methods. Administration of Land Affairs in order to support the implementation of the authority, duties and functions of the National Land Agency by using a computerized system of land activities which is an electronic system.

Atas dasar Tap MPR No.IV/MPR/1978, dikeluarkan kebijaksanaan bidang pertanahan yang dikenal dengan catur tertib bidang pertanahan sebagaimana dimuat dalam Keppres Nomor 7 Tahun 1979, salah satunya meliputi tertib administrasi pertanahan. Bagaimana cara menyelenggarakan tertib administrasi bidang pertanahan untuk menunjang pelaksanaan kewenangan, tugas, dan fungsi Badan Pertanahan Nasional. Penelitian ini menggunakan metode yuridis normatif. Penyelenggaraan Tertib Administrasi Bidang Pertanahan untuk menunjang pelaksanaan kewenangan, tugas, dan fungsi Badan Pertanahan Nasional dengan cara menggunakan sistem komputerisasi kegiatan pertanahan yang merupakan sistem elektronik.

A. Pendahuluan

Tanah memiliki peran yang sangat besar bagi keberlangsungan hidup umat manusia. Abstract

The purpose of this study is to find out the politics of law which is oriented to maritime and maritime administration. The writing method is writing law which is analyzed using qualitative analysis. The results of the research show that legal politics is the direction of development that will be achieved by the Indonesian state. As a state of law and as an archipelago, the legal politics of the Indonesian people are not yet fully oriented towards maritime and maritime affairs. Some regulations which are bound with maritime affairs and maritime affairs are not effective in law enforcement so that they need to be improved or revised but they are not included in the legislation program. While the legislation programs that have been set up, there are still some that have not been achieved, especially regarding maritime affairs and maritime affairs.

Abstrak

Tujuan kajian ini adalah untuk mengetahui politik hukum yang berorientasi pada administrasi kelautan dan kemaritiman. Metode penulisan adalah penulisan hukum yang dianalisis menggunakan analisis kualitatif. Hasil penelitian menjukan bahwa politik hukum merupakan arah pembangunan yang akan dicapai oleh negara Indonesia.

Sebagai negara hukum dan sebagai negara kepulauan, politik hukum bangsa Indonesia belum sepenuhnya berorientasi pada kelautan dan kemaritiman. Beberapa peraturan yang terikat dengan kelautan dan kemaritiman tidak efektif dalam penegakan hukum sehingga perlu perbaikan atau revisi akan tetapi tidak masuk program legislasi.

Sedangkan program legislasi yang telah ditetapkan pun masih ada yang belum tercapai khususnya tentang kelautan dan kemaritiman.

Abstract

This study aims to explain the meaning of the symbol of the tradition called "Sedekah Laut". It is creates a cultural and religious conflicts frequently and explains how the law should be able to resolve social conflicts by "Berperasaan". This "berperasaan"

law is based on progressive legal theory which states that the law must serve the society by providing benefits rather than merely punishing. The results of the discussion showed that there is a strong connection between culture and religion, God. This form of gratitude is an expression of gratitude for the gift that has been given. In addition, this is a the way of respect to God who has guarded the sea which is believed to be something important related to the safety of society. The relation of this research to the study of law is that how law can be a tool to resolve conflicts between culture and religion. Resolving conflict by law is done by looking at symbols as cultural values that have been long lived in that local society.

yang seringkali menimbulkan benturan budaya dan agama itu terjadi dan menjelaskan bagaimana seharusnya hukum dapat menyelesaikan konflik sosial dengan menyatakan bahwa Hukum harus mengabdi kepada masyarakat dengan memberi kebermanfaatan dari pada hanya sekedar menghukumi. Hasil pembahasan menunjukan bahwa ada keterkaitan yang kuat antara budaya dan agama yaitu upacara simbolis Sedekah Laut merupakan wujud implementasi rasa syukur masyarakat setempat kepada Tuhan Yang Maha Esa. Wujud syukur ini sebagai ungkapan terima kasih atas pemberian yang telah diberikan. Selain itu, hal ini sebagai wujud rasa hormat mereka untuk menjaga laut yang diyakini berperan penting demi menjaga keselamatan masyarakat. Kaitan penelitian ini dengan studi hukum adalah bahwa bagaimana hukum dapat menjadi alat menyelesaikan konflik antara budaya dan agama. Penyelesain konflik ini oleh hukum dilakukan dengan melihat simbol-simbol sebagai nilai budaya yang telah lama hidup dalam masyarakat setempat.

Kata kunci: Budaya, Tradisi, Hukum, Pandangan Hidup, Konflik Sosial, Konflik.
