CASE REPORT

VIOLENCE AGAINST BABIES AT THE MILLENIAL GENERATION

Abstract:

Background: Nielsen Media Research defines millennials as adults aged between 22 – 38 years in 2019, the millennial generation has a behavior that likes to travel. 1 in 3 millennials in Indonesia vacation at least once a year. Millennials, on the other hand, are sharing, caring and socially responsive, while according to BBC News, a 45-year-old French nursing assistant and mother of two daughters has been arrested after admitting to killing eight of her newborn babies between 1989 and 2006. The same report lists three other multiple infanticide homicides that have been detected in France (one of seven babies in the 1984 Limousin;

another of four babies in Alsace in 2003, of which at least three were of the same ancestry, and a third of six infants). in Lower Normandy 2010)

Discussion: Millennials are considered as a group with more diverse ethnicities than previous generations. Millennials are also a generation with a good level of education. The millennial generation is also considered to be an educated young generation with high optimism, but they still commit acts of violence against their babies.

Conclusion: From the results of external and internal examinations, it is estimated that the age of the baby in the womb is 36-37 weeks (viable), born alive, has not received treatment.

The cause of death of the victim was suffocation accompanied by blood infiltration in the head due to blunt force.

INTRODUCTION

Although many misinterpret millennials as the entire population of young people, the term millennials actually refers to people born in the time period from the early 1980s to the mid-1990s and early 2000s.

Nielsen Media Research defines millennials. as adults aged between 22 – 38 years in 2019. Millennials are sometimes also called Echo Boomers because they are descended from the Baby Boomer generation and because of the significant increase in birth rates in the early 1980s to 1990s.

Millennial Characteristics; Currently, each generation has labels, attributes, and stereotypes attached to each generation, as well as the millennial generation.

Millennials are here at a time when daily activities are starting to be influenced by the internet and mobile devices. This is why millennials are considered to be very proficient in using technology and digital platforms.

Apart from being adept at using technology, millennials also have a number of other characteristics. This generation is considered as a group with more diverse ethnicity than previous

generation with a good level of education.

That's why millennials are considered as an educated young generation with high optimism. On the other hand, this generation is also considered to be more individualistic, ignores political issues, and focuses more on materialist values.

However, these characteristics will of course vary based on the region and socio- economic conditions of each individual. ( Suara.com 2020)

Recently, the millennial generation has become a hot topic of discussion among the public. Not only in terms of education and technology, but also millennial behavior that is different from the previous generation. Research conducted by the Alvara Research Center institution said that the millennial generation has great potential for business. The first behavior, the millennial generation in Indonesia is very addicted to the internet. In a day, the average millennial generation can use the internet for a duration of more than seven hours with a certain age range. Second, the loyalty of the millennial generation is low.

transactions with a portion of 59 percent.

The fourth behavior is that the millennial generation can work faster and smarter because it is supported by the presence of technology. On the other hand, millennials also like to share, care and are responsive to social problems. (Indonesia is good.id) Murder is the intentional killing of another person's life, in order to take the life of another person, a perpetrator must do something or a series of actions that result in the death of another person with a note that the profit from the perpetrator must be aimed at the result in the form of the death of the other person. The crime of murder is a material delict crime, which is a crime that can only be considered as having been completed by the perpetrator with the emergence of prohibited or unwanted consequences by law.

Cases of murder of newborns have been known for a long time and occur everywhere. Pharaoh of his time had ordered the killing of every male baby born, for fear of the emergence of a new king. In ancient times in Arabia it was common to kill every baby girl who was considered unlucky for her family.

According to BBC News, a 45-year-old French nursing assistant and mother of two daughters has been arrested after admitting to killing eight of her newborn babies between 1989 and 2006. Recently (June 2014) news media in Finland reported that five dead babies which had rotted away was found in the basement of an apartment house. A 35 year old woman claimed to have given birth to them all in the last 5-10 years. He further claimed that all had given birth at home and that the babies were stillborn. He was arrested on

suspicion of infanticide and a police investigation is ongoing.

Under applicable law in England, the killing of a baby under the age of one year by its own mother is called infanticide (Infanticide). The sentence is distinguished lighter than the sentence for ordinary murder (murder). This difference is based on the consideration that the mental status of women who are pregnant, giving birth or breastfeeding is very unstable and easily disturbed. Even in the past, infanticide itself in England was not punished, because the act was identified with the behavior of cats, which at any time could kill their own children.

In Scotland, there is no distinction between infanticide and ordinary homicide, while in Indonesia there is a distinction, but the method of distinction is very different from that in England. Here (Indonesia) it is not the mental status of the mother that is used as the basis for consideration, but the motive for fear of being caught giving birth to a child and the murder being carried out at the time of birth or shortly thereafter.

The motive of fear of being caught giving birth to children is related to the culture in Indonesian society which still considers it taboo to bear children without a husband.

If a woman kills her own baby who has just been born from a legal marriage, then the murder cannot be categorized as infanticide, but ordinary murder because she has no good reason to be afraid that she will be found out that she has given birth to a child. But a woman without a husband who kills her own baby as a result of adultery (obscene) with another man can be categorized as committing infanticide. If the two murders above,

those with a husband or without a husband, were committed for fear of being discovered by others or by their husbands that she gave birth. child is categorized as child homicide. So to be considered a child murder itself in Indonesia, the following conditions must be met: 1. Perpetrator:

biological mother, 2. Victim: biological child, 3. Time of murder: at birth or not long after, 4. Motive: fear of being found out giving birth.

a case report of a baby corpse, unknown, female gender, Explanation The body was found in the bathroom of Martha Friska General Hospital, Medan, on Tuesday, October 2, 2012 at 11.00 WIB. Internal examination, Head: At the scalp opening: Blood infiltration was found on the inner left scalp with a length of 4.5 cm, a width of 1 cm, with a distance of 3 cm from the middle of the body, 4 cm from the left ear.

At the opening of the thick membrane of the brain, dilation of blood vessels was found, soft brain tissue was found, no blood infiltration was found.

DISCUSSION

Child homicide (PAS) by definition is the killing of a child committed by a mother on her child at the time of birth or not long after birth, for fear of being found out that she gave birth to a child. The 6 questions that must be answered include: is the baby viable/non-viable, live birth/stillbirth, has been treated/not treated, the age of the baby in the womb, signs of violence, cause of death.

1. Determination of baby's viability On external examination, the baby's weight was 2650 grams, body length was 50 cm, head circumference was 32 cm and chest circumference was 30 cm. and do not have severe defects, such as anencephalus (lack of a brain). If the condition of the baby shows that he has been conceived at 28 weeks or more but has serious defects or if the baby has no major defects but is conceived at less than 28 weeks, then the baby is considered not viable.

Babies who are not viable are not necessarily stillborn and vice versa, babies who are viable are not necessarily born alive. The purpose of expressing a viable baby is to show the judge a fact that is likely to be used as consideration in determining the severity of the sentence to be imposed. It should be noted that non- viable live born babies will not live long.

2. Determination of the age of the baby in the womb

Determining the age of the baby in the womb according to the de Haas formula for 6 months and over: gestational age (months) is the root of the baby's body length. In this case, the body length (head- heel) of 46 cm divided by 5 equals 9.2 months.

3. Determination of live birth or death?

The results of external examination of this baby found an enlarged chest, on internal examination found a high diaphragm as high as between 5-6 ribs, found the right lung filled the chest cavity, found both lungs were red mosaic, the edges of the lungs were blunted, bleeding spots on the heart and lungs, positive pulmonary buoyancy test (+). If it is associated with the results of the above examination, these results indicate that the baby is breathing.

4. Has the baby been treated?

On external examination, this baby found the umbilical cord with a length of 19 cm, the base of the umbilical cord is pale, the end of the umbilical cord is red, has been cut, the cut edge is uneven, not tied and there is vernix caseosa (baby skin fat) on the head and folds. thighs, the baby was not wearing clothes when found.

5. Cause of death

There were bruises on the outer upper and lower lips, and bruises on the inner upper and lower lips. Bruises on the outer and inner upper and lower lips indicate the perpetrator's closure of the baby's mouth.

The cause of death in the baby was due to smothering which caused suffocation due to obstruction of air entering the respiratory tract.

The body of a baby, unidentified, female sex, body length 46 cm, weight 2,480 grams, skin color is light yellow. The umbilical cord was cut unevenly, 5 cm long, the edges of the wound were uneven, blood infiltration was found around the wound, the umbilical cord was untied and unwrapped. sense organs (eyes, mouth, nose, ears and limbs) and genitals have been formed. The hair on the head and eyebrows were straight black and the nails had passed through the tips of the fingers and toes.

From the results of external and internal examinations, it is estimated that the baby's age in the womb is 36-37 weeks (viable), born alive, has not received treatment. due to blunt force trauma.
