10. Code of Professional Ethics for Viswa Mahavidyalaya Teachers

The code of professional conduct for Viswa Mahavidyalaya teachers is given under.

Code of Professional Ethics for Viswa Mahavidyalaya Teachers

Preamble

I. Goal of Higher Education In Our Country

The basic purpose of education is to create skill and knowledge and awareness of our glorious national heritage and the achievements of human civilization, possessing a basic scientific outlook and commitment to the ideals of patriotism, democracy, secularism, socialism and peace, and the principles enunciated in the Preamble to our constitution.

Higher education has to produce leaders of society and economy in all areas of manifold activities with a commitment to the aforesaid ideals.

Higher education should strive for academic excellence, and progress of arts and science.

Education, research and extension should be conducted in conformity with our national needs and priority and ensure that our best talents make be fitting contributions to international endeavor on societal needs.

II. Teachers And Their Rights:

Teachers should enjoy full civic and political rights of our democratic country. Teachers have a right to adequate emoluments, social position, just conditions of service, professional independence and adequate social insurance.

The Code of Professional Ethics

I. Teachers And Their Responsibilities:

Whoever adopts teaching as a profession assumes the obligation to conduct himself in accordance with the ideals of the profession. A teacher is constantly under the scrutiny of his students and the society at large. Therefore every teacher should see that there is no incompatibility between his precepts and practice. The national ideals of education which have already been set forth and which he/she should seek to inculcate among students must be his/her own ideals. The profession further requires that the teachers should be calm, patient and communicative by temperament and amiable in disposition. Teachers should-

(i) Adhere to a responsible pattern of conduct and demeanour expected of them by the community;

(ii) Manage their private affairs in a manner consistent with the dignity of the profession;

(iii) Seek to make professional growth continuous through study and research;

(iv) Express free and frank opinion by participation at professional meetings, seminars, conferences, towards the contribution of knowledge;

(v) Maintain active membership of professional organizations and strive to improve education and profession through them;

(vi) Perform their duties in the form of teaching, tutorial, practical and seminar work conscientiously and with dedication.

(vii) Co-operate and assist in carrying out functions relating to the educational responsibilities of the institution such as; assisting in appraising applications for admission, advising and counseling students as well as assisting in the conduct of University examinations including supervision, invigilation and evaluation; and (viii) Participate in extension, co-curricular and extracurricular activities including

community service.

II. Teachers And Students:

Teachers should-

(i) Respect the right and dignity of the student in expressing his/ her opinion.

(ii) Deal justly and impartially with students regardless of their religion, caste, economic, social and physical characteristics;

(iii) Recognize the difference in aptitude and capabilities among students and strive to meet

their individual needs;

(iv) Encourage students to improve their attainments, develop their personalities and at the same time contribute to community welfare.

(v) Inculcate among students scientific outlook and respect for physical labour and ideals of democracy, patriotism and peace;

(vi) Be affectionate to the students and not believe in a vindictive manner towards any of them for any reasons.

(vii) Pay attention to only the attainment of the student in the assessment of merit;

(viii) Make themselves available to the students even beyond their class hours and help and guide students without any remuneration or reward;

(ix) Aid students to develop an understanding of our national heritage and national goals, and

(x) Refrain from inciting students against other students, colleagues or administration III. Teachers And Colleagues:

Teachers Should –

(i) Treat other members of the profession in the same manner as they themselves wish to be treated.

(ii) Speak respectfully of other teachers and render assistance for professional betterment.

(iii) Refrain from lodging unsubstantiated allegations against colleagues to higher authorities;

(iv) Refrain from allowing considerations of caste, creed, religion, race or sex in their professional endeavor.

IV Teachers And Authorities:

Teachers Should –

(i) Discharge their professional responsibilities according to the existing rules and adhere to procedures and methods consistent with their profession in initiating steps through their own institutional bodies and / or professional organizations for change of any such rule detrimental to the professional interest;

(ii) Refrain from undertaking any other employment and commitment including private tuitions and coaching classes which are likely to interfere with their professional

responsibilities.

(iii) Co-operate in the formulation of policies of the institution by accepting various offices and discharge responsibilities which such offices may demand;

(iv) Co-operate through their organizations in the formulation of policies of the other institutions and accept offices;

(v) Co-operate with the authorities for the betterment of the institutions keeping in view the interest and in conformity with dignity of the profession;

(vi) Should adhere to the conditions of contract;

(vii) Give and expect due notice before a change of position is made, and

(viii) Refrain from availing themselves of leave except on avoidable grounds and as far as practicable with prior intimation, keeping in view their particular responsibility for completion of academic schedule.

V. Teachers And Non –Teaching Staff;

(i) Teachers should treat non- teaching staff as colleagues and equal partners in a cooperative undertaking within every educational institution;

(ii) Teachers should help in the function of joint staff – councils covering both teachers and the non-teaching staff;

VI. Teachers And Guardians:

Teachers should –

Try to see through teachers‟ bodies and organizations that institutions maintain contact with the guardians of their performance to the guardians whenever necessary and meet the guardians in meeting convened for the purposes for mutual exchange of ideals and for the benefit of the institutions.

VII. Teachers And Society

Teachers should –

(i) Recognize that education is a public service and strive to keep the public informed of the educational programme which are being provided;

(ii) Work to improve education in the community and strengthen the community‟s moral intellectual life;

(iii) Be aware of social problems and take part in such activities as would be conducive to the progress of society and hence the country as a whole;

(iv) Perform the duties of citizenship, participate in community activities and shoulder responsibilities of public offices;

(v) Refrain from taking part in or subscribing to or assisting in any way activities which tend to promote feelings of hatred or enmity among different communities, religions or linguistic groups but actively work for national Integration.

23. Discipline and Appeal Rules

1. Short Title

These rules shall be called the “Sri Chandrasekharendra Saraswathi Viswa Mahavidyalaya Employees Discipline and Appeal Rules 2007”.

2. Application

i) These rules shall apply to both teaching and non teaching employees of the Viswa Mahavidyalaya

ii) In regard to persons employed on contract, the provisions of these rules shall apply in respect of such of those matters as are not governed by the contract.

iii) If any doubt arises in the application of a given rule to an employee, the matter shall be referred to the Board which shall decide the same.

3. Penalties

For good and sufficient reasons, including any breach of the service rules of the Viswa Mahavidyalaya or negligence, inefficiency, insubordination or failure to show due diligence and attention in the discharge of his duties or failure to conform to the instructions of his superiors or any irregularities in the discharge of his duties or any criminal offence involving moral turpitude, an employee of the Viswa Mahavidyalaya shall make himself liable to the following penalties, namely;-

Minor Penalties i. Censure

ii. Withholding of promotion

iii. Stoppage of increment without cumulative effect.

iv. Fines

Major Penalties

i. Reduction to a lower rank in the seniority list

ii. Any period of suspension pending enquiry, either the whole or part of which treated as a substantive punishment.

iii. Stoppage of increment with cumulative effect.

iv. Reduction to a lower stage of pay.

v. Reduction to a lower category of the Viswa Mahavidyalaya service.

vi. Removal from service which shall not be a disqualification for future employment in the Viswa Mahavidyalaya.

vii. Dismissal from service which shall ordinarily be a disqualification for future employment in the Viswa Mahavidyalaya.

4. RECOVERY OF LOSS

Recovery may be ordered by the competent authority of any loss, if any, caused by an employee to Viswa Mahavidyalaya by any act of commission / omission, in addition to any of the punishments mentioned under rule 3.

5. AUTHORITY TO INSTITUTE DISCIPLINARY PROCEEDINGS

The Vice-chancellor or Registrar as the case may be, may institute disciplinary proceedings against any employee.

6. DISCIPLINARY AND APPELLATE AUTHORITIES

The authorities competent to impose penalties and the appellate authorities and period allowed for appeal shall be as indicated in Appendix. Any delay up to fifteen days from the date of imposing penalty while preferring an appeal may be condoned by the appellate authorities at their discretion. All appeals to the Board in an open format shall be addressed to the Registrar who is the ex-officio Secretary of the Board.

7. PROCEDURE FOR IMPOSING MINOR AND MAJOR PENALTIES

i) MINOR PENALTIES

Before imposing any of the minor penalties the delinquent employee shall be given an opportunity to explain his position to the disciplinary authority. If the explanation is not found

to be satisfactory, the disciplinary authority may impose any of the minor penalties on the delinquent employee.

ii) MAJOR PENALTIES

Before inflicting any of the major penalties the defaults of the delinquent employee shall be reduced to the form of charges giving the specific misconduct committed and served on him. He shall be required to make representation and to state whether there shall be an oral enquiry and / or oral hearing and if so details of documents and witnesses to be examined.

An enquiry to furnish hearing shall be held as desired by the delinquent employee. After the enquiry is completed, a copy of the report of the enquiry officer shall be forwarded to the delinquent employee and he shall be given a reasonable opportunity of making such representation as he may wish to make against the findings in the report. The charges and the representation of the delinquent employee and the findings of the enquiry officer shall be examined and the decision together with the penalty shall be recorded in writing and served on the delinquent employee.

8. SUPERSESSION BY THE VICE-CHANCELLOR

The Vice chancellor may take charge of the proceedings of an enquiry at any stage of the enquiry and complete or cause to be completed the enquiry in the manner he thinks fit in the interests of the Viswa Mahavidyalaya.

9. SUSPENSION

i) The Vice Chancellor in the case of any teaching and non-teaching employee of class A of the Viswa Mahavidyalaya and the Registrar in the case of Non-teaching staff of class B, C and D may place them under suspension, pending enquiry if, in their opinion the continuance of the employee in service will be detrimental either to the proposed enquiry or interest of the Viswa Mahavidyalaya.

ii) Notwithstanding anything contained in the above clause, the Vice-chancellor may, when he deems necessary, suspend any employee pending enquiry.

iii) The period of suspension shall not exceed six months, unless the period is extended beyond six months for specific reasons, by the competent authority.

iv) During suspension period, the employee would receive subsistence allowance

10. ABATEMENT OF DISCIPLINARY PROCEEDINGS

On the death of an employee against whom disciplinary proceedings are pending, such proceedings shall abate even though the same may be in the initial stage or nearing completion.

11. FINAL ORDER

i) An order of imposing any penalty shall state the grounds on which it is based and shall be communicated in writing to the person against whom it is passed.

ii) Every order, notice any other process made or issued under these rules shall be served in person on the employee concerned or sent to him by registered post with acknowledgement due or if such person is not found, by leaving it at his last known place of residence or by giving or tendering it to an adult member of his family or if none of the means aforesaid is available, by affixing it in some conspicuous part of his last known place of residence.

iii) If the management is not satisfied with the enquiry findings it may order for a fresh enquiry in certain cases.

12. APPEAL

Every employee shall be entitled to appeal to the appellate authority within a time period as specified in the appendix against an order passed by the disciplinary authority imposing upon him, any of the penalties specified under these rules.

13. POWERS OF THE APPELLATE AUTHORITIES

The appellate authority shall consider the appeal and pass such orders as appears to it just and equitable having regard to all the circumstances of the case and either confirm or enhance or reduce or set aside the penalty.

14. SUOMOTU REVIEW

Notwithstanding anything contained in these rules.

2. The Vice Chancellor or 3. The appellate authority, or

4. Any other authority specified in this behalf by the Board by a general or special order may call for the records of any enquiry and review any order made under these rules.
