“IMPACT OF SCIENTIFIC ADVANCEMENTS ON LAW AND SOCIETY WITH SPECIAL REFERENCE TO CYBER ISSUES”
Abhiraj Singh Chauhan Assistant Prof. S & S Law College
Abstract - In this paper, we will attempt to explore the effect factor of science and technology on law and society, as well as the dimensions of new cyber security concerns, and we will also broaden our understanding of cyber law. Law is not a static concept; it evolves in response to the needs of society. The law governs the interactions of individuals as they relate to society as a whole. Furthermore, as time passes, science and technology undergo dynamic changes, resulting in a plethora of new benefits and drawbacks in the age of internet technology. As a result, most threats are founded on the popular assumption of nothing being secure in the current era. It is a broader idea that refers to required changes in the law that are also a pressing need of the hour. However, we are concerned here with concerns of skills and other information technology apparatus that alter the law's relationship with society. Law deals with the rules and regulations that are most capable of changing the relationships. We will address some of the reasons for the dwindling legal clarity in this subject, as well as the potential consequences of declining authority of cyber security. As a result, the law has been updated in order to ensure effective cooperation between society and the consequences of technology. In the context of modern technology, such as cyber, security is critical for the security of the state and related issues. Science and technology have come a long way in recent years. As a result, significant changes in the law governing cyberspace are possible. The most crucial point is that advances in technology have created a slew of issues for cyber security. The reason for this is because the legislation has been changed to meet the requirements of the hour. We can argue that the effect factor of science and technology on law and society is in the shape of a broader vision and the dimension of new cyber challenges; security is a major threat to society.
As a result, the law has played a vital role in the prevention of every infraction in modern society. With the changing dimension of the form of law, the influence factor of information technology is extremely high. Finally, the study concludes with a decisive conclusion.
1 INTRODUCTION
Science and technology are extremely useful in the modern setting as compared to traditional human living standards. It benefits us in every aspect of our lives. People in the primitive times used fewer techniques. First, we are aware of the contemporary era's history. In today's modern culture, growth occurs gradually and incrementally. As time passed, society advanced in scientific techniques. However, this process is so slow that various ages have passed in the form of what exists in the contemporary day. It should also be emphasised that it has altered through time in response to societal requirements. There are numerous issues that arise as a result of the evolution. It realised that some more and more technique was needed to solve these challenges. Following this, a plethora of inventions emerge as a result of trying to discover a solution in the present setting. This is not an easy task. Change is a natural law. It may be argued that current civilization is evolving from the past and has finished the development of many ages. As a result, it has altered with the formal organisation of the society over time.
Science and technology have existed since the beginning of time. It existed in the form of that time in a reduced or smaller form of that period's discoveries. It is important to remember that no culture can live without the use of technology and procedures that are appropriate to the needs of the time. Science and technology approaches are also applied in ancient civilization.
It is not the same as it is today, but it addresses numerous aspects of the people's daily lives at the time. Inventions provided significant benefits and drawbacks, as well as the ability to solve a wide range of problems. As a result, it has expanded and changed through time, such as today's cyber security. Other features that are similar include the
link and impact of science and technology on the society and the law which is based upon that.
The law prescribes how specific acts are to be carried out. Everything is governed or regulated by law. The first is natural law, while the second is state-recognized law, which is enforced by state apparatus. Science is also based on law in the sense of nature of principles or doctrines developed by scientists. The natural law is not punished, but the state has specified which acts are punishable or not for the good of society or the betterment of the peoples. Now we come to the part where we can see how the three terms science and technology, society, and laws are related to one another, as well as how cyber security issues are addressed in the paper.
1.1 Problem Profile
The problem profile is centred on the direct impact of science and technology on law and society, as well as the dimensions of the new cyber security issues. The first question is what the complexities of current science and technology are with the execution of legislation and cyber security or related risks to cyber space. The following step is to discuss the significance, benefits, and drawbacks of the document. Science and technology, on the other hand, have provided numerous benefits. However, the evil side of new technologies is also seen in modern culture when compared to old civilization. The second issue that law enforcement organisations face is the annoyance that is created between different classes of society when content is uploaded to Facebook and messages are distributed through WhatsApp and other social sites. When a single message is widely disseminated, it causes significant disruption in the community. However, we cannot deny the importance of science and technology in everyday life.
In this work, I will attempt to investigate a new topic known as cyber security threats. The term threats refers to new upcoming future occurrences or a chain of events that are unpredictable and unanticipated security hazards. With the progression of time, technology undergoes dynamic changes, resulting in the presence of several new risks in the age of internet technology. The threat is predicated on the popular notion that nothing is secure in the modern era. The reason for this is that hackers are intelligent individuals who stole all information pertaining to computers and other electronic equipment, among other things. However, various types of higher-level risks exist in the sphere of internet technology. The state is the source of sovereignty. We are concerned here with the relevance of skills and other information technology machinery that alters state relations. It is the most crucial factor for the consideration of the entire authorities be running is with this power in the sphere of cyber world. It is concerned with the intellectual abilities of the state, which is best capable of changing the relationships.
1.2 Objective
The purpose of this paper is to assess the current condition, which is most significant for today. We are aware of the world in terms of what has occurred throughout the universe.
Life has changed in all sectors of the world's different interconnected fields. The introduction begins with an explanation of what is going on, what needs to be improved, and whether or not we will succeed. Another question is if it is fair. The modern legislation is useful or helpful for the prevention of all infractions, which influence all aspects of life. In what way can we take it as a matter of thinking about what is bad for the environment, technology effects, or data privacy, and so on? The concerns are being resolved in the solution that appears to be more appropriate.
One section of this article discusses the effects of science and technology on law and society. The second is the shifting proportions of emerging cyber security challenges. The section discusses what it means when science and technology alter the law. The same section of this page has offered information about the additional dimensions, or expanded conceptions, in the setting of cyberspace. The title of the study makes it obvious to what extent we can imagine the changing scenario in all aspects of life. Another point of contention is the extent to which technological advances and new innovations influence our daily lives. Science has played a very well defined role; in other words, we can say more than we expected. It is incredibly useful inventions that have made our lives easier. Science
has offered numerous benefits that cannot be quantified. The prospect has arrived in the sense of little effort with maximum advantages in all aspects of life.
2 IMPACT OF SCIENTIFIC ADVANCEMENTS ON THE SOCIETY & LAW
Law is becoming increasingly important in the governance of science and technology, especially the ethical implications of scientific study and emerging technologies. The relatively new discipline of law, science, and technology tries to comprehensively investigate the various ways in which legislation interacts with science and technology.
Law, science, and technology has been defined as "the discipline that deals with how our legal system can and must adjust to accommodate the problems created by the ever more urgent and ubiquitous impact of technology on society" (Wessel, 1989) and as seeking
"to determine how the various processes of law—primarily judicial and legislative—respond to changes brought about by scientific advances" (Green, 1990).
The previous discussion shows that science and technology have an impact on law and society in both positive and harmful ways. We cannot survive without technology in the current circumstances. It is a big comfort for us because life has been so difficult without facilities. Science and technology begin with little inventions and progress to significant inventions that are a part of our daily lives.
It is inextricably linked to our daily lives. In every field, the computer and all of its facilities are smoothly working to make the process simple and comfortable. Life has been transformed into a technological marvel. Medical, education, agriculture, and all other fields have become completely reliant on technology, and this would not be possible without the assistance of scientific breakthroughs. It is also critical for a progressive civilization to adopt procedures that are newer or updated from previous versions of the same discoveries.
This appears to be more effective than the traditional way of life of the world's inhabitants.
All internet transactions are a component of modern business, and they are made possible by science and technology.
It is conceivable when the interchange of numerous trades on a national or international scale has a high degree of diversity in today's world. We can't imagine how much technology has contributed from a modern standpoint. Through science and technology, the globe is connected as if it were a global village. It is an adventure in all sectors, not just at the national level, but also on a larger scale.
The advancement of technology has resulted in a plethora of complexities and drawbacks. We are aware of hackers and other individuals that steal information and cause numerous problems for individuals. The reason for this is that nothing is secure in our times. The comprehensive drawbacks are mentioned in the title of the report, new dimensions of new cyber security concerns. We discussed how science and technology affect the law in this section. In one sense, the law exists to regulate individual people in order to avoid wrongdoing. The scientific inventions are now on display. The legislation evolved in response to the exigencies of the time. However, not all areas of information technology can still control so many difficulties.
We sometimes hear from people that a large number of transactions can be completed without any activity on the part of the user. Bank and ATM frauds, for example, are at an all-time high. These issues are still intractable on a country-by-country basis.
Every government in the world has implemented various laws, but nothing has worked.
This is one example of how science and technology have affected law and society. The second is similar to environmental degradation, but the problem persists.
The law governs the behavior of society's citizens. It is established framework what can and cannot be done. When compared to society, the impact of science and technology on law is significant. Many rules exist in each country to prevent unlawful transactions on the internet or directly dealing with scientific techniques. We cannot deny the impact of scientific discoveries on our daily lives. Science and technology cover many aspects of life, such as mobile phones, laptop computers, educational institutions, and all other aspects of life. As a result, the various levels of nations or worldwide scientific agreements create regulations to govern the several distinct types of activity. The law is based on the assumption that everything it deals with is governed by rules and regulations. The law determines what constitutes the actual procedure and what constitutes a breach of the
specific legislation. However, in many circumstances, exclusions exist, implying that the laws are settled for violations of the criminal acts of the individual, all legal people, or all other individuals, which includes all other authorities.
In simple terms, the meaning of advancements in the context of science and technology is that it deals with the criteria of the extended version of the previous one. It follows from this assumption that when one field is covered to another region of the specific institution or authorities is an extension of the previous one. Nature keeps altering from time to time. Another component, previous inventions, is no longer relevant now. It has been exhausted from the current scenario because it has not been completed. As a result, the conversion is from old to new based on the rule of natural law, as change is a natural law.
The new ideals are the polar opposite of the global world's living standards. In the form of the present, science and technology have transformed many things from complex to simple. It is obvious if we look at all of the inventions that have been changed into new ones in the past. This occurs when new laws, rules, regulations, orders, byelaws, notifications, and ordinances take effect on the date when the old ones are replaced. Pollution is caused by the expansion of industry and other forms of little and significant undertakings air, water, and so on. This result of scientific findings causes a plethora of issues. The advancement of science and technology has also resulted in the emergence of deadly diseases. The entire ecosystem has been poisoned by numerous human activities. This means that, while science and technology have provided numerous benefits, they have also generated a slew of serious issues that are still unresolved today. Science and technology define not only the easy way of life of people, but it can also be seen as one of the most vulnerable and complex problems we face today in the form of environmental degradation.
Science and technology have the same impact on law and society. It can be seen in modern society that fixed laws are revised, revised, or enacted by numerous states. This demonstrates that law and society are dynamic concepts. It is not fixed. The evolution of law is evident in the fact that society has adopted new things, and the law has been amended to meet the needs of society. For example, when new items enter our lives, all existing issues become converse in the form of current law. The law is for the people, and when a law is no longer valuable to society, it can be amended or repealed. These objectives can be accomplished through social transformation within the context of scientific advancement. Science and technology play important roles in the advancement of society and legislation. It does not imply that the authority to make laws is vested in scientific discoveries. It is in the understanding of the more and more creations that the virtues and demerits might be created. The impact of science and technology on law is such that new things assist in the creation of new laws that replace one of the substring continuing laws.
We are aware that new technologies are beneficial in that no problem is sought out; but, if the state has not addressed the issue through established laws, new laws must be enacted to prevent various violations. This is dependent on whether it is correct or incorrect. The accepted laws establish whether the situation amounts to an offence or not. The development is based on both positive and negative aspects. Science, technology, law, and society all existed in primitive society, as evidenced by ancient sources. It is the human being's wisdom that has been developed stage by stage. It was a demand for the society's necessities. With the passage of time, science and technology, which are yet in their infancy, evolve and society changes in a constant process.
Through numerous laws, the law contributes to the transformation of society from rigid to simple. It is well recognized principles that can regulate the behavior of the entire society. However, it should be highlighted that without the assistance of science and technology, it is not possible to be as developed as the modern concept of what is law as it exists now. As a result, numerous innovations, concepts, and ideas can be exchanged in the scholar of that historical period of society. Here, we are concerned with the entire universe, not just a specific portion of the earth. It signifies that, while it varies from country to country. It should be emphasized that the two states do not have the same level of development. It differs in many ways, such as cultural values or practices. These two factors are critical to the development of the specific society. It is concerned with the region's internal factors. The country's cultural values or customs are projected to grow in
comparison to the people's traditional way of thinking. This is directly related to science and technology, which has an impact on the entire society or a specific portion of the world.
This means that in every breakthrough, ideas are adopted by a group of like-minded individuals. It has provided people with an increasing number of prospects for fresh discoveries. The significance of science and technology is not limited to our imagination. In the form of inventions, it progresses from little to large.
Another factor examined in the research is the size of emerging cyber security challenges. On one one, the broadened definition of science and technology deals with beneficial advancements, but on the other, it is concerned with dangers related to cyber security and other related issues. The privacy life is not secure in the face of such advancements, and it is one of the most significant challenges in the current era. What is the measure to prevent the dangers of cyber security is not fulfilled in modern technology instruments even now. When these types of violations occur, the laws are strictly applied and implemented. The image relating to cyber security is rather grim. It cannot say what is secure and what is not secure. The following are the pertinent issues.
Privacy and data theft will be the main security challenges on which enterprises must concentrate their efforts. We live in a world where every information is available digitally. Social networking services provide a safe environment for users to engage with friends and family. In the case of home users, cybercriminals would continue to target social media sites in order to steal personal information. There will be new attacks against Android-based devices, but they will be limited in scope. Because tablets and smart phones use the same operating system, they will soon be targeted by the same virus.1
3 WHY CYBER SECURITY IS A BIGGER ISSUE NOW?
Over the last five years, most multinational corporations have significantly improved their cyber security capabilities. Formal processes for identifying and prioritizing IT security risks, as well as developing mitigation methods, have been put in place, and hundreds of millions of dollars have been set aside to put these plans into action. Desktop environments are significantly less "open" than they were even five years ago, thanks to the disablement of USB ports and the blocking of Web mail services. To counteract perimeter attacks, strong technologies and activities have been put in place.2
Value is increasingly migrating online, and digital data is becoming more widespread. Why are some organizations seeing more internet threats each hour than they did in a month just a few years ago? With respect to Willie Sutton, that's where the money is. Simply put, more online transactions provide greater incentives for fraudsters.
Corporations are expected to be more „open‟ than ever before. Increasingly, people working in business units are demanding access to corporate networks through the same mobile devices that they use in their personal lives.
Supply networks are becoming more intertwined. Companies are pushing vendors and customers to join their networks in order to enhance relations with customers and optimize supply chains. However, because of this involvement, it is very hard to isolate a company's IT environment.
Malevolent agents are growing in sophistication. Professional cybercrime organizations, political ―hacktivists,‖ and state-sponsored groups have improved technologically, outperforming the expertise and resources of corporate security teams in some circumstances. Hackers provide "cybercrime as a service," charging a fee for each end user device infected with malware. As a result, increasingly intricate, targeted attacks have occurred in the last five years. Malware is far more difficult to track down these days, and it is frequently tailored to steal data that can be utilized for financial advantage.
Cyberspace is the fictitious world in which computer networks communicate. The phrase gained popularity in the 1990s, when the use of the Internet, networking, and digital communication were all expanding rapidly, and the term "cyberspace" could represent the many new ideas and phenomena that were emerging.
With its unique qualities, cyberspace, as explained above, provides significant issues in cyber security. The most significant problem is coordinating and cooperating among various stakeholders at the national and international levels. To enable synchronized response, recovery, and intelligence, a complete structure is required and a system for sharing information, as well as clarity in duties and responsibilities of various agencies and governments.
A telephone call appears to take place in cyberspace. Not inside your phone, but rather the plastic device on your desk. Not in the other person's phone, in a different city.
The space in between the phones. [...] In the last two decades, this electrical "space," which was once small, gloomy, and one-dimensional—little more than a narrow speaking tube stretching from phone to phone—has burst itself open like a massive jack-in-the-box. The eerie light of the glowing computer screen has flooded it. Thus, the concept of cyberspace relates not to the material offered to the surfer, but rather to the ability to surf between multiple sites, with feedback loops between the user and the rest of the system generating the possibility of always encountering something unknown or unexpected.
3.1 Sovereignty and Jurisdictional Fragmentation
The problem of jurisdictional fragmentation stems from the fact that it does not and cannot agree with cyberspace's global nature. Jurisdiction, which is inextricably tied to the concept of state sovereignty, imposes a sovereign state's exclusive duty over its territory and/or its population, hence excluding any extra-jurisdictional engagement of other governments. The sovereign equality of states is safeguarded by customary public international law standards.
As a result, no state can claim control over cyberspace and impose meaningful legislation on it.3
4 CONCLUSION
Finally, we may state that science and technology are quite valuable in modern days.
However, it is not specified to what extent. Science and technology have an impact on the law and society. People use technology, and as a result of the implications of technology, laws are required for the betterment of society.
In the paper, the impact of science and technology in terms of how it is used or misused by people has been examined. What are the new dangers or dimensions of cyber security are also misunderstood. We can arrive at the conclusion in the form of, because both merits and demerits are present. The impact of research and technology is so great that modern existence would be impossible without science and other linked capabilities.
However, the law has the ability to restrict these types of activity. Science and technology have an impact on law and society. The law specifies certain regulations that can be used to investigate any form of infraction and, if necessary, impose specific sorts of penalty.
The second big issue is cyber security, which can also be covered by numerous Acts or legislation. Nothing is safe, as the idea implies. Various laws defend the fact that nothing is secure. It deals with prevention by enforcing the required legal procedures. It is possible to accomplish this through the use of legal preventive measures. Cyber security is not attainable, but attempts are the finest thing for any breach of anything that is illegal.
Finally, I conclude that the three terms are inextricably linked. Science and technology, as well as law and society, are inextricably linked. It means that from history to the present, everything is happening at the same time. However, in the present era, it may be claimed that it deals with more and more close relationships. Science and technology are governed by legislation in terms of life's necessities. The laws defined the conditions under which the facilities were enjoyed, as well as the likelihood of the goods being utilized or mistreated. However, the law clearly declares what is and is not to be done for various things in the specific context of the established style of the people's conduct. With the dimensions of the new cyber security challenges, science and technology have had a significant impact on law and society. It broadened the concept in all fields of the law.
It addresses the most essential issues that, aside from science and technology, have an impact on the environment and all other elements of existence. It is impossible to refute the reality that so many unfavorable aspects of modern growth are available. It can be checked with the many laws that are strictly enforced by the governmental apparatus. The
state's role is important for the prevention of all forms of violations, which cannot be prevented unless strong measures are taken against all individuals who are defaulters in the area of environmental protection. This is critical for environmental conservation as well as cyber security. The report concludes with a firm conclusion.
