439 THE CRIME OF VIOLATION OF THE RULES OF USE OF PYROTECHNICS AND THE

ANNOTATION
The article dedicated to the statuses of state control over the circulation of pyrotechnic devices in the territory of the Republic of Uzbekistan, the cases identified by the National Guard of the Republic of Uzbekistan on the illicit trafficking of pyrotechnic devices moreover opinions and proposals on the powers of the National Guard of the Republic of Uzbekistan in combating and preventing the crime of violating the rules of use of pyrotechnic devices.

INTRODUCTION
The greatest task of the state to citizens is to protect their rights, freedoms and legitimate interests. One of the main tasks is to take care of the health and safety of citizens, as well as to ensure it. Public safety has a great importance in this regard. Therefore public safety is so crucial issue all over the world nowadays. The Republic of Uzbekistan also pays great attention to this sphere thus large-scale work is being carried out in a comprehensive and high-quality manner. The Republic of Uzbekistan adopted two important documents on public safety just in November 2021. These were: "Strategy for the development of public security in the Republic of Uzbekistan in 2022-2025" and "Concept of Public Security of the Republic of Uzbekistan."
Paragraph 1 of the “Concept of Public Security of the Republic of Uzbekistan” defines the concept of public security, according to which public safety is the state of protection of society from unlawful aggression, social and interethnic conflicts, emergencies and other threats it serves the sustainable development of society and ensures the realization of human rights, freedoms and it serves the sustainable development of society and ensures the realization of human rights, freedoms and legitimate interests.
We can also see the illegal use of pyrotechnic devices against law as a threat to public safety.
Although the danger is not high, it is causing serious hazard to human health. This is because when the person who uses it can get various injuries himself first of all, on the other side it can cause a variety of injuries, harm to others. According to doctors,because of its sudden intimidation the sound of pyrotechnics has a very negative effect on the cardiovascular system.
In particular, children suffer from it who find it as a simple toy or a means of entertainment.
These include burns, several injuries, and even we can see some people who lost of limbs, eyesight and hearing.
What is pyrotechnics , what do we mean by pyrotechnics? As defining the concet of pyrotechnics, the word "pyrotechnics" is derived from the Greek word: "pyr" - fire and "techne" - art, skill. The art of fire and its control dates back to ancient times.

440 The Republic of Uzbekistan is waging a comprehensive fight against the illicit trafficking of pyrotechnics. Particularly, the National Guard of the Republic of Uzbekistan is making a lot of efforts to combat against it.
The cases provided to implied crimes that are written in first part of Article 250 [1] of the Criminal Code of the Republic of Uzbekistan (illegal handling of pyrotechnic articles) (except for crimes related to violation of customs legislation) is carried out by the National Guard and its local units according to DRU-548 of June 8, 2019 "On amendments and additions to the Criminal, Criminal Procedure Codes of the Republic of Uzbekistan and the Code of Administrative Liability of the Republic of Uzbekistan" and according to Article 381 [2] of the Code of Criminal Procedure of the Republic of Uzbekistan.
The National Guard and its local branches investigated 48 criminal cases, most of which were investigated under Article 250 [1] of the Criminal Code in 2021.
According to Chapter 2 of the Concept of Public Security of the Republic of Uzbekistan (state regulation of public safety), the National Guard of the Republic of Uzbekistan is a public security entity. The National Guard is also responsible for ensuring public safety during public events under Article 9, paragraph 3. Therefore, it is efficient to allow the use of pyrotechnic devices during public events, especially in coordination with the National Guard to ensure public safety at the event.
Paragraph 3 of the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan "On measures to strengthen state control in the field of circulation of pyrotechnic articles in the territory of the Republic of Uzbekistan" No. 724 identify that The Ministry of Internal Affairs of the Republic of Uzbekistan will cooperate with the State Customs Committee and the State Tax Committee responsible for control detection and elimination of cases of illegal import, production, transportation, storage, sale and use of pyrotechnic devices and take action of bringing the guilty persons to justice according to the law.
The National Guard of the Republic of Uzbekistan is responsible for combating the illegal use of pyrotechnics,therefore National Guard should be concerned about its prevention. In addition, the National Guard of the Republic of Uzbekistan is included in the list of entities engaged in crime prevention in the Law of the Republic of Uzbekistan "On prophylaxis of offenses " dated in May 14, 2014.
In this case in accordance to Law of the Republic of Uzbekistan "On Prophylaxis of Offenses "
while the National Guard of the Republic of Uzbekistan is involved in crime prevention I consider and recommend as a separate section that it will be effective to add in the obligation and tasks of them “To combat the illegal use of pyrotechnics, to prevent this situation and to study and eliminate the causes, the conditions that causes it” .
In conclusion, it is no secret that the young and the old suffer from the illicit treatment of pyrotechnics and even inflict irreparable serious injuries surely. Therefore, the fight against the illegal use of pyrotechnics is the duty not only of the National Guard of the Republic of Uzbekistan, but also obligation of all of us.
