2010년 섹션 202 노인지원주택법 개정

노인지원주택을 위한 임차지원사업에 관한 1959년 주택법(Housing Act of 1959)을 개정하였다. 합리적 사업비용을 조 달하기 위하여 주택 및 도시개발부(Housing and Urban Development) 장관이 임차지원사업 연간 계약대금을 조정하는 권한을 자유재량에서 의무적인 것으로 변경하였다. 장관이 지원주택 소유자가 무주택 노인에게 임차를 우선적으로 줄 수 있도록 허가하게끔 규정하였다. 본 법은 2000년 미국인 주택소유권 및 경제적 기회법을 개정하여 (1)프로젝트형 임차주 택지원사업 부채변제 (2) 비지출자금의 사용, (3) 사업잔여금의 사용 등을 규제하는 요건사항을 개정하였다. 연장자보호 임차료지원계약을 규제하는 요건 등을 규정하여, 리파이낸싱이나 자본재구성(recapitalization)의 경우 노인사업 거주자 의 주거상실을 예방하고, 노인사업보호 및 활성화를 증진시키고 있다. 노인주택을 지원생활시설(assisted living facility) 로 전환하는 것에 대한 보조금(grants)에 관하여 지원생활시설(assisted living facility)의 정의를 확장하였다. 주된 주거 공간으로서 지원생활시설(assisted living facility)을 사용하는 가족을 위한 임차료 지원에 관하여, 1937년 연방주택법 (United States Housing Act of 1937)을 개정하였다. 구체적으로 그 가정은 임차료 지원을 최초 받는 시점에 월조정수 입(monthly adjusted income)의 40%를 넘는 금액을 임차료로 지급하여야 함을 규정하고 있다. 장관은 전미 연장자주 거정보센터(clearinghouse)를 설립 및 운영하여야 한다.

2010년 도보자안전증진법 개정

2010년 도보자안전증진법(Pedestrian Safety Enhancement Act of 2010)은 교통부 장관에게 단계적 모터 자동차 안전 기준 규제입법을 주도하도록 하고 있다. 구체적으로 정부는 자동차 또는 기타 장치가 시각장애인 및 기타 도보자들에게 안 전경고를 하기 위하여 발산하는 최소한의 소음수준을 연구하여 연방의회에 제출하여야 한다. 따라서, 정부는 장애인이나 기타 도보자들이 근처에 있는 전기 또는 하이브리드 자동차로서 일정속도 이하로 운행하는 차들을 감지할 수 있도록 경고 음 발산의무화 기준을 설정하고, 자동차들은 해당 기준에 맞추어 경고음을 발산하여야 하는 의무를 지게 된다. 본 법은 또 한 규제입법을 만들기 위하여 전미 고속도로교통안전국의 책임자에게 국고를 배당하도록 하고 있다. 2010년 12월 9일 상 원에서 통과된 원안이 그대로 법률로 입법되었다.

2010년 프랭크 멜빌 지원주택투자법

장애를 가진 사람을 위한 주거지원요건을 개정하기 위하여 전미 주거공급법(affordable housing act)를 개정하였다. 하 지만 이러한 주거지원을 확대하기 위하여 비영리민간기관에 대한 지원제공권한은 유지시켰다. 하지만, Housing and Urban Development (HUD)의 장관이 직접 장애인에게 임차료 지원을 제공하는 권한은 폐지하였다. 프로젝트 임차지원 계약요건과 연간 계약대금의 갱신 및 증가를 개정하였다. 저소득 주거세공제 또는 세금면제 주택채권으로 지원받는 사업 스폰서와의 최초 계약은 기간을 최대 360개월로 하고 60개월 동안 자금을 제공하도록 하였다. 주택소유자와 임차인과의 임대계약은 최소 1년 이상이 되어야 한다. 지원주택에 대한 비용제한 적용을 개정하고, 장관은 이러한 비용제한을 포기할 수 있도록 하였다. 다가족 사업을 위한 회계연도별 자본금 선급금의 최소비율을 확립하였다. 또한 저소득 장애를 가진 비 노인계층 및 최소한 사람의 장애인을 포함한 최저임금가족에 대한 지원주택 제공을 확대하기 및 임차지원 프로그램을 효 율적으로 운영하도록 하였다. Comptroller General(회계감사원장)은 장애인 가정 지원사업의 적합성 및 효율성에 관한 보고서를 의회에 제출하여야 한다.

알츠하이머 사업법

미 보건복지부(Health and Human Services [HHS]) 장관실에 전미 알츠하이머사업국을 설립하는 것을 주요내용으로 하 고 있다. 본 법은 구체적으로 이하의 사항을 목적으로 하고 있다: 1) 알츠하이머 진행을 막기 위한 치료방법 개발을 가속화 함, 2) 알츠하이머를 극복하기 위한 통합계획을 만들고 유지함, 3) 알츠하이머병을 가진 시민의 건강보호와 치료를 협력 지원함, 4) 알츠하이머 발병률이 높은 인종과 낮은 인종을 임상실험이나 리서치에 포함시켜 인종간 격차를 해소함, 5) 병 퇴치를 위한 전 세계적 공조를 강화함, 6) 모든 연방기관에 걸쳐 알츠하이머 리서치 및 서비스 정보와 협력을 제공. 또한 알츠하이머에 관한 모든 연방사업을 평가할 부서책임자의 재량권과 관련의무를 규정하고, 알츠하이머 리서치 및 치료 자 문위원회를 부서 내에 설립하고 있다.

2010년 국경지역 부패방지법은 국토안보부의 장관(Secretary of Homeland Security (DHS))에게 이하의 사항을 이행하 도록 하고 있다: (1) 본 법 제정 후 2년 이내에 미연방 세관 및 국경보호국(U.S. Customs and Border Protection (CBP)) 의 법 강제집행 부서 지원자들이 해당 부서에 고용되기 전에 거짓말탐지 조사를 받도록 의무화하고, (2) 본 법 발효 후 180 일 이내에 미연방 세관 및 국경보호국(U.S. Customs and Border Protection (CBP))은 상기 법강제집행 부서원들의 신 상배경조사를 정기적으로 실시하도록 하고 있다. 따라서, 국토안보부 장관은 국토안보에 관한 하원 및 상원위원회에 정기 적으로 경과보고를 하여야 한다.

을 개정하여 2011년 5월 27일까지 이동식 전자감시권한(roving electronic surveillance authority) 부여 규정을 연장하 는 것을 내용으로 하고 있다. 본 법은 동시에 “2004년 정보개선 및 테러리즘방지법 (Intelligence Reform and Terrorism Prevention Act of 2004)”을 개정하여 “해외 권력(foreign power)의 대리인(agent)”의 정의를 개정하는 규정을 2011년 5월 27일까지 연장하였다. 해외권력 대리인은 국제적 테러리즘이나 약탈적 행위(“외로운 늑대[lone wolf]"규정)에 참여 한 모든 비미국인을 포함하였다. 이러한 개정은 사업행위 기록(business records)과 개인적 테러리스트에 대한 정부의 정 보접근과 관련된 것이다. 본 법은 하원 사법위원회(House Judiciary)와 하원 정보위원회(House Intelligence)의 심사를 거쳐 하원에서 먼저 통과한 후 상원에서 통과되었다. 본 법률은 전문과 섹션 1. 법률명(Short title)과 섹션 2. 특정규정의 종료연장(Extension of sunsets of provisions relating to...) 등 3개의 부분으로 구성되어있다.
