INTRODUCTION

SCOPEThe scope of
this project
paper concerns theposition
of the Syariah courts systemin
Malaysia.It is
the upmost important to discuss thesituation
of the Syariah courts because the establishment of the syariah courtsreflect
the status of Islam as being theOfficial
Religion of Malaysia.This paper
will
also make an attempt to discover, thatis
to what extend has the Syariah courts succeededin
implementing the Islamic Law as conceivedin
the A1 Quran and the A1 Hadith, because as thesituation
stands now, the implementation of the Islamic Lawis
moreinclined
towards the modernlegislation.

background of the Islamic Law before thearrival

Under the second sub headingthis
paperwill
venture size to what extend has theBritish intervention

implementing the English Law to replace the Islamic Law which has beenpractical

to the effectiveness of the Syariah courtsin
implementing Islamic Law.Attention will

of thecivil
law and theCivil
Courts against the Islamic Law and the Syariah courts.The problems cause by the various Enactments which govern each
particular
states administration problem under the Religiousoffice,
the lack offacilities
andofficers,
and the problem regarding theposition
of the Kathiwill
also be discussed underthis
ChaptezxUnder Chapter
five, this
paperwill try
to suggest various reformsin
order to put the Syatiah Courtsin its
trueposition
as thejudicial
administrator of the Islamic Law.Such reforms as to amedment to the Federal
constitution,
theuniformity
of the various Enactments plus some other suggestionswill
belaid
downin this
paper,in
the hope that the Syariah
