4. INDUSTRIAL TECHNOLOGY DEVELOPMENT INSTITUTE (ITDI) reserves the right to accept or reject any bid, to annul the bidding process, and to reject all bids at any time prior to contract award, without therebyincurring any liability to the affected bidder or

bidders.

5. The Bidders shall submit three (3) copies of their duly accomplished eligibility requirements, Technical and Financial Proposal into one (1) sealed envelope.

6. The ITDI reserves the right to reject any and all bids, declare a failure of bidding, and not to award the contract if 1.) there is a prima facie evidence of collusion between appropriate public officers or employee, or between the BAC and any of the bidders

themselves, or between the bidders and a third paty, including any act which restricts suppresses, or nullifies or tends to restrict, suppress or nulliy compelition; 2.) the BAC is

found to have failed in the prescribed bidding procedures; or 3) for any justifiable and reasonable ground where the award of the contract will not redound to the benefit of the government ^as defined in the ^IRR.
