บทคัดยอ
วิทยานิพนธนี้มุงศึกษาปญหาทางกฎหมายในการควบคุมการจําหนายพืชปาโดยพิจารณา ถึงกฎหมายที่ไดมีการอนุวัติตามอนุสัญญาวาดวยการคาระหวางประเทศซึ่งชนิดของพืชปาที่ใกลจะ สูญพันธุตามสนธิสัญญา “ไซเตส” เมื่อการคาพืชปาเปนธุรกิจที่สามารถสรางกําไรไดโดยไมตอง ลงทุนเมื่อเปรียบเทียบกับผลประโยชนที่ไดมาอยางมหาศาล อันเปนสาเหตุสําคัญที่ทําใหพืชปาลด จํานวนลงอยางรวดเร็ว ซึ่งเกิดจากปญหาความไมชัดเจนในบทบัญญัติกฎหมาย การใชอํานาจหนาที่
ของเจาหนาที่ในการออกใบอนุญาตหรือใบรับรองการนําเขา สงออกหรือนําผาน ซึ่งพืชปาและ ปญหาความเปนเอกภาพของกฎหมาย แมในประเทศไทยจะมีการควบคุมพืชปาอยูหากมีการกําหนด ความหมายและวิธีการควบคุมการจําหนายพืชปาไวอยางชัดเจนอาจสามารถแกไขปญหาการคาพืช ปาได
จากการศึกษาพบวาการควบคุมการจําหนายพืชปาตามกฎหมายที่ไดมีการอนุวัติตาม อนุสัญญาไซเตสและกฎหมายที่เกี่ยวของกับการควบคุมการจําหนายพืชปานั้นไมมีประสิทธิภาพ เพียงพอในการที่จะบังคับใชกฎหมายและความไมชัดเจนในคํานิยามของบทบัญญัติแหงกฎหมาย และอํานาจหนาที่ของเจาหนาที่ในการออกใบอนุญาตหรือใบรับรองการนําเขา สงออกหรือนําผาน ซึ่งพืชปาพบวาเปนการออกใบอนุญาตของอธิบดีหรือผูซึ่งอธิบดีมอบหมายและการออกใบอนุญาต ของพนักงานเจาหนาที่ไมสอดคลองกันและความเปนเอกภาพของกฎหมายที่ไมมีความเปนหนึ่ง เดี่ยวกัน เพื่อนําไปสูการแกไขปรับปรุงเพิ่มเติมบทบัญญัติของกฎหมายภายในประเทศไทยหรือการ ออกกฎหมายเฉพาะ เพื่อควบคุมการจําหนายพืชปาที่อยูในปาธรรมชาติโดยตรงในอนาคตไดจะทํา ใหประเทศไทยมีกระบวนการควบคุมการจําหนายพืชปาที่ชัดเจนและเกิดความสําเร็จในระดับ มาตรฐานสากลที่สูงขึ้น

ABSTRACT
This thesis emphasized to study the legal problems in controlling of wild plant distribution, considering the laws which complied with the CITES Convention related to international trade. The types of wild plants are endangered species under “CITES” convention when the trading of wild plants is the business which can create profit without investment when it is compared with the huge benefit which is the important cause making the number of wild plants to reduce a lot quickly; this is caused by unclearness of the provisions of laws, exercising of authority and duty of officers in issuing licenses or certificates of import/export or transit of wild plants and problems regarding unity of laws. Even though Thailand has controlled wild plants, if there is defining of meaning and method of controlling of wild plant distribution clearly, it may solve problems of wild plant distribution.
From studying, it was found that controlling of wild plant distribution under the law which complied with the CITES Convention and laws related to controlling of wild plant distribution, was not effective enough for enforcing of the laws and there was unclearness of definitions of the provisions of law and authority and duty of officers in issuing licenses or certificates of import/export or transit of wild plants, it was found that it was the issuance of license of Director General or persons that the Director General assigns and issuance of licenses of officers which is not in harmony and unity of laws which does not have unity. This will bring to modification, improvement and adding of the provisions of laws in Thailand and legislating of

specific laws, to control wild plant distribution in natural forests directly in the future. It will make Thailand to have clear process of controlling of wild plant distribution and there will be higher success in international standard level.
