Comparative study between Islamic and positive law
Abstract
The study explored the crime of sexual harassment of children and its punishment inboth Islamic law and the positive law, where the study began with an introduction contains the subject of the study which is the crime of sexual harassment of children being one of the most serious crimes affecting the entity and the structure of society; and accordingly the main question of the study can be formulated: what is the sexual harassment of children, and what is its penalty?
The study employed a comparative analytic inductive method where legitimate texts related to the subject of research were surveyed and compared with the positive law of various States, also adopted the deductive analytical method with reference to general crimesprovisions in Islamic law and applying it to this crime.
The study where divided in to an introductory section titled with:The Extent of sexual harassment crime of children at local and international level. On the other hand, the first chapter weretitled with:What is the crime of sexual harassment of children and its effects, where the second chapter have the title of: The Elements of the crime of sexual harassment of children in both of Islamic and positive laws.Finally, the study were concludedwith a number of results, the most important ones of it are: The crime of sexual harassment of children is forbidden and criminalized in all legislation and positive laws, despite the fact that the positive laws delayed in criminalizing it; also Indicating that Saudi legislatoris preeminent in terms of allocating provisions criminalizing sexual harassment of children included in both the child protection, and protection from abuse laws.As a matter of fact, it also turns out that there is a regulatory void in the comparative laws in terms of the absence of provisions of sexual harassment of children in particular, and show a lack of specialized studies in this crime and the scarcity of statistics concerning it.The study formalized a number of recommendations, notably the importance of further scientific studies dealing with childhood sexual abuse legally from various aspects , And the importance of intensifying the punishment for child sex offenders through identified provisions stating the minimum limit of punishmentbut with no upper one, in addition to a public discredit, in parallelto an intensive field campaigns to educate the community legitimatelyand legally about this crime.
