Introduction

The need for the Study

A municipality's Disaster Management Plan must be aligned with the Municipal Infrastructure Investment Plan (MIIP). Disaster management in the context of current legislation was implemented in the first financial year.

Objectives of the Study

Once again, the resources and skills of a municipality will determine their ability to develop the necessary infrastructure and establish disaster management structures and facilities in relation to legislation. It is against this background that the study has focused on a newly established rural municipality with the aim of meeting challenges.

Introduction

The Disaster Management Act23 recognizes that disaster management concerns people's lives and is therefore closely related to service delivery.

Public Health

This chapter explores the synergy between public health, public health law, disasters and local government. Finally, the public health assurance aspect ensures that the identified services will be provided.

Public Health Law

Public health activities change with changing technology and social values, but the main goals remain the same, ie. Public health does not deal with health at the level of the individual, but at the level of the entire population.

Role of Local Government

Many of the patients lost their routine medications, diabetes supplies, asthma machines, etc. from the flood. None of the respondents are aware of any consultation process involved by the local government regarding disaster management. It can be expected that the Australia/South Africa Local Government Partnership initiative in the development of the district municipality's disaster management plan should have covered the consultation process in Indwedwe.

Summary of the Chapter

In this chapter, the various definitions of public health, public health legislation and their distinctive features were outlined. The chapter highlighted the legislative requirement to ensure that the disaster management plan is incorporated into the municipality's integrated development plan.

LEGISLATIVE AND CONSTITUTIONAL BASIS FOR DISASTER

History of Local Government

The negotiations on the future of local government took place in the Local Government Forum (LGNF). According to Pillay and Liebenberg, the following are some of the values ​​and principles of local government.

Relationship between National, Provincial and Local Government

Category A - this category is "metropolitan area": ​​A municipality that has the exclusive authority to administer and set rules in its area.   • Understanding Integrated Development Planning

In order to understand development, [Burton: 109]108 is of the opinion that the development and the environment are inseparable. The recent efforts to promote an integration of environmental considerations in development planning are an explicit recognition of the failure of the development approaches. It is argued that poor people consist of the vulnerable group that mostly includes women, the elderly, children, the disabled, explaining that such a group would not be in a position to organize.

This reflects disparities in access to services in rural areas and contributes to poverty-related diseases115. According to Articles 152 and 153 of the South African Constitution117, local government is responsible for the development process in municipalities, as well as for municipal planning. The White Paper on Local Self-Government is in line with the spirit of the Constitution, as it explicitly addresses integrated development planning as a tool for the development of local self-government.

Integrated development planning can contribute to the eradication of the development heritage of the past, thereby enabling the concept of developmental local self-government to function and encouraging participation in management119.

Roles and Responsibilities of District and Local Municipalities in respect of Disaster

In the floods of 1987, the respondents are aware of the involvement of churches, the Red Cross and other organizations. Local communities in the study area have been excluded from access to emergency and disaster facilities. The rural nature of the area results in a higher number of women in the area as opposed to men.

The integrated nature of planning seeks to ensure that all communities have a community safety plan defined in legislation as a disaster management plan. This community safety plan is only valuable to the extent that it affects community safety. The study has shown that non-availability or lack of infrastructure is a major determining factor in disaster management planning.

The intention is for municipal investment planning for infrastructure to be aligned with disaster management planning. This study also found that the distribution of settlements, allocation of land for agricultural purposes and other land use decisions should be coordinated, taking into account the need for disaster management.

This study adds that disaster and emergency stakeholders should involve rural women and industrial actors involved in the area in defining disaster management requirements. At the heart of these policies should be the aim to achieve equity in access to disaster management facilities. One of the main policy challenges is therefore reimbursement for disaster management services provided.

The disaster management planning process must categorize the entire municipal area according to applicable emergency and disaster risks. What has emerged from the study is that disaster management is to a large extent part of development planning. In terms of disaster management infrastructure, it is essential that the municipal infrastructure investment planning exercise should be expedited and it should prioritize disaster management infrastructure to be funded by the MIG.

This section should address all protocols and procedures to be followed and adhered to in activating the plan.

Concluding Remarks

The accuracy of the findings and recommendations on the model has been improved through the adoption of the KwaZulu-Natal Traditional Leadership and Governance Aces2, (Act No. 5 of 2005). The eThekwini Municipal Council and the eThekwini Local House of Traditional Leaders are expected to play a leading role in ensuring that rural communities in the municipal area are assisted in accessing services in terms of the general requirements of the public health law. The implementation of the model supported by this study will enrich the partnership between the two structures (municipal and traditional).
