TAKE NOTICE that Applicant, FOURTH RESPONDENT in the High Court (hereinafter referred to as “BRIDON”) intends to apply at the hearing of this matter for an order that:

1. Bridon to be joined as Second Applicant in the application between the INTERNATIONAL TRADE ADMINISTRATION COMMISSION and SCAW

SOUTH AFRICA (PTY) LIMITED (case No CCT 59/09) before this honorable Court;

2. Condonation be granted to Bridon for the late filing of this application;

3. The costs of this application follow the costs of the main application;

4. Further and/or alternative relief.

FURTHER TAKE NOTICE that the Affidavit of BAREND FREDERIK VAN DER MERWE will be used in support of this Application.

FURTHER TAKE NOTICE that the respondents are invited to respond to this application within 10 (TEN) days after this Application is lodged, by in writing indicating whether they oppose the Application, and if so, the grounds for such opposition.

FURTHER TAKE NOTICE that the APPLICANT has appointed the offices of its attorneys of record, as set out below, as the address at which it will accept notice and service of all documents in these proceedings.
