The truth about Eskom
New Book: Truth to Power by André de Ruyter Published by Penguin Random House SA
In probably the best kept secret in publishing, the explosive tell-all book by former Eskom CEO, André de Ruyter was released this past weekend.
In it, he shares his realisation why taking over as Eskom CEO in January 2020, was considered the toughest job in South Africa.
Aside from neglected equipment, ageing power stations and an eroded skills base, he discovered that Eskom was crippled by corruption on a staggering scale. Fake fuel oil deliveries at just one power station cost Eskom R100 million per month; kneepads retailing for R150 a pair were purchased for R80 000; billions of rands of equipment supposedly housed in the company’s storerooms was missing.
Faced with police inac- tion, he was compelled to plunge into a world that was foreign to him - a world of spies and safe houses, of
bulletproof vests and bodyguards. In Truth to Power, De Ruyter
tells the behind-the- scenes story of how he launched a private
investigation that exposed at least four criminal cartels feed- ing off Eskom. While fighting this scourge,
he had to deal with political interference,
absurd regulations, non-paying
municipalities, and unfounded accusations of racism, wildcat strikes, sabotage and a poisoning attempt.
De Ruyter takes the reader inside the boardrooms and government meetings where South Africa’s future is shaped, with ministers often pulling in conflicting directions. He explains how renewable energy is the cheapest and quick- est solution to our power crisis, in spite of fierce opposition from vested coal interests.
De Ruyter candidly reflects on his three years at the power utility, his successes and failures, his reasons for leaving and his hopes for the future.
As someone who worked at the highest levels of the state but is not beholden to the ruling party, he is uniquely placed to speak truth to power.
Nuwe boek: Werk soos ‘n Mil- jardêr

Klerksdorp Midweek, Klerksdorp - Go Tur- quoise for the Elderly is a campaign that can be the perfect opportunity for South Africans to renew their commitment to the safety of our senior citizens.
The awareness campaign called “Go turquoise for the Elderly” runs from May 15 to June 15 (World Elderly Abuse Awareness Day).
Unfortunately, older people are often seen as soft targets for crime, abuse, exploitation, and neglect.
Criminals prey on the elderly because they are seen as vulnerable targets. It is important to ensure that proper security measures are in place. “We cannot allow bad elements to take advantage of our senior citizens,” says Charnel Hat- tingh, Group Head of Marketing &
Communications at Fidelity ADT.
Hattingh says that for this reason their safety must be highlighted and addressed the whole year round. “Safety begins in the home, regardless of whether you live by yourself, with your partner or in a retirement village. Ensure that the locks you have fitted on windows and doors are of a good quality and will not break easily. Also keep a list of important contact numbers near the telephone so that no time is wasted in the event of an emer- gency.
“If there’s a knock at the door and you do not have a peephole, call out to the person and ask them to
identify themself. If it is a service or delivery person, do not simply open the door to them but insist on seeing their identification. Also contact their employer to confirm this, you have the right to refuse them entry into your home until you have done so and are happy that they are who they say they are.”
Hattingh adds that safety must also be a priority when out and about. “When you plan to go out, even if it is just for a short walk, tell someone where you are going and when you expect to return.
Inviting someone along is always a good idea, as is not walking in quiet, isolated areas. If you are going to the shops, never hold your handbag dangling at the straps;
keep it tucked tightly under your arm. If you are only taking along your purse or wallet, either carry it in the front pocket of your trou- sers or in an inside jacket pocket.
While shopping, never leave your handbag or anything of value, like a cell phone, unattended or in the trolley.”
It is an unfortunate real- ity that the elderly are of- ten victims of con-artists.
Hattingh says offers that sound too good to be true should set the alarm bells ringing.
“Be suspicious of anyone who tries to rush you into signing any kind of contractual agree- ment. Tell them that you want some time to read through the paperwork; go through it very carefully or ask the assis- tance of a trusted family member, friend or advisor.”
“Never freely give your personal details - including your credit card, identity or banking information - to anyone who randomly calls and asks for them. If you want reassur- ance, ask them for their details and verify those for yourself. Call them only once you are happy that the initial request was legitimate.”
Hattingh says that while senior citizens can arm themselves with these precautions, the younger gen- erations do have a role to play.
“Regularly visit or call elderly relatives or neighbours and offer to help them with chores or mainte- nance around the house. They may not be as confident as they once were when it comes to tasks like climbing onto ladders or carrying home the shopping. Knowing that you are around to help may ease some of the related stress and anxi- ety and possibly prevent them from becoming a victim of crime.”
Klerksdorp Midweek, Ork- ney - A 40-year-old Sergeant stationed at Orkney was ar- rested last week for defeating the ends of justice.
Sgt Molefe Edwin Modis- adife appeared in the Orkney Magistrates Court last week.
According to Brig Sabatha Mokgwabone, police spokes- person, they received informa- tion that he and a suspect in a
hijacking case worked togeth- er to get the victim to with- draw the case. They allegedly offered to bring him his car’s keys if he withdraw the case.’’
The vehicle was hijacked in Kanana in April and later dis- covered in a garage in Ext 21, Jouberton.
The case was postponed to May 30 for further investiga- tion.

“…an employer may not require or permit an em- ployee to work overtime except in accordance with an agreement” (Basic Conditions of Employment Act) All employers and employees need to know of a re- cent Labour Court judgment holding that an instruc- tion to work overtime in the absence of an agreement is unlawful.
Law firm Meyer, Van Sittert and Kropman has the answers…
In a recent case, a company’s site manager instructed four employees to work overtime to meet production targets but they refused, citing safety issues on the day in question. They were charged with gross insubordi- nation and subsequently dismissed.
They took the matter to the Commission for Concili- ation, Mediation and Arbitration (CCMA) to dispute the dismissals, and when the CCMA found that the dismissals were substantively fair, they applied to the Labour Court for review.
Although the CCMA commissioner found that there was a work agreement in place that bound the em- ployees to work overtime as and when necessary, the Labour Court held that the overtime clause in their contracts of employment lapsed by the time the in- struction was issued.
Moreover, on the facts there was no evidence to support any inference of an “implied or tacit” agree- ment to work overtime on this particular day. Said the Court: “…an agreement [to work overtime] could be inferred only when an employee had actually worked overtime without prior consent.”
The Court’s conclusion - without an agreement to work overtime on the day in question, the instruction
was unlawful, and the dismissal accordingly unfair.
A further finding by the Court, although of practi- cal relevance only to one employee whose agreement to work overtime remained valid, is nevertheless well worth noting: “The sanction of dismissal should be reserved for instances of gross insolence and gross insubordination as respect and obedience are im- plied duties of an employee under contract law, and any repudiation thereof will constitute a fundamental and calculated breach by the employee to obey and respect the employer’s lawful authority over him or her.”
In this case “there was no evidence that the applicant employees acted wilfully and repeatedly. A progres- sive disciplinary sanction in a form of a warning or final written warning could have availed.”
The employer was ordered to reinstate the employ- ees, retrospectively and with full back pay.
Agreement is essential: The BCEA (Basic Condi- tions of Employment Act) regulates overtime and pro- vides that overtime is voluntary: “…an employer may not require or permit an employee to work overtime except in accordance with an agreement”.
It is up to you as employer to prove that a valid agreement is in place - so whilst a verbal agreement is perfectly fine in practice most of the time, a written agreement will prove invaluable in the event of any uncertainty or dispute.
When overtime agreements lapse: The BCEA also specifies that an overtime agreement “concluded with an employee when the employee commences employ- ment, or during the first three months of employment, lapses after one year.”
Overtime:
importance of agreements
