The Chief Justice has issued the following directions:
1. The parties are directed to file written argument, by no later than, 18 November 2013, on:
(i) whether the Conventional Penalties Act 15 of 1962 may be applicable;
(ii) whether it was raised by any of the parties in the proceedings;
(iii) if not, whether a court may raise its applicability of its own accord;
(iv) whether this court may raise it on appeal;

(v) if it is applicable, how its applicability bears, if at all, on the applicants’
argument that cancellation in the particular circumstances would be contrary to public policy.
2. Further directions may be issued.
